ORAL COMMUNICATION: None ITEM l: TENTATIVE PARCEL MAP NO.99-211 (SCE LARK/WARNER SUBDIVISION) APPLICANT/ PROPERTY OWNER: Southern California Edison, Attention: Mark Raidy, 100 Long Beach Blvd., Rm 1020, Long Beach, CA 90802 REQUEST: To subdivide one lot into two lots. LOCATION: 16961 Lark Lane (northwest corner of Lark Lane and Warner Avenue) PROJECT PLANNER: Amy Wolfe Amy Wolfe, Staff Planner, displayed site plans stating the purpose and location of the request. Staff stated that the proposed subdivision will be in compliance with the Subdivision Ordinance Standards and will exceed the minimum lot frontage and area requirements. The proposed land use is appropriate for the site. Staff recommended approval based upon the findings and conditions as outlined in the staff report. Two telephone calls were received as a result of the public notices. One citizen expressed concern regarding the proposed land use. The second phone call was concerning potential existing hazardous materials on the site. No other comments written or verbal were received. THE PUBLIC HEARING WAS OPENED. Mark Raidy, 100 Long Beach Boulevard, Suite 1020, Long Beach, the applicant, stated that they will conduct a limited environmental assessment at the time of development to ensure no contamination exists. Mr. Raidy stated that they intend to maintain some control or access to the property in order to access the SCE fuel oil pipeline. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. TENTATIVE PARCEL MAP NO.99-211 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR PROJECTS EXEMPT FROM CEOA: The Zoning Administrator finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15315, Class 15, of the CEQA Guidelines, because the tentative parcel map for subdivision of a single family residential property consists of less than four parcels, complies with the General Plan and Zoning, no variances are required, all services and access are available, the parcel was not involved in a division of a larger parcel within the previous two years, and the average slope is less than 20 percent. FINDINGS FOR APPROVAL - TENTATIVE PARCEL MAP NO.99-211: 1. Tentative Parcel Map No. 99-211 for the subdivision of a 21,011 net square foot parcel into one 13,200 net square foot parcel and one 7,811 net square foot parcel for single family residential development is consistent with the General Plan Land Use Element designation of RL-Low Density Residential on the subject property, or any applicable specific plan, or other applicable provisions of this Code. The proposed subdivision meets the following goals and policies of the General Plan: a. Goal LU 2: Ensure that development is adequately served by transportation infrastructure, utility infrastructure, and public services. b. Goal LU 9: Achieve the development of a range of housing units that provides for the diverse economic, physical, and social needs of existing and future residents of Huntington Beach. 2. The site is physically suitable for the type and density of development. No development is proposed at this time on either parcel, however the proposed parcels are relatively flat, rectangular shaped, will have access to a public street, and will be more than adequate in size for development of a new single family residence. 3. The design of the subdivision or the proposed improvements will not cause serious health problems or substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. The subject parcel is located within a highly urbanized area and is surrounded by existing development of single family residential units and the Meadowlark Golf Course. The subdivision of the parcel and subsequent development of two single family dwellings will have no adverse impacts on any fish or wildlife or their habitat. 4. The design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision unless alternative easements, for access or for use, will be provided. ZA Minutes 05/10/00 2 (OOZM0510) CONDITIONS OF APPROVAL - TENTATIVE PARCEL MAP NO.99-211: 1. The tentative parcel map received and dated March 30, 2000 shall be the approved layout. 2. A reproducible mylar copy and a print of the recorded parcel map, along with digital graphic files of the recorded map per the City of Huntington Beach "CAD Standards Manual for Consultants", shall be submitted to the Department of Public Works at the time of recordation. (PW) 3. The engineer or surveyor preparing the final map shall comply with Sections 7-9-330 and 7- 9- 337 of the Orange County Subdivision Code and Orange County Subdivision Manual, Subarticle 18 for the following item: a. Tie the boundary of the map into the Horizontal Control System established by the County Surveyor. (PW) 4. The Final Parcel Map shall be recorded with the County of Orange prior to issuance of building permits. (PW) 5. All vehicular access rights to Warner Avenue shall be released and relinquished to the City of Huntington Beach except at locations approved by the Zoning Administrator. (PW) 6. The Departments of Planning and Public Works are responsible for compliance with all conditions of approval herein. The Planning Director and Public Works Director shall be notified in writing if any changes to the parcel map are proposed as a result of the plan check process. Permits shall not be issued until the Planning Director and Public Works Director have reviewed and approved the proposed changes for conformance with the intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the Zoning Administrator may be required pursuant to the HBZSO. INFORMATION ON SPECIFIC CODE REQUIREMENTS - TENTATIVE PARCEL MAP NO. 99-211: 1. Tentative Map Parcel No. 99-211 shall become null and void unless exercised within two (2) years of the date of final approval. An extension of time may be granted by the Planning Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 2. The applicant shall submit a check in the amount of $38 for the posting of the Notice of Exemption at the County of Orange Clerk's Office. The check shall be made out to the County of Orange and submitted to the Planning Department within two (2) days of the Zoning Administrator's action. 3. Tentative Parcel Map No. 99-211 shall not become effective until the ten calendar day appeal period has elapsed. ZA Minutes 05/10/00 3 (OOZM0510) 4. The Zoning Administrator reserves the right to revoke Tentative Parcel Map No. 99-211, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 5. All applicable Public Works fees shall be paid. 6. Park Land in -lieu fees shall be paid based on August 1998, City park land appraisal value of $516,000 per acre pursuant to Section 254.08H of the HBZSO prior to approval of the parcel map by the City Engineer.
