ORAL COMMUNICATION:
Jerry Urner, Huntington Harbour Property Owners' Association, brought to the attention of the
Zoning Administrator the fact that a 6-foot high wall was newly constructed on top of a 2-foot high
retaining wall at a property on Seawitch Lane without obtaining approval from the Zoning
Administrator. Mary Beth Broeren, acting Zoning Administrator, advised Mr. Urner that the Zoning
Code allows for a 6-foot high wall on top of a 2-foot high retaining wall without a conditional use
permit in certain areas. Ms. Broeren and Mr. Urner discussed different cases in which this action
would or would not be allowed.
ITEM 1: COASTAL DEVELOPMENT PERMIT NO.99-14 (DE WOLFE RESIDENCE)
APPLICANT/
PROPERTY OWNER: James and Adrienne DeWolfe, 16281 Tisbury Circle, Huntington
Beach, CA 92649
REQUEST: To remodel an existing single family dwelling and construct an 800
square foot 2"d story addition and a 249 square foot 1 S` story addition.
LOCATION: 16281 Tisbury Circle (west of Saybrook south of Edinger)

COASTAL STATUS: APPEALABLE
Sandra Thornton, Staff Planner, displayed site plans stating the location of the project. Staff stated
that the surrounding uses are all residential. The applicant is requesting to remodel an existing
single-family dwelling and construct an 800 square foot 2nd story addition and a 249 square foot V
story addition.
Staff recommended approval of the project stating that the project will not impact public views or
access to coastal resources. It meets all development regulations for low density residential zoning
including building height, setbacks and site coverage. All necessary infrastructure is provided for the
project.
Staff stated that she has not received any comments regarding this project in response to the public
hearing notice.
Mary Beth Broeren, Zoning Administrator, confirmed with staff that the homeowners' association
had approved this project. Staff produced a stamped signed copy of the approval.
Ms. Broeren and staff discussed the lot coverage calculation and confirmed that the numbers are
below 50%.
THE PUBLIC HEARING WAS OPENED.
Jerry Urner, Huntington Harbour Property Owners' Association, stated that they had reviewed the
plan and recommended approval.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Ms. Broeren confirmed with the applicant that they had read the conditions of approval requiring the
covenant that would restrict the use of the attic area. The applicant stated that they were prepared to
comply with the conditions.
COASTAL DEVELOPMENT PERMIT NO.99-14 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN
TEN (10) CALENDAR DAYS.
FINDINGS FOR PROJECTS EXEMPT FROM CEQA:
The Zoning Administrator finds that the project will not have any significant effect on the
environment and is exempt from the provisions of the California Environmental Quality Act (CEQA)
pursuant to section 15301 of the CEQA Guidelines, because the addition will not increase the floor
area by more than 50 percent or 2,500 square feet.
FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO.99-14:
1. Coastal Development Permit No. 99-14 for the development project, as proposed or as modified
by conditions of approval, conforms with the General Plan, including the Local Coastal Program.
The project is an addition to an existing single family residence, which conforms to the General
Plan Land Use designation of Residential Low Density. The project will not impact public views
or access to coastal resources.
2. The project is consistent with the requirements of the CZ Overlay District, the base zoning
district, as well as other applicable provisions of the Municipal Code. The project meets all
development regulations for the Low Density Residential zoning district, including building
height, setbacks, and site coverage.

3. At the time of occupancy the proposed development can be provided with infrastructure in a
manner that is consistent with the Local Coastal Program. All necessary infrastructure is
provided for the project.
4. The development conforms with the public access and public recreation policies of Chapter 3 of
the California Coastal Act. No public access or recreational opportunities exist at the site.
CONDITIONS OF APPROVAL - COASTAL DEVELOPMENT PERMIT NO.99-14:
The site plan, floor plans and elevations received and dated August 24, 1999 shall be the
conceptually approved layout with the following modifications:
a. Depict all utility apparatus, such as but not limited to back flow devices and Edison
transformers on the site plan. Utility meters shall be screened from view from public rights -
of -way. Electric transformers in a required front or street side yard shall be enclosed in
subsurface vaults. Backflow prevention devices shall be prohibited in the front yard setback
and shall be screened from view. (Code Requirement)
2. Prior to submittal for building permits, the following shall be completed:
a. Zoning entitlement conditions of approval shall be printed verbatim on the second page of all
the working drawing sets used for issuance of building permits (architectural, structural,
electrical, mechanical and plumbing).
3. Prior to issuance of building permit, the following shall be completed:
a. The owner shall record a Covenant and Agreement with prior approval from the Building and
Safety Department. The Covenant shall be recorded with the County Recorder and a copy of
the recorded document shall be filed with the Building and Safety Department. This may be
accomplished during the plan check process. The Covenant and Agreement will restrict the
Attic area over the garage to Light Storage only (40 psf). (BD)
4. Prior to final building permit inspection and approval, the following shall be completed:
a. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
5. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the site plan, elevations and floor
plans are proposed as a result of the plan check process. Building permits shall not be issued
until the Planning Director has reviewed and approved the proposed changes for conformance
with the intent of the Zoning Administrator's action and the conditions herein. If the proposed
changes are of a substantial nature, an amendment to the original entitlement reviewed by the
Zoning Administrator may be required pursuant to the HBZSO.

INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. Coastal Development Permit No. 99-14 shall not become effective until the ten day California
Coastal Commission appeal period has elapsed.
2. Coastal Development Permit No. 99-14 shall become null and void unless exercised within one
year of the date of final approval or such extension of time as may be granted by the Director
pursuant to a written request submitted to the Department of Planning a minimum 30 days prior
to the expiration date.
3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 99-14,
pursuant to a public hearing for revocation, if any violation of these conditions or the
Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs.
4. All applicable Public Works fees shall be paid. (PW)
5. State -mandated school impact fees shall be paid prior to issuance of building permits.
6. The development shall comply with all applicable provisions of the Municipal Code,
Department of Building, and Fire Department as well as applicable local, State and Federal Fire
Codes, Ordinances, and standards, except as noted herein.
7. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be
prohibited Sundays and Federal holidays.
8. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of
Exemption at the County of Orange Clerk's Office. The check shall be made out to the
County of Orange and submitted to the Department of Planning within two (2) days of the
Zoning Administrator's action.
ITEM 2: CONDITIONAL USE PERMIT NO.99-40 (OAK OVEN BARBECUE
APPLICANT: Louis B. Gaydos, 21501 Brookhurst St., Suite D, Huntington Beach,
CA 92646
PROPERTY OWNER: CBM, 1517 South Sepulveda Blvd., Los Angeles, CA 90025
REQUEST: To permit the sale of beer and wine at the Oak Oven Barbecue.
LOCATION: 21501 Brookhurst Street, Suite D (southwest corner of Brookhurst and
Hamilton)
PROJECT PLANNER: Sandra Thornton
Sandra Thornton, Staff Planner, stated that the applicant has decided to do a parking study and is
debating as to whether or not to add some additional items to his conditional use permit.
Staff recommended continuation to a date uncertain.
