CALL TO ORDER Mayor Green called the adjourned regular meetings of the City Council and the Redevelopment Agency of the City of Huntington Beach to order at 5.00 p.m. in the Central Library, Room D. CITY COUNCILIREDEVELOPMENT AGENCY ROLL CALL Present: Bauer, Green, Dettloff, Sullivan (Garofalo arrived at 5:15 p.m.) Absent: Julien, Harman PUBLIC COMMENTS SCOTT ARENELLA, city employee, read a communication to the City Council that he had written covering aspects of the controversy surrounding the planned employee holiday luncheon. He spoke regarding the reasons he believed the planned luncheon would be a very positive event. Mayor Pro Tern Garofalo arrived at the Council meeting at 5:15 p.m. CITY CLERK ANNOUNCES LATE COMMUNICATIONS WHICH PERTAIN TO ITEMS ON THE AGENDA Pursuant to the Brown (Open Meetings) Act, City Clerk Brockway announced the following late communications regarding agenda items. These late communications had been received " following distribution of the agenda. The following late communications were distributed at the Council meeting: Communication from Scott Baugh, Assemblyman, (no date) titled To Interested Entities, Re: Member Budget Requests. Communication to the Mayor and City Council from Councilmember Bauer titled "H" Item for November 22, 1999 City Council Meeting - Re: Employee Holiday Luncheon dated November 19, 1999. 862 11/22/99 — Council/Agency Minutes — Page Z Communication distributed by City Administrator titled Talking Points for Assemblymember Scott Baugh (no date). EMPLOYEE HOLIDAY LUNCHEON The City Council considered a communication from Councilmember Bauer dated November 19, 1999 titled Employee Holiday Luncheon which had been announced earlier during late communications by the City Clerk. Councilmember Bauer clarified the reasons why he had placed this item on the agenda. He spoke regarding his recommendation to cancel the luncheon and to request that the City Administrator's Office to recommend other ways to recognize and reward city employees. Mayor Pro Tern Garofalo recommended that the event be rescheduled and that a committee be appointed of Council and citizens to plan an event for city employees. City Administrator Silver spoke regarding the history of employee events including the city picnic and the Public Works Department open house, both very successful events. He spoke regarding the community and the city employees which make the city a special place to live. He stated that the employees' luncheon had been management's idea, not that of the city employees or the City Councilmembers. He commented that Council had approved the budget on September 29, 1999 which includes this celebration. On a subsequent agenda the employees' luncheon item had been placed relative to requesting Council approval of fund raising efforts for the luncheon. City Administrator Silver spoke regarding the hard and soft cost of the event if it is held or if it is not held. He stated that the Huntington Center is going to reimburse the city for a $1,000 of the work done in order for the Fire Department to allow the facility to use the event. City Administrator Silver presented information regarding the repayment the city will receive from Huntington Center through use of the facility during the year 2000 free of charge to community organizations. A motion was made by Bauer, second Green to cancel the luncheon and direct the Office of the City Administrator to recommend other ways to recognize and reward city employees. Mayor Pro Tern Garofalo stated that should Councilmember Bauer's motion fail he would recommend to move the date of the event and form a coalition of persons to oversee the event and to hold an event at a future time. Councilmember Sullivan stated that he was heartened that the city will be able to use the facility during the year 2000. Councilmember Sullivan stated he believes the employee luncheon should proceed as planned. Mayor Pro Tem Garofalo stated that his motion would be to direct the City Administrator to proceed with the luncheon or to defer at his discretion. Councilmember Dettloff and Mayor Green presented their viewpoints on the subject. Following further discussion a vote was taken on the motion made by Bauer, second Green. The motion failed by the following roll call vote: AYES: Green, Bauer NOES: Dettloff, Green, Sullivan ABSTAINED: Garofalo ABSENT: Julien, Harman 863 11122/99 — Council/Agency Minutes — Page 3 A motion was made by Garofalo, second Green to direct the City Administrator to proceed or not to proceed with the event at his discretion, and if not proceeding with the event, to meet with two Councilmembers to explore other methods of holding such events. City Administrator Silver responded to Mayor Pro Tern Garofalo -as to his intention to proceed with the employee Holiday Luncheon. He commented on his plan to proceed with the event and to request the Director of Organizational Effectiveness to raise funds from the employees and also to ensure that community organizations utilize the Huntington Center facility during the coming year. The motion made by Garofalo, second Green was withdrawn. (CITY COUNCIUREDEVELOPMENT AGENCY) MEETING WITH ASSEMBLYMEMBER SCOTT BAUGH REGARDING FUNDING OPPORTUNITIES FOR THE NEXT LEGISLATIVE SESSION {340.80) Peter Crandall, representing Assemblymember Scott Baugh, was introduced by Deon Lewis, District Director, Assemblymember Scott Baugh's Office. Ms. Lewis distributed a communication from Assemblymember Baugh (no date) titled Member Budget Request. This communication had been distributed to the City Council and staff earlier in this meeting and announced by the City Clerk. Mayor Green spoke regarding the monies that are taken from the city by the state. He described the city's struggle to provide services, due primarily because of the state funding take -away. Mr. Crandall stated that he had just learned that Asseblymember Baugh could not attend the meeting. At the request of Mayor Pro Tern Garofalo Mr. Crandall stated that he would look into affordable housing and the issue of infrastructure. Councilmember Dettloff stated that the city would like to participate with Assemblymember Baugh regarding special legislation for coastal cities. City Administrator Silver informed Mr. Crandall of the material that had been prepared for Assemblymember Baugh to discuss at this meeting. The subject of compulsory arbitration set forth in the communication titled Talking Points for Assemblymember Scott Baugh was discussed. MOTION TO RECESS TO CLOSED SESSION A motion was made by Dettloff, second Garofalo to recess to Closed Session the following items: The motion carried by unanimous vote with Councilmembers Julien and Harman recorded absent. (City Council) Closed Session - City Council pursuant to Government Code Section 54956.9(a) to confer with its attorney regarding pending litigation which has been initiated formally and to which the city is a party. The title of the litigation is Gunther v. Hitt, et al.; - Orange County Superior Court Case No. 796147. Subject: Gunther v. Hitt, et al. (Based on existing facts and circumstances, the legislative body of the local agency has decided to initiate or is deciding whether to initiate litigation.) Number of Potential Cases: one. (120.80) (City Council) Closed Session — City Council pursuant to Government Code Section 54957.6 to meet with its designated representatives William Osness, Personnel Director; Daniel Cassidy, Esquire of Liebert, Cassidy and Frierson and Richard Whitmore, Esquire of Whitmore, Johnson & Bolanos regarding labor relations matters — meet and confer with the following employee organizations: MSOA, POA, PMA, MEA, MEO, HBFA and SCLEA.
