ORAL COMMUNICATION: None ITEM 1: COASTAL DEVELOPMENT PERMIT NO.99-9 (BEACH PARKING PERMIT MACHINES) APPLICANT: State of California, Department of Parks & Recreation, c/o Donald Ito, 18331 Enterprise Lane, Huntington Beach, CA 92648 PROPERTY OWNER: State of California, Department of Parks & Recreation, 1416 9"' Street, Sacramento, CA 94296 REQUEST: To permit the installation of parking permit dispenser machines at the entrances to Bolsa Chica State Beach and Huntington State Beach. LOCATION: 17851 & 21601 Pacific Coast Highway (Bolsa Chica and Huntington State Beaches) PROJECT PLANNER: Ian Jones Ian Jones, Staff Planner, displayed pictures stating that the applicant is the State of California, Department of Parks and Recreation, and is requesting a total of five beach parking permit dispensers/kiosks. Staff stated that there would be a total of five dispensers located at five different entrances; specifically, Bolsa Chica and the Huntington State Beach entrances at Beach, Magnolia, Newland and Brookhurst. Staff stated that the five dispensers would be open year-round with hours ranging from approximately 6:00 AM to 9:00 PM. Staff stated that all of the dispensers/kiosks are to be placed at each entrance except for the Beach Boulevard entrance. Staff stated that the Beach Boulevard dispenser will be placed further into the parking lot to prevent stacking of automobiles. Staff stated that the only response received was from Public Works who wants the dispensers accessible to the driver's window, as well as being adequately lit during any night hours of operation. Staff stated that the applicant has addressed both of these concerns. Staff recommended approval with the suggested findings and conditions. Herb Fauland, Zoning Administrator, questioned the use of the word "kiosk" since they are dispensers. Staff clarified that the request is for dispensers. Mr. Fauland asked if the existing kiosks are to remain. Staff confirmed that they would remain (in addition to the dispensers). Mr. Fauland asked if the dispensers are subject to Design Review. Staff stated, "No." THE PUBLIC HEARING WAS OPENED. Donald Ito, California State Parks, 18331 Enterprise Lane, Huntington Beach, stated that he is present to answer any questions that the Zoning Administrator might have, and that he is representing the applicant. Mr. Fauland asked Mr. Ito if he had reviewed the conditions of approval. Mr. Ito stated that he had. Mr. Fauland asked the applicant if they had any concerns with condition 4.a, a short-term parking area near the parking machine. Mr. Ito stated there was no problem with this condition, and stated that the intent was that the machines be accessible from the driver in the vehicle. Mr. Ito stated that they currently have the machines operational at other State parks. Mr. Ito stated that the only difference would be at the Beach Boulevard entrance because of the potential stacking problem. Mr. Ito stated that the Beach Boulevard machine would be installed in the parking lot, essentially near an existing parking spot. Mr. Ito noted that it would really be a drive -through access and payment. Mr. Fauland confirmed with Mr. Ito that there would be no modifications made to the drive aisles, and the proposal was for the installation of the dispensing machines only. Mr. Ito agreed. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. COASTAL DEVELOPMENT PERMIT NO.99-9 (BEACH PARKING PERMIT MACHINES) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO.99-9: 1. Coastal Development Permit No. 99-9 for the development project, conforms with the General Plan, including the Local Coastal Program. The project includes the installation of parking fee collection devices at each entrance to Bolsa Chica and Huntington State Beaches, which conforms with the Recreation and Community Services Element of the General Plan designation including maintaining and enhancing local parks and recreational services and facilities. 2. The project is consistent with the requirements of the CZ Overlay District, the base zoning district, as well as other applicable provisions of the Municipal Code. The project meets all development requirements outlined in the coastal zone district and will conform with all applicable City Codes as allowed by the Coastal Development Permit. 2 (99ZM0630) ZA Minutes 06/30/99 3. At the time of operation the proposed development can be provided with infrastructure in a manner that is consistent with the Local Coastal Program. All infrastructure currently exists at the site. 4. The development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The proposed parking fee collection kiosks will not impact public views or access to coastal resources. CONDITIONS OF APPROVAL - COASTAL DEVELOPMENT PERMIT NO.99-9: 1. The site plan, floor plans, and elevations received and dated May 4, 1999 shall be the conceptually approved layout. 2. Prior to submittal for building permits, zoning entitlement conditions of approval shall be printed verbatim on the second page of all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing). 3. The following Fire Department requirements shall be noted on the building plans: (FD) a. Fire access roads shall be provided in compliance with City Specification No. 401. b. Security gates shall designed to comply with City Specification No, 403. 4. Use shall comply with the following: (PW) a. A short-term parking area shall be provided near the parking machine, or the parking machine shall be easily accessible from the driver's window. b. The parking machine and its general area shall be adequately lit at night during hours of operation of the machine. 5The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the Zoning Administrator may be required pursuant to the HBZSO. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1: Coastal Development Permit 99-9 shall not become effective until the ten day appeal period has elapsed. 2. Coastal Development Permit 99-9 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director ZA Minutes 06/30/99 3 (99ZM0630) pursuant to a written request submitted to the Department of Planning a minimum 30 days prior to the expiration date. 3. The Zoning Administrator reserves the right to revoke Coasial„Development Permit 99-9, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. All applicable Public Works fees shall be paid. 5. The development shall comply with all applicable provisions of the Municipal Code, Department of Building, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. 6. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 7. All signs shall conform to the HBZSO. Prior to installing any new signs, or changing sign faces, a building permit shall be obtained from the Department of Planning. 8. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of Exemption at the County of Orange Clerk's Office. The check shall be made out to the Count o� f Orange and submitted to the Department of Planning within two (2) days of the Zoning Administrator's action.
