Dean Brown, The Planning Consortium, 1111 Town and Country Road, #37, Orange, CA 92868-4667 ® PROPERTY OWNER: City of Huntington Beach, Attention: Matt Lamb, 2000 Main Street, Huntington Beach, CA 92648 REQUEST: To permit a 50-foot high monopole disguised as a palm tree and a 50 square foot equipment cabinet within the Huntington Beach Fire Station parking lot. LOCATION: 3831 Warner Avenue (the north side of Warner Avenue, east of Pacific Coast Highway) PROJECT PLANNER: Sandra Thornton Sandra Thornton, Staff Planner, displayed project plans and photographs, stating the purpose and location of the request. Staff recommended approval of the request based upon the findings and subject to the conditions as outlined in the staff report and because the project conforms with the General Plan, including the Local Coastal Program. No written or verbal comments were received in response to the public notification. THE PUBLIC HEARING WAS OPENED. John Bitterly, 1111 Town and Country Road, #37, Orange, the applicant, stated that they agree with staff's recommended conditions and requested approval of the project. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. 0 COASTAL DEVELOPMENT PERMIT NO. 00-16/CONDITIONAL USE PERMIT NO.00-52 WERE APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) WORKING DAYS. FINDINGS FOR PROJECTS EXEMPT FROM CEOA: The Zoning Administrator finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15303 of the CEQA Guidelines, because the new antenna will be constructed at an existing' parking lot and will not create any noise, traffic, air quality, or adverse visual impacts to the surrounding community. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 00-16: Coastal Development Permit No. 00-16 for the development project, as proposed or as modified by conditions of approval, conforms with the General Plan, including the Local Coastal Program. The new 50-foot high monopole disguised as a palm tree and a 50 square foot equipment cabinet conform to the General Plan designation of Public. The project will not impact public views or access to coastal resources. 2. The project is consistent with the requirements of the CZ Overlay District, the base zoning district, as well as other applicable provisions of the Municipal Code. The project meets all development regulations for the Public -Semipublic zoning district including height. 3. At the time of occupancy the proposed development can be provided with infrastructure in a manner that is consistent with the Local Coastal Program. All necessary infrastructure is provided for the project. 4. The development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. No public access or recreational opportunities exist at the site. FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO.00-52: Conditional Use Permit No. 00-52 for the establishment, maintenance and operation of the 50-foot high monopole disguised as a palm tree and a 50 square foot equipment cabinet within the Huntington Beach Fire Station parking lot will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The monopole will be located centrally within the Huntington Beach Fire Station parking lot, minimizing visual impacts to adjacent properties. The wireless communication facility will not generate noise, traffic or other impacts which would be detrimental to surrounding commercial and residential uses. In addition, landscaping will be added to the area that will help to screen the monopole from view and the operation of the wireless communication facility will provide enhanced, reliable mobile communication to the area. 0 ZA Minutes 09/20/00 (00=0920) 2. The conditional use permit will be compatible with surrounding uses because the proposed ® monopole will be setback substantially from the limits of the site and, as modified, will be disguised as a palm tree, which will blend into the surroundings. 3. The proposed Conditional Use Permit No. 00-52 will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Public on the subject property. In addition, it is consistent with the following goals and policies of the General Plan: a. Goal LU2: Ensure that development is adequately served by transportation infrastructure, utility infrastructure, and public services. b. Objective U5.1: Ensure that adequate natural gas, telecommunication, and electrical systems are provided. c. Policy U5.1.1: Continue to work with service providers to maintain current levels of service and facilitate improved levels of service. The proposed new wireless communication antennas facilitate telecommunication service and improve wireless communication coverage for the community. CONDITIONS OF APPROVAL - COASTAL DEVELOPMENT PERMIT NO.00-16/ CONDITIONAL USE PERMIT NO. 00-52: 1. The site plan and elevations received and dated August 11, 2000 shall be the conceptually approved layout. 2. Prior to issuance of grading permits, the following shall be completed: a. A grading plan, prepared by a Registered Civil Engineer, shall be submitted to the Department of Public Works for review and approval. (PW) b. Drainage shall not be affected by the improvements. (PW) 3. Prior to submittal for building permits zoning entitlement conditions of approval shall be printed verbatim on all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing) and shall be referenced in the index. 4. Prior to issuance of building permits, the following shall be completed: a. A Landscape Construction Set must be submitted to the Department of Public Works and approved by the Departments of Public Works and Planning. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which identifies the location, type, size and quantity of all existing plant materials to remain, ZA Minutes 09/20/00 3 (00=0920) existing plant materials to be removed and proposed plant materials; an irrigation plan; a grading plan; an approved site plan and a copy of the entitlement conditions of approval. (PW) • b. A grading permit shall be issued. (PW) 5. Prior to final building permit inspection and approval the following shall be completed: a. All improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein including landscaping. b. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Planning Department. c. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan or elevations are proposed as a result of the plan check process. Building permits shall not be issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the Zoning Administrator may be required pursuant to the HBZSO. INFORMATION ON SPECIFIC CODE REOUIREMENTS: 1, Coastal Development Permit No. 00-16/Conditional Use Permit No. 00-52 shall not become effective until the ten working day appeal period has elapsed. For projects in the appealable area of the coastal zone, there is an additional ten working day appeal period that commences when the California Coastal Commission receives the City's notification of final action. 2. Coastal Development Permit No. 00-16/Conditional Use Permit No. 00-52 shall become null and void unless exercised within one year of the date of final approval which is September 20, 2001 or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 00- 16/Conditional Use Permit No. 00-52, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. All applicable fees from the Building, Public Works, and Fire Departments shall be paid prior to the issuance of Building Permits. 5. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. • ZA Minutes 09/20/00 4 (00zm0920) 6. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be ® prohibited Sundays and Federal holidays. 7. The applicant shall submit a check in the amount of $43.00 for the posting of the Notice of Exemption at the County of Orange Clerk's Office. The check shall be made out to the County of Orange and submitted to the Planning Department within two (2) days of the Zoning Administrator's action. 8. All landscaping shall be maintained in a neat and clean manner, and in conformance with the HBZSO. Prior to removing or replacing any landscaped areas, check with the Departments of Planning and Public Works for Code requirements. Substantial changes may require approval by the Zoning Administrator. 9. State -mandated school impact fees shall be paid prior to issuance of building permits. 10. An encroachment permit shall be required for all work within the right-of-way. (PW) ITEM 2: CONDITIONAL USE PERMIT NO.00-40 (BUCKINGHAM WIRELESS COMMUNICATIONS FACILITY) APPLICANT: Joe Thompson, Compass Telecom Services, 17870 Skypark Circle, #102, Irvine, California 92614 ® PROPERTY OWNER: August J. Petracy, 5542 Buckingham, Huntington Beach, CA 92649. REQUEST: To install a wireless communications facility including a 53 foot tall antenna support pole and associated equipment. LOCATION: 5542 Buckingham Drive (southeast of intersection of Bolsa Avenue and Graham Street) PROJECT PLANNER: Ron Santos Ron Santos, Staff Planner, displayed project plans, photographs and elevations, and stated the purpose, zoning and location of the request. Staff stated that revised plans were received to locate the proposed monopole near the trash enclosure. Staff recommended approval of the request based upon the findings and subject to the conditions as outlined in the staff report. The project complies with the City Zoning and Subdivision Ordinance, which allows wireless communication facilities to exceed the base district height with approval of a conditional use permit. The project is also consistent with the goals and policies of the General Plan. No written or verbal comments were received in response to the public notification, and no unique conditions were imposed by any City departments. THE PUBLIC HEARING WAS OPENED. Don Lace, 5561 Engineer Drive, neighboring property owner, opposed the project stating that the proposed monopole would be an eye sore and would degrade property values. ® Mary Beth Broeren, Zoning Administrator, and Mr. Lace reviewed photographs of the proposed site and a monopalm. Mr. Lace expressed support of the project if live trees were to be included. ZA Minutes 09/20/00 5 (00zm0920) Joe Thompson, 17870 Skypark Circle, #102, Irvine, the applicant, concurred with staffs recommended conditions and the use of a monopalm instead of a pine. 0 Eva'Young, 5531 Engineer Drive, neighboring property owner, expressed concern that the antenna would interfere with receiving of radio transmissions. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Mary Beth Broeren, Zoning Administrator, and staff discussed the placement of two palm trees adjacent to the proposed monopalm. Ms. Broeren asked staff to change the conditions as follows: Condition l.a: Delete the use of a pine tree and add that the maximum height will be 53 feet to the top of the antenna arrays. Add Condition l.c: A minimum of two palm trees, with a minimum height of 20 feet at time of planting, shall be planted adjacent to the proposed antenna support pole ("monopalm"). The applicant shall be responsible for continued maintenance of all landscaping required. Add Condition 2.e: A landscape and irrigation plan shall be submitted for review and approval by the Public Works Department and Planning Department 0 CONDITIONAL USE PERMIT NO. 00-40 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND MODIFIED CONDITIONS OF APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR PROJECTS EXEMPT FROM CEQA: The Zoning Administrator finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15303 of the CEQA Guidelines. The project consists of the installation of a limited number of new, small facilities and structures. CEQA Guidelines recognize such projects as typically having no significant effect on the environment, and accordingly as "categorically exempt". FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO.00-40: Conditional Use Permit No. 00-40 for the establishment, maintenance and operation of a wireless communications facility, including a 53 foot high antenna support pole and associated equipment, will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The proposed antenna structure, as conditioned, will be designed to simulate the appearance of a tree, thus minimizing potential adverse visual impacts on surrounding properties. All other equipment will ZA Minutes 09/20/00 6 (OO=0920) be located inside the existing industrial building, entirely screened from view. The facility will not ® generate noise, traffic or other impacts which would be detrimental to surrounding commercial and residential uses. 2. The proposed wireless communications facility will be compatible with industrial uses on the project site and surrounding properties. The proposed antenna support pole, as conditioned, will be designed to simulate the appearance of a palm/pine tree, will be consistent with the typical height of palm/pine trees at maturity, and will be sited near existing mature trees. The proposed wireless communications facility will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision, Ordinance and any specific condition required for the proposed use in the district in which it would be located. The HBZSO allows wireless communication facilities to exceed the base district height with approval of a Conditional Use Permit. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of I-F2-d (Industrial — 0.5 maximum F.A.R. — Design Overlay) on the subject property. In addition, it is consistent with the following goals and policies of the General Plan: a. LU 2: Ensure that development is adequately served by transportation infrastructure, utility infrastructure, and public services. b. LTD 2.2: Minimize the visual impacts of oil production facilities and other utilities where they encroach upon view corridors or are visually incompatible with their surrounding uses. c. U 5.1: Ensure that adequate natural gas, telecommunications and electrical systems are provided. d. U.5.1.1: Continue to work with service providers to maintain current levels of service and facilitate improved levels of service. Conditions of approval requiring a simulated tree structure in lieu of the proposed monopole will provide for consistency with the Goals and Policies identified above. In addition, the proposed facility will improve wireless communication service in the community. CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO.00-40: 1. The site plan, floor plans and elevations received and dated August 22, 2000 shall be the conceptually approved layout, with the following modifications: a. A simulated round -trunk palm tree antenna support pole, with a maximum height of 53 feet to the top of the antenna arrays, shall be installed in lieu of the proposed monopole. b. The area designated for emergency generator parking on the approved plans shall not be designated with pavement markings on -site. ® c. A minimum of two palm trees, with a minimum height of 20 feet at time of planting, shall be planted adjacent to the proposed antenna support pole ("monopaW ). The applicant shall be responsible for continued maintenance of all landscaping required pursuant to this Conditional ZA Minutes 09/20/00 7 (00=0920) Use Permit for a period coincident with the existence of the proposed antenna support pole at the site. 2. The following shall be completed prior to issuance of building permits: a. Zoning entitlement conditions of approval shall be printed verbatim on all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing) and shall be referenced in the index. b. A copy of a revised site plan and elevations, reflecting conformance with Condition No. 1, shall be submitted for review, approval and inclusion in the entitlement file to the Planning Department. c. A Building Code Analysis showing compliance with the 1998 California Building Code (CBC) shall be provided on the plans. (BD) d. Structural calculations shall be prepared and submitted showing compliance with the CBC. (BD) e. A landscape and irrigation plan shall be submitted for review and approval by the Public Works Department and Planning Department. The scope of this plan may be limited to the area immediately surrounding the proposed antenna support structure, and shall identify the specific location of palm trees required pursuant to Condition 1. 3. Prior to final building permit inspection and approval the following shall be completed: 0 a. All improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein. b. Fire extinguishers shall be installed and located in areas as necessary to comply with Huntington Beach Fire Code Standards. (FD) c. Fire lanes shall be designated and posted to comply with Fire Department City Specification No. 415. (FD) d. Address numbers will be installed to comply with Fire Department City Specification No. 428. The size of the numbers will be a minimum of six (6) inches with a brush stroke of one and one-half (1-1/2) inches. (FD) e. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Planning Department. f. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. g. Service roads and fire access lanes, as determined by the Fire Department, shall be posted, marked, and maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. (FD) ZA Minutes 09/20/00 8 (00=0920) 4. The Planning Director ensures that all conditions of approval herein are complied with. The ® Planning Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the Zoning Administrator's action and the conditions herein.
