dwelling being built adjacent to his home. He is concerned about privacy issues and the
Infill Ordinance.

THE PUBLIC HEARING WAS OPENED.
Don Stephens, 18711 Beach Boulevard, applicant, stated that subject site is getting older and
they are trying to maintain its attractiveness. The request for additional height of the sign is
because the height of an existing palm tree will block its view.
Terrance Shannon, 34052 La Plaza Drive, #205, Dana Point, Counsel for General Motors, stated
that he concurs with staffs recommendation. He stated they are attempting to create an
attractive site by upgrading it.

Commissioner Speaker stated that he appealed the request because the overall reduction in
amount of signage would cause it to be blocked by the existing palm tree. He stated that if the
palm tree were to be removed then the sign should be returned to a maximum sign height of 20
feet.
Commissioners Kerins and Biddle stated opposition to approving the appeal because it would be
preferential treatment and would set a precedent. They felt the sign should be in conformance
with the code especially when the city is trying to upgrade Beach Boulevard.

FINDINGS FOR PROJECTS EXEMPT FROM CEOA:
The Planning Commission finds that the project will not have any significant effect on the
environment and is exempt from the provisions of the California Environmental Quality Act
(CEQA) pursuant to Section 15311 of the CEQA Guidelines, because it consists of the
placement of a minor accessory structure (on -premise sign) on an existing commercial facility.
FINDINGS FOR APPROVAL - SIGN CODE EXCEPTION NO.00-02:
1. Sign Code Exception No. 00-02 to permit a 38 feet high, 50 square foot freestanding
identification sign in lieu of a maximum height of 20 feet for the existing McKenna
Volkswagen auto dealership is compatible with the character of the area and is needed for
special circumstances defined by the applicant and approved by the Planning Commission.
The new freestanding sign will provide clear and coordinated signage and business exposure
to motorists traveling north and south on Beach Boulevard. The new freestanding sign will
be compatible with the design of the two-story building renovation and will be more
aesthetically pleasing than the existing 40-foot high sign. The proposed sign is compatible
with the character of the area and is needed for special circumstances defined by the
applicant. The new sign in conjunction with the dealership renovation of the existing
dealership is part of a National Design Program in North America by Volkswagen of
America. Other surrounding dealerships have signs that exceed the maximum height allowed
by code. Furthermore, existing palm trees along the front property line would impact the
visibility of a 20-foot high sign.
2. The proposed sign will not adversely affect other signs in the area. The signs will not block
the visibility of other signs in the surrounding area, and are compatible with existing signs
within the general vicinity.

3. The proposed signage will not be detrimental to properties located in the vicinity and will be
compatible with the surrounding area. The height of the 38-foot freestanding sign is similar
to other business identification signs in the immediate vicinity, including Terry York Ford
and Delillo Chevrolet and will not adversely affect adjacent properties.
4. The proposed signage will not obstruct vehicular or pedestrian traffic visibility and will not
be hazardous distraction. The sign will be located outside the driveway visibility cutoff
above the sight line of traffic and will not obstruct vehicle or pedestrian visibility.
CONDITIONS OF APPROVAL — SIGN CODE EXCEPTION NO.00-02:
1. The site plan and sign elevations received and dated May 11, 2000 shall be the approved
layout with the following conditions:
a. Address numbers shall be installed to comply with City Specification No. 428. The size
of the numbers will be sized a minimum of six (6) inches with a brush stroke of one and
half (1-1/2) inches. (FD)
2. Prior to submittal for building permits, the zoning entitlement conditions of approval shall be
printed verbatim on the second page of all working drawing sets used for issuance of building
permits (architectural, structural, electrical and mechanical).
3. The sign copy shall be restricted to the VW logo and street address. Any additional sign
copy will require review and approval by the Planning Commission
4. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the site, sign or elevations
plans are proposed as a result of the plan check process. Building permits shall not be issued
until the Planning Director has reviewed and approved the proposed changes for
conformance with the intent of the Planning Commission's action and the conditions herein.
If the proposed changes are of a substantial nature, an amendment to the original entitlement
reviewed by the Planning Commission may be required pursuant to the HBZSO.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
1. Sign Code Exception No. 00-02 shall not become effective until the ten -calendar day appeal
period has elapsed.
2. Sign Code Exception No. 00-02 shall become null and void unless exercised within one year
of the date of final approval which is June 12, 2001 or such extension of time as may be
granted by the Director pursuant to a written request submitted to the Planning Department a
minimum 30 days prior to the expiration date.
3. The Planning Commission reserves the right to revoke Sign Code Exception No. 00-02,
pursuant to a public hearing for revocation, if any violation of these conditions, including any
changes that affect the basis of the findings (e.g., obstruction of palm trees), or the
Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs.
4. All applicable fees from the Building, Public Works, and Fire Departments shall be paid prior
to the issuance of Building Permits.

5. The development shall comply with all applicable provisions of the Municipal Code,
Building Department, and Fire Department as well as applicable local, State and Federal Fire
codes, Ordinances, and standards, except as noted herein.
6. Construction shall be limited to Monday — Saturday 7:00 AM to 8:00 PM. Construction shall
be prohibited Sundays and Federal holidays.
7. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of
Exemption at the County of Orange Clerk's Office. The check shall be made out to the
County of Orange and submitted to the Planning Department within two (2) days of the
Planning Commission action.
8. All landscaping shall be maintained in a neat and clean manner, and in conformance with the
HBZSO. Prior to removing or replacing any landscaped areas, including palm trees, check
with the Departments of Planning and Public Works for Code requirements. Substantial
changes may require approval by the Planning Commission.
9. All signs shall conform to the HBZSO, except for the deviations granted under Sign Code
Exception No. 00-02. Prior to installing any new signs, or changing sign faces, a building
permit shall be obtained from the Planning Department.
B-2 CONDITIONAL USE PERMIT NO.00-28/COASTAL DEVELOPMENT PERMIT
NO.00-07 (FARMER'S MARKET/CRAFTS FAIRE AT PIER PLAZA):

- Farmer's Market to occupy top tier of parking lot between the plaza and vehicular entry

- Crafts Faire to occupy plaza between the Municipal Pier and parking lot north of the pier.
Staffs Recommendation:
Approve Conditional Use Permit No. 00-28 and Coastal Development Permit No. 00-07
based upon the following:
- Required pedestrian, vehicular, disabled and emergency access is maintained.
- General Plan and Local Coastal Program goals and objectives to enhance pedestrian
traffic in the downtown which compliments visitor serving commercial uses.
- Relocation results in no net loss of parking from prior locations.
- City staff assistance in parking control and set-up and clean-up operations.
The Commission asked staff what would happen to other activities scheduled for the subject site.
Staff explained that the activities are coordinated through the Special Events Committee.

The Commission stated that they want the use of Pier Plaza and the proposed use to be flexible in
conjunction with other uses. They do want the proposed use to monopolize the site.

FINDINGS FOR PROJECTS EXEMPT FROM CEOA:
The Planning Commission finds that the project will not have any significant effect on the
environment and is exempt from the provisions of the California Environmental Quality Act
(CEQA) pursuant to Section 15304 of the CEQA Guidelines, because minor temporary use of
land having negligible or no permanent effects on the environment, including carnivals, sales of
Christmas trees, etc., are exempt from further environmental review.
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO.00-28:
1. Conditional Use Permit No. 00-28 for the relocation, maintenance and weekly operation of
the Farmers Market and Crafts Faire will not be detrimental to the general welfare of persons
working or residing in the vicinity or detrimental to the value of the property and
improvements in the neighborhood. With the conditions imposed, the operation of the
weekly event will not impact the surrounding businesses, residents, or beach related
activities.
2. The Farmers Market and Crafts Faire will be compatible with surrounding commercial,
residential, and beach related uses. The fair will occur on a weekly basis during typical retail
business hours and will not adversely impact the surrounding retail, restaurant, office and
residential uses.
3. The relocation of the Farmers Market and Crafts Faire will comply with the provisions of the
base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning
and Subdivision Ordinance. No variances are requested as part of this request.
4. The granting of the conditional use permit will not adversely affect the General Plan. It is
consistent with the Land Use Element designation of Open Space -Shoreline on the subject
property. In addition, it is consistent with the following goals and policies of the General
Plan:
Policy L U 10.1.17: Require the inclusion of uses and elements that contribute
amenities for visitors, such as public activity areas and onsite recreational facilities.

Policy LU 14.1.3: Require that structures located in the City's parks and other open spaces
be designed to maintain the environmental character in which they are located.
Policy 9.5.1.2: Protect encourage and where feasible provide a variety of recreation
facilities which provide opportunities for all income groups.
Policy 9.5.2.5: Protect, encourage, and where feasible provide visitor serving facilities in
the coastal zone which are varied in type and price.
The market and crafts faire encourages residents and visitors to the downtown, and provides
for variety in the recreational opportunities in and around the Municipal Pier area. The
weekly event consists only of temporary structures which are removed upon completion of
the event.
FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO.00-07:
1. Coastal Development Permit No. 00-07 for the relocation of the Farmers Market and Crafts
Faire, conforms with the plans, policies, requirements and standards of the Huntington Beach
Coastal Element of the General Plan.
2. Coastal Development Permit No. 00-07 is consistent with the requirements of the CZ
Overlay District, the base zoning district, as well as other applicable provisions of the
Municipal Code. The temporary use does not involve the construction of permanent
structures. Minimum aisle widths will be provided; no variances to development standards
are requested.
3. At the time of occupancy the proposed development can be provided with infrastructure in a
manner that is consistent with the Local Coastal Program. All infrastructure exists for the
proposed market that is consistent with the Huntington Beach Coastal Element and Coastal
Land Use Plan of the General Plan.
4. The relocation of the market conforms with the public access and public recreation policies
of Chapter 3 of the California Coastal Act. All public access will remain to the beach and
pier area.
CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO.00-28/COASTAL
DEVELOPMENT PERMIT NO.00-07:
1. The site plan, floor plans, and elevations received and dated May 1, 2000 shall be the
conceptually approved layout.
2. Prior to each event, the parking spaces to be utilized for the market shall be clearly posted
and signed for Temporary No Parking. (PV)
3. During the event, the following shall be complied with:
a. Hours of operation shall be limited to Fridays between 7:00 AM to 9:00 PM.
b. Provide police or parking enforcement patrols to eliminate parking violations.

c. All stands/booths shall be self-supporting units; no nails, stakes, holes shall be permitted
in parking lot or pavers.
d. The height of temporary structures shall not exceed ten (10) feet.
e. All vendors shall make appropriate arrangements for collection of refuse and the clean up
of the site after closure of the event.
f. If lighting is proposed, an electrical lighting plan shall be submitted and approved by the
Fire Department, and Building and Safety Department. All outside lighting shall be
directed to prevent "spillage" onto adjacent properties.
g. Emergency access shall be maintained in the aisle. (PW)
h. No access shall be taken from the intersection of PCH and Main St. (PW)
i. Public Works Inspection/Survey will be conducted to ensure integrity and identify any
damage in writing to the applicant.
4. The event may be operated in conjunction with other events at Pier Plaza. Other major
events approved by specific events permit take precedent over the weekly event, and may
require the occasional cancellation of the event.
5. The Planning Director shall be notified in writing if any changes to the market are proposed.
No changes shall be made until the Planning Department has reviewed and approved the
changes. The Planning Department reserves the right to require that an amendment to the
original entitlement be processed if the proposed changes are of a substantial nature.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:

appealable area of the coastal zone, there is an additional ten working day appeal period
that commences when the California Coastal Commission receives the City's notification of
final action
2. Conditional Use Permit No. 00-28 and Coastal Development Permit No. 00-07 shall

July 11, 2001, or such extension of time as may be granted by the Planning Director

B-3 REVOCATION OF CONDITIONAL USE PERMIT NO.92-1(R) (WETLANDS
AND WILDLIFE CARE CENTER):
APPLICANT: Gary Gorman, Huntington Beach Wetlands Conservancy
LOCATION: 21900 Pacific Coast Highway (northeast corner at Newland Avenue)

• Revocation of Conditional Use Permit No. 92-1 (R) a request:
Establish the temporary Wetlands and Wildlife Care Center as a permanent use.
The facility includes: a 425 square foot visitor center, a 1,860 square foot hospital,
a 2,625 square foot cleaning building, 5,250 square feet of existing animal
enclosures with another 6,000 square feet of enclosures proposed in the future.
The development also includes the replacement of a preexisting nonconforming
six-foot high perimeter fence in the front and exterior side yard area (Newland
and PCH) as required pursuant to a condition of approval the facility.
Staffs Recommendation:
Revoke Conditional Use Permit No. 92-1 (R) based upon the following:
- The failure to comply with approved conditions of approval in a timely manner including
completion of necessary on -site and off -site improvements and obtaining all required
building permits for the buildings and modular trailer, which were installed without
permits.
- The applicant has failed to comply with the conditions of approval in a timely manner to
ensure the use will be compatible with the surrounding area.
- The conditional use permit was issued on the basis of erroneous information or
misleading information or misrepresentation. The permit was issued based on the
applicant's acceptance to comply with the conditions of approval in a timely manner.
THE PUBLIC HEARING WAS OPENED.
Gary Gorman, Huntington Beach Wetlands Conservancy, applicant, requested that the
Commission take alternative action "A" which would not revoke the conditional use permit and
the Commission could revise the approved conditions of approval. Mr. Gorman stated that he
realizes he has not met the conditions but the center relies on volunteer funds and services.

Lena Yee Hayashi, 9572 Castine Drive, stated that they fell behind in meeting the conditions of
approval because in 1998 they had to deal with the injuries from the oil spill. Immediately
following that came the baby bird season and then the boiler and the freezer broke. Ms. Hayashi
stated that the first duty of the center is to care for the animals.
Mark Meizner, 14802 Chestnut Street, Westminster, representing Southern California Edison
(SCE), stated that SCE is a strong supporter of the center and it is a positive component of the
city. He strongly urged the Commission to approve an extension for a reasonable amount of
time.
Joseph Racano, 317 5t' Street, volunteer at the center, stated that Huntington Beach has the
largest area of wetlands on the California coast and the center is necessary for the care of injured
animals. He urged the Commission to grant an extension.
Carol Westling, 40 Balboa Coves, Newport Beach, volunteer at the center, urged the
Commission to grant an extension.
Toni Doyle, 1629 W. Ball Road, Anaheim, volunteer at the center, urged the Commission to
grant an extension.
Engrid Mathews, 1718 Galaxy, Newport Beach, volunteer at the center, urged the Commission
to grant an extension.
Margaret Nichols, volunteer at the center, urged the Commission to grant an extension.
Jamie Paulat, 7282 Yellowtail, #204, volunteer at the center, urged the Commission to grant an
extension stating the center is a huge asset to the city.
Lisa Hofer, 1227 Emerald Bay, Laguna Beach, volunteer at the center, urged the Commission to
grant an extension.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Commissioner Livengood stated that he took a tour of the site and talked with the manager. His
major concern is with the health and safety of the employees, animals and the public and
secondary is the landscaping. Commissioner Livengood stated that he would support a one-year
extension for the parking lot paving and 30-60 day extension for the trailer to become compliant.
Commissioner Mandic supports the extension and pleaded with the Commission to understand
the special needs of the center.
Commissioner Biddle stated that he understands the center has special needs because it is
voluntary; however, feels more substantial work should be done before he would favor an
extension.
Commissioners Speaker and Chapman stated they would support the extension reluctantly and
urged the applicant to have more substantial work done before the next review, as they would not
support further extensions.

Commissioner Kerins — requested staff investigate the dust control issues caused by new
construction at the end of the access road between Huntington Beach High School, the
park and existing residences. Commissioner Kerins expressed concern regarding a
Zoning Administrator Agenda item regarding the proposed subdivision of a commercial
site. He stated that commercial sites that are subdivided become difficult to rehabilitate
because of ownership patterns. Staff stated that they feel this subdivision of commercial
property will not impact any future rehabilitation. Commissioner Kerins requested staff
address the letter dated July 11, 2000 from EKN Engineering regarding the impacts of
the draft Design Guidelines on the Lowe's Home Improvement Warehouse. Staff stated
they would review the letter and incorporate a response in the upcoming staff report on
the Design Guidelines.
Commissioner Mandic — requested that staff explain why there is a problem with new
construction and privacy issues as brought forward by Moktar Saleh. Staff stated that
they would forward to her the code sections that govern infill projects.
Commissioner Chapman — requested staff to schedule a meeting with the appropriate
parties to discuss and resolve the issue of landscape maintenance at the Seacliff School
site.

Commissioner Livenizood — requested that staff agendize the issue of Mr. Saleh's home
on the July 25, 2000 Planning Commission meeting as an informational items
Commissioner Speaker — reiterated the Commission's request to condition Item B-2,
Farmer's Market, to allow other uses to share the pier plaza area at certain times.
The Commission discussed the role of the Planning Commission when the Commission's
decisions are appealed to the City Council. In particular, when the Staff has a different
recommendation than the Planning Commission. After Commission and staff discussion, the
Planning Commission stated they would like to initiate a policy that the Commission be part of
the sta$'s presentation to City Council when staff and the Commission have different
recommendations.
