ITEM 1• TEMPORARY USE PERMIT NO.99-5 (GREAT CHARITY SHOWER SING)
APPLICANT: Robert Quinn, 19431 Beach Boulevard, Huntington Beach, CA 92648
PROPERTY OWNER: Samuel Sinay, 1801 Century Park East, Suite 2101, Los Angeles, CA

REQUEST: To permit a temporary outdoor event with entertainment consisting of a
singing contest (in a shower) for Saturday, August 28, 1999, and
Saturday, August 26, 2000.
LOCATION: 19431 Beach Boulevard (north of Yorktown, west on Beach Blvd)
PROJECT PLANNER: Ian Jones
Ian Jones, Staff Planner, displayed site plans stating that the request is for a temporary outdoor
community fund-raiser for non-profit groups to be held on one day for approximately six hours on
Saturday, August 28, 1999, and Saturday, August 26, 2000. Staff stated that contestants would sing
in a shower to be judged by a panel of judges. Staff stated that there would be one disc jockey, a
judge's table, a shower, a barbecue, and chairs.
Staff recommended approval with the suggested findings and conditions of approval as submitted in
the staff report.
Herb Fauland, Zoning Administrator, asked if a review had been conducted with the police
department, and staff confirmed.
THE PUBLIC HEARING WAS OPENED.
Robert Quinn, 19431 Beach Boulevard, the applicant, stated that it was his understanding that the use
of a barbecue was to be removed from the request and Staff confirmed.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Mr. Fauland instructed Staff as follows:
1. Add a condition regarding signage to reflect that there are to be no moving signs or any other
hazardous distractions placed on the site.
2. Amend Condition 2.c to state that attire/costumes shall be worn at all times and are not to be
transparent when wet.
3. Delete the use of a barbecue as referred to in Condition 2.h.
TEMPORARY USE PERMIT NO.99-5 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND MODIFIED CONDITIONS
OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN
TEN (10) CALENDAR DAYS.
FINDINGS FOR PROJECTS EXEMPT FROM CEQA:
The Zoning Administrator finds that the project will not have any significant effect on the
environment and is exempt from the provisions of the California Environmental Quality Act (CEQA)
pursuant to section 15304, Class 4 of the CEQA Guidelines. The proposal is a temporary use that
will have no permanent effects on the environment.
FINDINGS FOR APPROVAL — TEMPORARY USE PERMIT NO.99-5
1. The proposed temporary use will be located, operated and maintained in a manner consistent
with the policies of the General Plan and the provisions of Chapter 241. The temporary use
permit will be compatible with surrounding uses because the event is temporary in nature and is
consistent with the commercial character of the area. It will not alter existing property and
improvements in the area. There is ample parking in both the front and rear of the site to
accommodate any additional parking needs.
2. Approval of the application for Temporary Use Permit No. 99-5 for the establishment,
maintenance and operation of a temporary outdoor community fund-raiser on Saturday, August
28, 1999, and Saturday, August 26, 2000, will not be detrimental to property or improvements
in the surrounding area or to the public health, safety or general welfare. The fund-raiser will be
held on only one day for approximately 6 hours. It will be set up directly in front of the store
and will not negatively impact the surrounding stores. No residential uses exist in the
immediate area. The event will be placed in a manner as to not block any access to other retail
stores. The proposal does not require any additional improvements or alterations to the existing
facilities.

CONDITIONS OF APPROVAL — TEMPORARY USE PERMIT NO.99-5
1. The site plan received and dated June 1, 1999 shall be the conceptually approved layout.
2. The use shall comply with the following:
a. The event shall not interfere with traffic on Beach Boulevard by either contestants or
promoter. (PD)
b. No alcoholic beverages are to be served before, during, or after the event. (PD)
c. Attire/costumes are to be worn at all times and are not to be transparent when wet. (PD)
d. The hours for the activity are limited to between 11 am to 5 pm. (CS)
e. Any water from shower shall not be allowed to run off site. (CS)
f. Service roads and fire access lanes shall be maintained. If fire lane violations occur and the
services of the Fire Department are required, the applicant will be liable for expenses incurred.

g. Public sidewalk on Beach Boulevard shall be kept open. (CS)
h. Only the uses described in the narrative shall be permitted except for the following:
(1) There shall be no Bar-B-Q located on site.
i. Should any electrical devices be involved, necessary permits shall be obtained from the
Building Department prior to the event.
3. There shall be no moving signs, signs that obstruct vehicular or pedestrian traffic visibility, or
signs that are a hazardous distraction on site.
4. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the site plan are proposed. If the
proposed changes are of a substantial nature, an amendment to the original entitlement reviewed
by the Zoning Administrator may be required pursuant to the HBZSO.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. Temporary Use Permit No. 99-5 shall not become effective until the ten day appeal period has
elapsed.
2. The Zoning Administrator reserves the right to revoke Temporary Use Permit No. 99-5,
pursuant to a public hearing for revocation, if any violation of these conditions or the
Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs.

3. The development shall comply with all applicable provisions of the Municipal Code, Building
Division, and Fire Department as well as applicable local, State and Federal Fire Codes,
Ordinances, and standards, except as noted herein.
4. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of
Exemption at the County of Orange Clerk's Office. The check shall be made out to the
County of Orange and submitted to the Planning Department within two (2) days of the
Zoning Administrator's action.

Sandra Thornton, Staff Planner, stated that the applicant requested the withdrawal because the project
was too expensive. Staff presented a letter from the applicant requesting the withdrawal.
Herb Fauland, Zoning Administrator, asked staff why the item was considered by the applicant to be
too expensive. Staff s response was that the applicant would be asked to enclose the area with a
wrought -iron type fence with columns.
THE PUBLIC HEARING WAS OPENED.
THERE WERE NO PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST
AND THE PUBLIC HEARING WAS CLOSED.
THE ZONING ADMINISTRATOR ACCEPTED THE APPLICANT'S REQUEST TO
WITHDRAW CONDITIONAL USE PERMIT NO.99-30.
THE MEETING WAS ADJOURNED AT 1:35 PM BY THE ZONING ADMINISTRATOR TO
THE NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR
