ZONING ADMINISTRATOR: Mary Beth Broeren, Acting STAFF MEMBER: Wendy Bounds, Peter Vanek, Ramona Kohlmann (recording secretary) MINUTES: None ORAL COMMUNICATION: None NON PUBLIC HEARING ITEM 1: LOT LINE ADJUSTMENT NO.99-1 (FYFFE/CLARK RESIDENCES) APPLICANT: Paula McKinney PROPERTY OWNER: Terry A. Fyffe, 22362 Wallingford Lane, Huntington Beach, CA 92646, and Edward Clark, 22372 Wallingford Lane, Huntington Beach, CA 92646 REQUEST: To adjust the lot lines between three existing residential properties. LOCATION: 22362 and 22372 Wallingford Lane (east of the intersection of Bushard and Brookhurst) PROJECT PLANNER: Wendy Bounds Wendy Bounds, Staff Planner, displayed site plans stating that the request is to adjust the property lines between three existing residential lots. Staff stated that the subject sites are located in a residential district and are developed with one dwelling unit each. The project will result in two residential lots and will meet all requirements outlined in the low -density residential zoning district. The adjusted lot lines will not create any conflict with existing structures on the site, and the dwelling units per site will not change. Based on the findings for the lot line adjustment, Staff recommends approval of the project with the recommended conditions. Zoning Administrator, Mary Beth Broeren, questioned Staff on the existing wall and right-of-way. Staff displayed pictures stating the wall already exists and the right-of-way is part of the parcel. Edward Clark, 22372 Wallingford Lane, property owner, stated that nothing was changing other than the actual splitting of the lot. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST. Mary Beth Broeren, Zoning Administrator, stated she would change Item No.1 in the Findings by changing the wording of "three existing parcels" to "the existing parcels" and to add that there are two units on the properties. LOT LINE ADJUSTMENT NO.99-1 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING MODIFIED FINDINGS AND CONDITIONS OF APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR PROJECTS EXEMPT FROM CEOA: The Zoning Administrator finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to section 15305 of the CEQA Guidelines, because the proposal is a minor lot line adjustment which will not result in the creation of a new parcel. FINDINGS FOR APPROVAL - LOT LINE ADJUSTMENT NO.99-1: The granting of Lot Line Adjustment No. 99-1 for the adjustment of lot lines between the existing parcels will not create any additional parcels or building sites. There are two existing residential units which will be unaffected by the lot line adjustment. The adjustment of lot lines will result in two residential properties. 2. The resulting parcels from the lot line adjustment will conform to Titles 20-24 of the Huntington Beach Zoning and Subdivision Ordinance because the adjusted lots comply with the requirements for minimum area, width, frontage, setbacks, and site coverage. 3. The lot line adjustment will not sever any existing structure(s) on any of the parcels. The proposed lot lines do not span the existing residences and block walls. 4. The lot line adjustment will not allow a greater number of dwelling units than allowed prior to the adjustment. The subject lots are zoned for single family residential use, allowing one unit per lot, and will remain so after the recordation of the lot line adjustment. 5. A plat map showing the lot line adjustment has been prepared and approved and will be filed in accordance with the provisions of Section 253.24. CONDITIONS OF APPROVAL — LOT LINE ADJUSTMENT NO.99-1: 1. The lot line adjustment received and dated February 22, 1999 shall be the conceptually approved layout with the following modification: ZA Minutes 4/14/99 2 (99ZM0414) a. The legal description shall be revised to reflect Orange County instead of Los Angeles County. 2. Submit a revised Lot Line Adjustment application to the Public Works Department for final approval. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. Lot Line Adjustment No. 99-1 shall not become effective until the ten-day appeal period has elapsed. 2. Lot Line Adjustment No. 99-1 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 3. The Zoning Administrator reserves the right to revoke Lot Line Adjustment No. 99-1, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. S. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of Exemption at the County of Orange Clerk's Office. The check shall be made out to the County of Orange and submitted to the Planning Department within two (2) days of the Zoning Administrator's action.
