Call To Order
Mayor Garofalo called the adjourned regular meetings of the City Council and the
Redevelopment Agency of the City of Huntington Beach to order at 4:00 p.m. in Room D of the
Central Library.

Late Communications
Deputy City Clerk, Liz Ehring announced Late Communications that pertain to the study session
item:
Communication from the Office of the City Attorney dated July 7, 2000 titled Proposition 218 as
Applied to the Findings and Recommendations of Citizens Infrastructure Advisory Committee,
Proposition 218.
Slide report dated July 10, 2000, titled City of Huntington Beach -- City Council and Citizens'
Infrastructure Advisory Committee Study Session -- Final Report Recommendations.
(City Council) Study Session — Received and Filed Citizens Infrastructure Advisory
Committee (IAC) Final Report (840.50)
The City Council considered a slide report presented by the Infrastructure Advisory Committee
(IAC) Chairperson Richard Harlow transmitting the key recommendations of the Citizens'
Infrastructure Advisory Committee in its Final Report. Announced earlier as a Late
Communication by the Deputy City Clerk, the report is dated July 10, 2000 and titled City of
Huntington Beach — City Council and Citizens' Infrastructure Advisory Committee Study Session
— Final Report Recommendations.
Chair Harlow thanked the City Council and City Administrator Ray Silver and his staff for their
work in conjunction with the Citizens' Infrastructure Advisory Committee. Mr. Harlow introduced

the IAC members and the Public Awareness Sub -Committee members, as well as a consulting
team that includes Gary Dysart from PSOMAS and Julie Che from Frank Wilson. and
Associates.
Mr. Harlow referred to a wall chart titled Issues, Questions, Concerns that focuses on many of
the topics that were discussed at the June 9, 2000 City Council session, at which time the IAC
presented its Interim Report. The chart elaborates upon the following items:

♦ Public Awareness
♦ Citizen's Oversight Board
♦ Infrastructure Fund
♦ 10% Maintenance of Effort
♦ Vote on New Funds
A group discussion led by IAC Chair Richard Harlow and Public Awareness Sub -Committee
Chair Mary Urashima included the goals and objectives of Public Awareness, Advocacy,
Reorganization, Policy, and Financing and Funding.
In the area of Public Awareness, Sub -Committee Chair Mary Urashima relayed the message
that an informed decision by the citizenry is key to the success of the program.
Councilmember Green stated that public safety should be the group's uppermost concern,
emphasizing that the city should ensure, for instance, that flood control channels, pumps, and
sewer systems are working properly, and that streets should have adequate signaling and
signage.
Mayor Pro Tern Harman initiated deliberation by the Council whether the city should take a pro-
active or a re -active stance towards infrastructure funding, keeping mindful of the fact that the
need for repairs and maintenance does not appear to be at a crisis point.
Mayor Garofalo stated that it is not the intent of Council to make a determination on the IAC's
findings and recommendations. The Mayor declared that the main purpose of this meeting's
presentation is to receive and file the IAC Final Report.
Councilmember Bauer expressed the sentiment relative to Advocacy Goals and Objectives that
historically, the state legislature has not been receptive to lobbying efforts. He cited issues
involving Air Quality Management District (AQMD) compliance requirements as a case in point.
Relative to setting standards for monitoring the longevity of certain infrastructure improvements,
Chair Harlow informed Council that presently there are no procedures in place that enable the
city to determine the length of time that structures such as storm drains are expected to last.
Chair Harlow reported that the Integrated Infrastructure Management Program (IIMP) document
should be received in a few months and that it calls for continued support of the Public
Awareness program.
Mayor Garofalo directed the IAC Chair and the Co -Chair, Dr. Gerald Chapman to meet with the
two Council Liaisons, Dettloff and Green in response to Chair Harlow's request for Council to

appoint an oversight committee based on a triad composed of City Council, IAC, and citizens -at -
large -representatives.
Councilmember Julien reiterated the original goal of the Infrastructure Advisory Committee,
which she stated is to get a good cross-section of the community to buy into the program.
Councilmember Sullivan thanked the IAC members for the wonderful work they have done. He
stated that the passage by a two-thirds vote in the area of taxation would require a tremendous
public awareness program.
Mayor Pro Tern Harman commended the IAC's efforts of 27 months, stating that its outstanding
work is worthy of a Putnam Award. The Mayor Pro Tern cautioned against adverse publicity
Council may encounter in reference to the committee's proposal for a Charter Amendment.
Councilmember Dettloff conveyed her pleasure at Mayor Pro Tem Harman's "second look„ at
the committee's proposals, expressing her appreciation to the IAC members on behalf of herself
and Councilmember Green as Council Liaisons. She made the announcement that the IAC has
done what no other city in the nation has ever accomplished.
In concurrence with Councilmember Dettloff's comments regarding the uniqueness of the IAC's
accomplishment, Councilmember Green encouraged that the momentum continue, and urged
against dissolution of the committee.
Considerable discussion ensued relative to several sections on sources of revenue covered in
the IAC Final Report, and on the goals and objectives of the remaining agenda topics for
discussion on Reorganization, Policy, and Financing and Funding.

Councilmember Bauer suggested 'a Plan B may need to be formulated and taken into
consideration should the proposed Charter Amendment not pass due to timing.
Discussion turned to the issue of the Charter Amendment, in which clarification was sought from
Assistant City Attorney Scott Field relative to a communication from the City Attorney's Office
distributed at the Study Session. The communication dated July 7, 2000 and titled Proposition
218 as Applied to the Findings and Recommendations of Citizens Infrastructure Advisory
Committee, Proposition 218 had been announced earlier as a Late Communication by the
Deputy City Clerk.
Assi6tarif.dity Attorney Field informed Council that Propositions 218 and 13, as well as the two-
thirds voting requirement could be subjects of ambiguity in the future, in relation to the IAC's
findings and recommendations and proposed Charter Amendment. Mr. Field provided the
example that the IAC tax initiative could be perceived by the public as somehow connected to
the advisory measure scheduled for the November 2000 ballot that proposes the imposition of
the utility tax on the AES Utility Facility.
Discussion at length ensued, after which Mayor Garofalo suggested that staff conceptualize the
legal opinion of the City Attorney's Office, and return at the next study session at the
July 17, 2000 Council meeting.

Motion Fails to Prepare Charter Amendment for November 7, 2000 Election. ( . )
A motion was made by Green, second Dettloff to direct the City Clerk to have a ballot initiative
measure prepared prior to the July 17, 2000 Council meeting that includes summary text on
page 8 of the IAC Final Report. The motion failed by the following roll call vote:
AYES: Harman, Green, Dettloff
NOES: Julien, Sullivan, Garofalo, Bauer

Subsequent to a discussion on time -lines, City Administrator Ray Silver suggested that IAC
Chair Harlow and Vice -Chair Chapman meet with Council Liaisons Green and Dettloff and staff
to develop a report to be presented at a future date regarding the feasibility of this item as a
ballot measure. Council concurred.
