ORAL COMMUNICATION: None
ITEM 1: COASTAL DEVELOPMENT PERMIT 98-31(NGUYEN RESIDENCE
APPLICANT: Andrew Goetz, 240 Newport Center #231, Newport Beach, CA 92660
PROPERTY OWNER: John and Connie Nguyen 16081 Santa Barbara, Huntington Beach, CA
92649
REQUEST: To permit a 2,321 square foot first and second story addition and remodel
of an existing two-story single family residence.
LOCATION: 16081 Santa Barbara Lane (west side of Santa Barbara, along the Long
Channel)
ROJECT PLANNER: Wendy Bounds
Wendy Bounds, Staff Planner, displayed a site plan stating the request is to add a total of 2,321
square feet to the existing house. The breakdown is 1,025 square feet on the first floor including the
garage and 1,296 square feet on the second floor. Applicant is also proposing to remodel the interior
of the house.
The proposal is consistent with all the development regulations of the Zoning Ordinance such as
building height, setbacks, site coverage, and the infill requirements. The proposal conforms to the
General Plan designation of Low Density Residential and the Local Coastal Program.
Staff stated a member of the public expressed concern that the addition would encroach onto an
easement on the southern property line. Staff stated that they investigated the issue and found that no
public easement existed. If the easement exists, it is a private easement covered by the CC&R's and
the City has no authority to enforce CC&R's. Staff is recommending approval of the proposed
request as it is consistent and conforms with the City's General Plan and Zoning Ordinance.
Herb Fauland, Zoning Administrator, asked staff if they had received any notification that the
Homeowner's Association had reviewed and approved the request. Staff stated they had not.
THE PUBLIC HEARING WAS OPENED.
Andrew Goetz, 240 Newport Center 9231, Newport Beach, CA, applicant, raised the issue of the
CC&R's and use agreement regarding the fence line; however, the Zoning Administrator noted this
was a permit for a remodel and not a fence issue.
James Blakely, 16071 Santa Barbara Lane, adjacent neighbor, stated the fence is an issue because the
house serves as a part of the fence.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Mr. Fauland, Zoning Administrator, recommended that Staff work with both parties and the City
Attorney's Office to review what impacts/rights the addition has on the property. Mr. Fauland
requested that Andrew Goetz provide Staff with copies of the CC&R's.
Mr. Fauland stated he would be continuing the item to the April 21, 1999 meeting to get additional
information and clarification on the easement issue.
COASTAL DEVELOPMENT PERMIT 98-31(NGUYEN RESIDENCE) WAS CONTINUED
BY THE ZONING ADMINISTRATOR TO APRIL 21,1999, AT 1:30 PM.
ITEM 2: COASTAL DEVELOPMENT PERMIT 99-2 (LEIBOWITZ RESIDENCE
APPLICANT: Rudy Jureack, 2062 Business Center Drive, Irvine, CA 92612
PROPERTY OWNER: Mr. and Mrs. Gary Leibowitz, 3422 Gilbert Drive, Huntington Beach,
CA 92649
REQUEST: To permit a 794 square foot first and second story addition, a 129
second story deck addition, and the remodel of an existing single family
residence.
LOCATION: 3422 Gilbert Drive, Huntington Beach, CA 92649
PROJECT PLANNER: Wendy Bounds
Wendy Bounds, Staff Planner, displayed a site plan stating the project is located in the Huntington
Harbor area at 3422 Gilbert Drive, surrounded by single family residences. The request is to permit a
794 square foot first and second story addition, a 129 second story deck addition, and the remodel of
an existing single family residence.
The project conforms to the General Plan designation of Low Density Residential, conforms to the
Local Coastal Program and is consistent with the development regulations outlined in the Zoning
Ordinance. No comments have been received regarding this application. Staff recommends approval
of the project with conditions.

Herb Fauland, Zoning Administrator, inquired as to whether or not the Huntington Harbour Property
Owners Association had reviewed and approved the project. Staff stated they had not received any
correspondence from the home owners association.
THE PUBLIC HEARING WAS OPENED.
Rudy Jureack, applicant/architect, 2062 Business Center Drive, Irvine, concurred with staff s report
and recommendation.
Gary Leibowitz, 3422 Gilbert Drive, property owner, extended his thanks.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
COASTAL DEVELOPMENT PERMIT 99-2 (LEIBOWITZ RESIDENCE)
WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING
FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION
TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO.99-2:
1. Coastal Development Permit No. 99-2 for the development project, as proposed or as modified by
conditions of approval, conforms with the General Plan, including the Local Coastal Program.
The project includes an addition to the first and second floor of an existing single family
residence in the Harbor, which conforms to the General Plan designation of Residential Low
Density. The project will have no impact on any public views or access.
2. The project is consistent with the requirements of the CZ Overlay District, the base zoning
district, as well as other applicable provisions of the Municipal Code. The project meets all
development requirements outlined in the low density residential zoning district, including site
coverage, height, and setbacks.
3. At the time of occupancy the proposed development can be provided with infrastructure in a
manner that is consistent with the Local Coastal Program. The subject site is located in an
existing single family residential area, all necessary infrastructure is in place.
4. The development conforms with the public access and public recreation policies of Chapter 3 of
the California Coastal Act. The subject site has no public access or views.
CONDITIONS OF APPROVAL - COASTAL DEVELOPMENT PERMIT NO.99-2:
1. The site plan, floor plans, and elevations received and dated February 16, 1999 shall be the
conceptually approved layout.

2. Prior to submittal for building permits, zoning entitlement conditions of approval shall be printed
verbatim on the second page of all the working drawing sets used for issuance of building permits
(architectural, structural, electrical, mechanical and plumbing).
3. Prior to issuance of building permits, compliance with all conditions of approval specified herein
shall be accomplished and verified by the Planning Department.
4. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the site plan, elevations and floor
plans are proposed as a result of the plan check process. Building permits shall not be issued until
the Planning Director has reviewed and approved the proposed changes for conformance with the
intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are
of a substantial nature, an amendment to the original entitlement reviewed by the Zoning
Administrator may be required pursuant to the HBZSO.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. Coastal Development Permit 99-2 shall not become effective until the ten day California Coastal
Commission appeal period has elapsed.
2. Coastal Development Permit 99-2 shall become null and void unless exercised within one year
of the date of final approval or such extension of time as may be granted by the Director
pursuant to a written request submitted to the Department of Planning a minimum 30 days prior
to the expiration date.
3. The Zoning Administrator reserves the right to revoke Coastal Development Permit 99-2,
pursuant to a public hearing for revocation, if any violation of these conditions or the
Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs.
4. All applicable Public Works fees shall be paid.
5. State -mandated school impact fees shall be paid prior to issuance of building permits.
6. Water service and a touch read meter shall be sized as per the Uniform Plumbing Code. A
backflow device shall be installed for the water services. (PW)
7. The development shall comply with all applicable provisions of the Municipal Code,
Department of Building, and Fire Department as well as applicable local, State and Federal Fire
Codes, Ordinances, and standards, except as noted herein.
8. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be
prohibited Sundays and Federal holidays.

9. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of
Exemption at the County of Orange Clerk's Office. The check shall be made out to the
County of Orange and submitted to the Department of Planning within two (2) days of the
Zoning Administrator's action.
