ZONING ADMINISTRATOR: Mary Beth Broeren STAFF MEMBER: Sandra Thornton, Ricky Ramos, Ramona Kohlmann (recording secretary) MINUTES: None ORAL COMMUNICATION: None ITEM 1: CONDITIONAL USE PERMIT NO.00-37 (GOSSETT DAY CARE) APPLICANT/ PROPERTY OWNER: Gary and Toni Gossett, 8741 Adams Avenue, Huntington Beach, CA 92646 REQUEST: To permit a large family childcare facility (up to 12 children). LOCATION: 8741 Adams (north side of Adams between Newland St. and Magnolia St.) PROJECT PLANNER: Sandra Thornton Sandra Thornton, Staff Planner, displayed site plans stating the purpose, location and zoning of the request. Staff stated that the site is currently licensed as a childcare facility to accommodate up to six children, and there have been no code enforcement complaints. Staff recommended approval of the request based upon the findings and subject to the conditions as outlined in the staff report and because the project will comply with the Zoning and Subdivision Ordinance. Staff stated that the required parking can be accommodated on -site. Five letters were received from neighboring residents opposing the request concerning issues of noise, parking, and a negative impact on property values. THE PUBLIC HEARING WAS OPENED. Glenna Jones, 8721 Adams Avenue, adjacent neighbor, opposed the request because of the increase in noise level, vehicle congestion, danger in loading and unloading children from vehicles, parking problems, and detriment to property values. Mary Beth Broeren, Zoning Administrator, stated that she has reviewed a letter received from Glenna Jones dated July 25, 2000. Randall Borden, 19942 Felcliff Lane, neighboring property owner, opposed the request stating that screaming children can be heard, property values will be impacted, play equipment is too close to the blockwall, problems will occur with traffic and parking, and the request is in violation of the CC&R's. Mr. Borden stated that many residents were not able to attend today's meeting because of conflict with work hours and asked why the meeting could not have been held during the evening hours. Mary Beth Broeren, Zoning Administrator, stated that she has reviewed a letter received from Patricia Borden dated August 1, 2000. Barbara Anne Evanshen, neighboring property owner, opposed the request because of concerns related to parking, traffic and property values. Ms. Evanshen stated that the childcare facility would have to be disclosed should she decide to sell her property. Ms. Evanshen stated that breaches in parking have occurred, vehicles have blocked pedestrian traffic, and children are being picked up after 5:30 p.m. Mary Beth Broeren, Zoning Administrator, stated that she has reviewed a letter received from Pete and Barbara Evanshen dated August 3, 2000. Danielle Nagao, 19952 Felcliff Lane, neighboring property owner, opposed the request and disagreed with the Zoning and Subdivision Ordinance as interpreted by staff in the staff report. Ms. Nagao stated that the project would be a detriment because of the negative impact to property values, and that her general welfare will be affected by the noise created by the addition of six children. Ms. Nagao complained about children screaming from inside the facility, stated that she will be home on maternity leave and will have to listen to the noise, that the play equipment is too close to the blockwall, that the facility would devalue property, and that parking, noise and traffic were a concern. Ms. Nagao stated that the staff report recommending approval of the request was viewed as a predetermined decision by the Zoning Administrator. Pete Evanshen, 19971 Felcliff Lane, neighboring property owner, opposed the request stating that the applicant would be the only benefactor in this action and that the facility presents an unsafe situation. Gary Gossett, 8741 Adams Avenue, applicant, stated that the State inspects the childcare facility every two years, parking problems will be remedied, no violations have been filed against the facility, and the facility has been operating for 20 years. Mr. Gossett stated that they control the noise as best as they can and a staff member is outside to monitor the activities. Ryan Bean, 19441 Salmon Lane, stated that he is a schoolteacher, and stated that 12 children would create excessive noise for a residential neighborhood thereby creating a detriment to the property values. Thomas Jones, 8721 Adams Avenue, stated that noise from the facility is a disturbance. Patricia Borden, 19942 Felcliff Lane, neighboring property owner, stated that she was not aware of the childcare facility when she purchased her home 22 years ago. i1 fl LJ ZA Minutes — 08/02/00 2 - (OOZM0802) THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Mary Beth Broeren, Zoning Administrator, stated that she reviewed a letter received on August 1, 2000, from Michael and Maureen Beckens, 19951 Adams Avenue, opposing the request. Ms. Broeren stated that she did visit the site and viewed the parking situation throughout the neighborhood. Ms. Broeren stated that given today's testimony, the parking situation, and the configuration of the properties with several rear yards in close proximity, she concurs that extending the childcare facility would be an incompatible use. Ms. Broeren stated she was going to deny the request and asked staff to create findings as outlined below. CONDITIONAL USE PERMIT NO.00-37 WAS DENIED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS. SHE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR DENIAL - CONDITIONAL USE PERMIT NO.00-37: 1. Conditional Use Permit No. 00-37 for the establishment, maintenance and operation of the large family childcare facility (up to 12 children) will be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. Due to the close proximity and number of rear yards that abut this residence the noise associated with up to 12 children at the facility would impact neighboring properties negatively. In addition, the current parking and traffic conditions are poor and adding more vehicle trips to and from the site would further impact both the parking and traffic conditions in the neighborhood. 2. The conditional use permit will not be compatible with surrounding uses because the parking and traffic conditions at the site are currently poor and adding more vehicle traffic to the area will further impact both the parking -and traffic conditions in the neighborhood.
