ZONING ADMINISTRATOR: STAFF MEMBER: MINUTES: ORAL COMMUNICATION: ITEM 1: Mary Beth Broeren Sandra Thornton, Ricky Ramos, Ramona Kohlmann (recording secretary) June 21, 2000 None PETITION DOCUMENT: CONDITIONAL USE PERMIT NO.00-33 (VEHICLE STORAGE) APPLICANT: Clay James, 16555 Beach Boulevard, Huntington Beach, CA 92647 PROPERTY OWNER: John Mullin, 2033 Monterey Road, South Pasadena, CA 91030 REQUEST: To permit the outdoor storage of new and used vehicles for a maximum of five (5) years. LOCATION: 16300 Gothard Street (on the east side of Gothard Street north of Heil Avenue) PROJECT PLANNER: Sandra Thornton Sandra Thornton, Staff Planner, displayed site plans and photographs stating the purpose, location and zoning of the request. Staff stated that because of the nature of the project, the project is not subject to full landscape requirements except for upgrading the landscaping on Gothard Street. Staff recommended approval of the request based upon the findings and subject to the conditions as outlined in the staff report and because the project complies with all zoning requirements. No written or verbal comments were received in response to the public notification. THE PUBLIC HEARING WAS OPENED. Clay James, 16555 Beach Boulevard, the applicant, stated that Huntington Beach Dodge, Toyota of Huntington Beach and Norm Reeves Honda will be utilizing the property to expand their businesses. Mr. James agreed to the conditions as suggested in the staff report, specifically the conditions prohibiting the washing and repair of automobiles on the proposed site and the prohibition of customers on the site. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. CONDITIONAL USE PERMIT NO.00-33 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR PROJECTS EXEMPT FROM CEOA: The Zoning Administrator finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to section 15304 of the CEQA Guidelines, because the outdoor storage of new and used vehicles for a maximum of five (5) years is considered a minor temporary use of land which will have negligible effects on the environment and is therefore exempt from CEQA. FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 00-33: Conditional Use Permit No. 00-33 for the establishment, maintenance and operation of the outdoor storage of new and used vehicles for a maximum of five (5) years will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The project will allow a vacant industrial site to be reused with a use that is compatible with the surrounding industrial area. In addition, the site will be used for vehicle storage purposes only, which will produce less noise than the previous lumberyard. 2. The conditional use permit will be compatible with surrounding uses because the subject site is located within an industrial district, which contains many similar uses. The previous use on the subject site was a lumberyard where the outdoor storage of lumber and related materials was allowed. 3. The proposed Conditional Use Permit No. 00-33 will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. There are no physical changes to the site, no structures proposed and no expansion of use. The request is only a change of use from outside lumber storage to automobile storage. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Industrial General on the subject property. ZA Minutes 07/26/00 2 (OOZM0726) CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO.00-33: 1. The site plan received and dated June 9, 2000 shall be the conceptually approved layout with the following modifications: a. The configuration of the vehicle storage layout shall be modified such that no vehicles are parked over the existing on -site public water line or block access to fire hydrants. (PW) b. Include the circulation plan and dimensions of all roads on the site plan. (FD) 2. Prior to the commencement of the use, the following shall be completed: a. The five (5) existing on -site fire hydrants must be operational prior to cars being parked on - site. (FD) b. Address numbers shall be installed to comply with City Specification 428. (FD) c. Security gates shall be designed to comply with City Specification 403. (FD) d. Fire extinguishers shall be installed and located in areas to comply with Huntington Beach Fire Code standards. (FD) e. A landscape plan depicting upgraded plant and tree materials to the landscape planter on Gothard Street shall be submitted to the Park, Tree, and Landscape Division for review and approval within 3 months of this approval (October 26, 2000). Required landscaping shall be installed within 12 months of this approval (July 26, 2001). (PW) f. Plans showing details for fencing, gates, and turn -around configuration at the entrance area shall be submitted to Public Works for review and approval by the Traffic Division. (PW) g. In accordance with NPDES requirements, a "Water Quality Management Plan" shall be prepared by a Civil or Environmental Engineer, and shall be submitted to Public Works for review and approval. This is required because of the potential for oil leakage, etc. from the vehicles. (PW) h. If resurfacing of the car storage area is proposed, the work shall be shown on a Grading Plan, prepared by a Licensed Civil Engineer, and shall be submitted to the Public Works Department for review and approval. (PW) i. Traffic Impact Fees shall be calculated by the Public Works Department and, if applicable, paid. (PW) (Code requirement) j. A Knox Box shall be included at the controlled entrance to allow the Police Department to enter in the event of an emergency. (PD) ZA Minutes 07/26/00 3 (OOZM0726) 3. The use shall comply with the following: a. All loading or unloading of vehicles shall be conducted on -site. (PW) b. Standard landscape code requirements apply to the existing landscaping fronting Gothard (Chapter 232 of the Zoning and Subdivision Ordinance), as approved by the Park, Tree, and Landscape Division. (PW) c. Retail sales, including auctions, shall not be permitted on -site. d. Inoperable vehicles are not allowed on -site. e. Advertisements (i.e. signs on the property, signs on the cars intended to attract attention to the site, banners, balloons, pennants) are prohibited on -site. f. Washing of cars is not permitted on -site. g. Repair or maintenance of vehicles is prohibited on -site. h. If the use becomes permanent (longer than five (5) years), a decorative block wall will be required to surround the property. 4. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan or use are proposed. No changes shall occur until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the Zoning Administrator may be required pursuant to the HBZSO. 5. Conditional Use Permit No. 00-33 shall be valid for a maximum of five (5) years from the date of this approval (July 26, 2005). INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. Conditional Use Permit No. 00-33 shall not become effective until the ten calendar day appeal period has elapsed. 2. Conditional Use Permit No. 00-33 shall become null and void unless exercised within one year of the date of final approval which is July 26, 2001, or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 3. The Zoning Administrator reserves the right to revoke Conditional Use Permit No. 00-33, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. ZA Minutes 07/26/00 4 (OOZM0726) [1 4. All applicable fees from the Building, Public Works, and Fire Departments shall be paid prior to the issuance of Building Permits. 5. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. 6. The applicant shall submit a check in the amount of $43.00 for the posting of the Notice of Exemption at the County of Orange Clerk's Office. The check shall be made out to the County of Orange and submitted to the Planning Department within two (2) days of the Zoning Administrator's action. 7. All landscaping shall be maintained in a neat and clean manner, and in conformance with the HBZSO. Prior to removing or replacing any landscaped areas, check with the Departments of Planning and Public Works for Code requirements. Substantial changes may require approval by the Zoning Administrator.
