ZONING ADMINISTRATOR: Mary Beth Broeren STAFF MEMBER: Sandra Thornton, Amy Wolfe, Ricky Ramos, Ramona Kohlmann (recording secretary) MINUTES: None ORAL COMMUNICATION: None ITEM 1: COASTAL DEVELOPMENT PERMIT NO.00-04/CONDITIONAL USE PERMIT NO. 00-06 (HARBOUR BAY HOMES) APPLICANT: . David Pacheco, 19531 Brookline Circle, Huntington Beach, CA 92646 PROPERTY OWNER: Harbour Bay Homes, 16835 Algonquin PMB 212, Huntington Beach, CA 92649-3510 REQUEST: To permit a new 6,195 square foot 2-story home at 33-feet 6-inches high. The conditional use permit request includes a review and analysis for compliance with the Infill Lot Ordinance. The Infill Lot Ordinance encourages adjacent property owners to review proposed development for compatibility/privacy issues, such as window alignments, building pad height, and floor plan layout. LOCATION: 16311 Niantic Circle (at the terminus of Niantic Circle) PROJECT PLANNER: Sandra Thornton Sandra Thornton, Staff Planner, displayed site plans and photographs, stating the purpose, location, and zoning of the request. Staff stated that the project conforms to the In -fill Lot Ordinance, as well as the General Plan and Zoning Code requirements, including setbacks, site coverage, and parking. Staff recommended approval of the request based upon the findings as outlined in the staff report. No written or verbal comments were received in response to the public notices. Mary Beth Broeren, Zoning Administrator, asked staff if the spa will be permitted with this item or if there is a condition stating that a separate permit will be required. Staff stated that the spa was not outlined in the narrative and, therefore, staff would add a condition. THE PUBLIC HEARING WAS OPENED. Jerry Urner, Huntington Harbour Property Owner's Association, stated that they have reviewed and approve the request. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Ms. Broeren asked staff to add a condition stating that the proposed spa shall be permitted separately and fencing surrounding the spa will be required to comply with the Uniform Building Code. COASTAL DEVELOPMENT PERMIT NO.00-04/CONDITIONAL USE PERMIT NO.00-06 WERE APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) WORKING DAYS. FINDINGS FOR PROJECTS EXEMPT FROM CEQA: The Zoning Administrator finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to section 15303 of the CEQA Guidelines, because one (1) new single family residence is exempt from CEQA. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 00-04: l . Coastal Development Permit No. 00-04 for the development project, as proposed or as modified by conditions of approval, conforms with the General Plan, including the Local Coastal Program. The project is a new single family residence, which conforms to the General Plan Land Use designation of Residential Low Density. The project will not impact public views or access to coastal resources. 2. The project is consistent with the requirements of the CZ Overlay District, the base zoning district, as well as other applicable provisions of the Municipal Code. The project meets all development regulations for the Low Density Residential zoning district, including building height, setbacks, and site coverage. 3. At the time of occupancy the proposed development can be provided with infrastructure in a manner that is consistent with the Local Coastal Program. All necessary infrastructure is provided for the project. 4. The development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. No public access or recreational opportunities exist at the site. FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO.00-06: 1. Conditional Use Permit No. 00-06 for the establishment, maintenance and operation of the new 2- story single family residence with a total building height of 33-feet 6-inches will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The dwelling will only reach ZA Minutes 03/29/00 2 (OOZM0329) 33-feet 6-inches in height at the peak of the roof and the height at the eave level will be approximately 23 feet high. The majority of the building will be less than 30 feet high. 2. The conditional use permit will be compatible with surrounding uses because the portion of the roof that exceeds 30 feet in height will be located at the center of the single family dwelling and will only reach 33-feet 6-inches in height at the peak. 3. The proposed 2-story single family residence with a total building height of 33-feet 6-inches will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. The project meets all development regulations for the Low Density Residential zoning district, including building height, setbacks, and site coverage. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Low Density Residential on the subject property. CONDITIONS OF APPROVAL - COASTAL DEVELOPMENT PERMIT NO.00-04/ CONDITIONAL USE PERMIT NO.00-06: 1. The site plan, floor plans, and elevations received and dated March 2, 2000 shall be the conceptually approved layout with the following modifications: a. Depict all utility apparatus, such as but not limited to back flow devices and Edison transformers on the site plan. Utility meters shall be screened from view from public rights - of -way. Electric transformers in a required front or street side yard shall be enclosed in subsurface vaults. Backflow prevention devices shall be prohibited in the front yard setback and shall be screened from view. (Code Requirement) b. Depict all gas meters, water meters, electrical panels, air conditioning units, mailbox facilities and similar items on the site plan and elevations. If located on a building, they shall be architecturally designed into the building to appear as part of the building. They shall be architecturally compatible with the building and non -obtrusive, not interfere with sidewalk areas and comply with required setbacks. 2. Prior to submittal for building permits, the following shall be completed: a. Zoning entitlement conditions of approval shall be printed verbatim on all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing) and shall be referenced in the index. b. A grading plan will be required only if the foundation is removed. (PW) c. All fire department requirements shall be noted on the building plans. (FD) ZA Minutes 03/29/00 3 (OOZM0329) 3. During construction, the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site: b. Wet down areas in the late morning and after work is completed for the day; c. Use low sulfur fuel (.05%) by weight for construction equipment; d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. f. Ensure clearly visible signs are posted on the perimeter of the site identifying the name and phone number of a field supervisor to contact for information regarding the development and any construction/grading activity. 4. Prior to final building permit inspection and approval, the following shall be completed: a. All improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein, including: 1) A fire alarm system will be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. (FD) 2) Address numbers will be installed to comply with City Specification No. 428. The size of the numbers will be sized a minimum of six (6) inches with a brush stroke of one and one-half (1-1/2) inches. (FD) 3) One 36-inch box tree shall be planted within the front yard. (PW) b. The existing water service serving the site may potentially be utilized if it is of adequate size as set by the Uniform Plumbing Code, conforms to current standards, and is in working condition as determined by the Water Division. (PW) c. Separate backflow protection shall be installed per the Water Division Standards for the water service. (PW) d. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. Any structures projecting beyond the bulkhead will require separate permits and approval by the California Coastal Commission. ZA Minutes 03/29/00 4 (OOZM0329) 6. The proposed spa shall be permitted separately and fencing surrounding the spa will be required to comply with the Uniform Building Code. 7. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the Zoning Administrator may be required pursuant to the HBZSO. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. Coastal Development Permit No. 00-04/Conditional Use Permit No. 00-06 shall not become effective until the ten working day appeal period has elapsed. For projects in the appealable area of the coastal zone, there is an additional ten working day appeal period that commences when the California Coastal Commission receives the City's notification of final action. 2. Coastal Development Permit No. 00-04/Conditional Use Permit No. 00-06 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 00- 04/Conditional Use Permit No. 00-06, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. All applicable Public Works fees shall be paid. 5. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. 6. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 7. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of Exemption at the County of Orange Clerk's Office. The check shall be made out to the County of Orange and submitted to the Planning Department within two (2) days of the Zoning Administrator's action. 8. State -mandated school impact fees shall be paid prior to issuance of building permits. 9. An encroachment permit shall be required for all work within the right-of-way. (PW) ZA Minutes 03/29/00 5 (OOZM0329) ITEM 2: CONDITIONAL USE PERMIT NO.00-02 (HOT AND SPICY THAI RESTAURANT) APPLICANT: David Dodge, 2724 Fairman St., Lakewood, CA 90712 PROPERTY OWNER: Huntington Investments, 363 San Miguel Dr., #200, Newport Beach, CA 92660 REQUEST: To establish a restaurant with alcohol sales in an existing 1,200 square foot tenant suite. LOCATION: 16561 Bolsa Chica, Suite 108 (southwest corner at Heil Avenue) PROJECT PLANNER: Ricky Ramos Ricky Ramos, Staff Planner, displayed site plans and photographs stating the purpose, location and zoning of the request. Staff recommended approval of the request and stated that adequate parking will be provided as required by code. Staff stated that the Police Department reviewed the request and had no comments concerning the sale of alcohol. One phone call was received regarding questions in general, and no letters were received regarding this project. THE PUBLIC HEARING WAS OPENED. THERE WERE NO PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. CONDITIONAL USE PERMIT NO.00-02 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR PROJECTS EXEMPT FROM CEQA: The Zoning Administrator finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to section 15301 of the CEQA Guidelines, because it consists of the operation and minor alteration of existing facilities involving no expansion of use. FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 00-02: l . Conditional Use Permit No. 00-02 for the establishment, maintenance and operation of a restaurant with alcohol sales in an existing 1,200 square foot tenant suite will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The project is proposed within an existing tenant suite in an established commercial center and no significant exterior alterations are proposed that would impact the area. The use will provide another service to area residents. 2. The conditional use permit will be compatible with surrounding uses because the restaurant with alcohol sales is consistent with the character of the established commercial center where it will be ZA Minutes 03/29/00 6 (OOZM0329) located. It will be buffered from surrounding uses by adequate setbacks. Alcohol sales will be in conjunction with food sales. 3. The proposed Conditional Use Permit No. 00-02 will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. The project is allowed with a conditional use permit and adequate parking will be provided for the restaurant and the entire center as required by code. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Commercial General on the subject property which permits eating and drinking establishments. In addition, it is consistent with the following goals and policies of the General Plan: a. Achieve the development of a range of commercial uses. (Goal LU 10) b. Accommodate the development of neighborhood, community, regional, office, and visitor - serving commercial uses in areas designated on the Land Use Plan Map. (Policy LU 10.1.1) CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO.00-02: 1. The site plan and floor plan received and dated January 7, 2000 shall be the conceptually approved layout. 2. Prior to submittal for building permits, the following shall be completed: a. Zoning entitlement conditions of approval shall be printed verbatim on all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing) and shall be referenced in the index. b. All Fire Department requirements shall be noted on the building plans. (FD) 3. Prior to final building permit inspection and approval and issuance of a Certificate of Occupancy, the following shall be completed: a. All improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein, including: 1) Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. (FD) 2) Address numbers will be installed to comply with City Specification No. 428. The size of the numbers will be sized a minimum of six (6) inches with a brush stroke of one and one-half (1-1 /2) inches. (FD) b. The existing water service currently serving the site may potentially be utilized for domestic purposes if it is of adequate size to meet the minimum requirements set by the Uniform ZA Minutes 03/29/00 7 (OOZM0329) Plumbing Code, conforms to current standards, and is in working condition as determined by the Water Division. (PW) c. If a new water service and meter is required, then it shall be installed per Water Division standards and sized to meet the Uniform Plumbing Code with a separate backflow protection device. The service lateral shall be a minimum of 2 inches in size. (PW) d. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Planning Department. e. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 4. Prior to the sale of alcoholic beverages, a copy of the Alcoholic Beverage Control Board (ABC) license, along with any special conditions imposed by the ABC, shall be submitted to the Planning Department for the file. Any conditions that are more restrictive than those set forth in this approval shall be adhered to. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the Zoning Administrator may be required pursuant to the HBZSO. A Certificate of Occupancy must be issued by the Planning Department and Building and Safety Department prior to occupying the building. ITEM 3: COASTAL DEVELOPMENT PERMIT NO. 00-05 (BEACH PUBLIC SERVICES FACILITY) APPLICANT/ PROPERTY OWNER: City of Huntington Beach, c/o Jim Engle, Community Services Department REQUEST: To demolish the existing junior lifeguard building and restroom trailer, and construct a 1,625 square foot one-story beach public services facility. LOCATION: 285 Pacific Coast Highway (ocean side, south of the pier) PROJECT PLANNER: Ricky Ramos Ricky Ramos, Staff Planner, displayed site plans and photographs stating the purpose, location and zoning of the request. Staff stated that the proposed uses include beach events coordination, a restroom, and a police department detention facility. Staff stated that the project complies with the General Plan and Zoning requirements. The item has been reviewed by the Design Review Board (DRB) for compliance with the Downtown Design Guidelines, and the DRB recommended approval. The project is exempt from Environmental review because it involves the replacement of an existing facility with a new facility of the same size, capacity, and essentially the same location. The project will not impact public access for recreational opportunities. Staff recommended approval of the project based upon the foregoing and the findings and conditions as outlined in the staff report. ZA Minutes 03/29/00 (OOZM0329) THE PUBLIC HEARING WAS OPENED. Kim Quart, 701 W. Graham Avenue, Lake Elsinore, the architect, stated he was available to answer questions, and pointed out a few minor changes on the plans, specifically, double doors in place of the overheard roll -down door and the addition of a fixed window on the west elevation. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. COASTAL DEVELOPMENT PERMIT NO.00-05 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) WORKING DAYS. FINDINGS FOR PROJECTS EXEMPT FROM CEQA: The Zoning Administrator finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15302 of the CEQA Guidelines, because the project consists of the replacement of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO.00-05: 1. Coastal Development Permit No. 00-05 for the development project, as proposed or as modified by conditions of approval, conforms with the General Plan, including the Local Coastal Program. The subject site is designated in the General Plan Land Use Element as Open Space -Shore and has a zoning designation of Downtown Specific Plan -District #11 (Beach Open Space) which permit coastal and recreational uses as well as ancillary buildings such as the proposed Beach Public Services Facility. The project will not impact public views or access to coastal resources because it involves the replacement of existing structures with a new similar sized building at the same location. It is consistent with the following goals, policies, and objectives in the General Plan: a. Require that structures located in the City's parks and other open spaces be designed to maintain the environmental character in which they are located. (Policy LU 14.1.3) b. Achieve and maintain high quality architecture, landscape, and public open spaces in the City. (Goal LU 4) 2. The project is consistent with the requirements of the CZ Overlay District, the base zoning district, as well as other applicable provisions of the Municipal Code. The project complies with all development standards including height and setbacks, among others. The Design Review Board reviewed the project for compliance with the Downtown Design Guidelines. ZA Minutes 03/29/00 10 (OOZM0329) 3. At the time of occupancy the proposed development can be provided with infrastructure in a manner that is consistent with the Local Coastal Program. All necessary infrastructure already exist to the site and only lateral extensions will be needed to construct the project. 4. The development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The project involves the replacement of existing structures with a new facility of the same size in the same location to be used for the same purpose as the existing structures and will therefore not impact public access and recreation. The project will enhance recreation opportunities by providing a modern facility more suited to meet the needs of beach users. CONDITIONS OF APPROVAL - COASTAL DEVELOPMENT PERMIT NO.00-05: 1. The site plan, floor plan, and elevations received and dated January 28, 2000 shall be the conceptually approved layout with the following modifications: a. Elevations shall depict colors and building materials reviewed and approved by the Design Review Board. b. Depict all utility apparatus, such as but not limited to back flow devices and Edison transformers on the site plan. Utility meters shall be screened from view from public rights - of -way. Electric transformers in a required front or street side yard shall be enclosed in subsurface vaults. Backflow prevention devices shall be prohibited in the front yard setback and shall be screened from view. (Code Requirement) c. All exterior mechanical equipment shall be screened from view on all sides. Rooftop mechanical equipment shall be setback 15 feet from the exterior edges of the building. Equipment to be screened includes, but is not limited to, heating, air conditioning, refrigeration equipment, plumbing lines, ductwork and transformers. Said screening shall be architecturally compatible with the building in terms of materials and colors. If screening is not designed specifically into the building, a rooftop mechanical equipment plan showing screening must be submitted for review and approval with the application for building permit(s). (Code Requirement) d. Depict all gas meters, water meters, electrical panels, air conditioning units, mailbox facilities and similar items on the site plan and elevations. If located on a building, they shall be architecturally designed into the building to appear as part of the building. They shall be architecturally compatible with the building and non -obtrusive, not interfere with sidewalk areas and comply with required setbacks. e. If outdoor lighting is included, energy saving lamps shall be used. All outside lighting shall be shielded and directed to prevent "spillage" onto adjacent properties and shall be shown on the site plan and elevations. f. A wide -style aluminum frame door (four (4) inches all around the door) shall be used for the Police substation. Use glass that is laminated (has a .060 inner layer). A security film ZA Minutes 03/29/00 11 (OOZM0329) attached to the glass on the interior side of the door shall also be provided. The door shall include a reinforced strike plate and a hook bolt deadbolt. (PD) 2. Prior to issuance of demolition permits, the following shall be completed: a. The applicant shall follow all procedural requirements and regulations of the South Coast Air Quality Management District (SCAQMD) and any other local, state, or federal law regarding the removal and disposal of any hazardous material including asbestos, lead, and PCB's. These requirements include but are not limited to: survey, identification of removal methods, containment measures, use and treatment of water, proper truck hauling, disposal procedures, and proper notification to any and all involved agencies. b. Pursuant to the requirements of the South Coast Air Quality Management District, an asbestos survey shall be completed. c. The applicant shall complete all Notification requirements of the South Coast Air Quality Management District. d. The City of Huntington Beach shall receive written verification from the South Coast Air Quality Management District that the Notification procedures have been completed. 3. Prior to issuance of grading permits, in accordance with NPDES requirements, a "Water Quality Management Plan" shall be required. (PW) 4. Prior to submittal for building permits, the following shall be completed: a.
