ZONING ADMINISTRATOR: Mary Beth Broeren STAFF MEMBER: Amy Wolfe, Sandra Thornton, Ricky Ramos, Ramona Kohlmann (recording secretary) MINUTES: None ORAL COMMUNICATION: None ITEM 1: CONDITIONAL USE PERMIT NO. 00-53 (MC FADDEN/EDWARDS SERVICE STATION; ALCOHOL SALES) APPLICANT: Thrifty Oil Company, David Rose, 420 McKinley, Suite 111, Corona, CA 92879 PROPERTY OWNER: Thrifty Oil Co., 13539 Foster Road, Santa Fe Springs, CA 90650 ® REQUEST: To permit alcohol beverage sales and minor exterior building and site modifications at an existing service station. LOCATION: 15501 Edwards Street (southwest corner of McFadden Avenue and Edwards Street) PROJECT PLANNER: Amy Wolfe Amy Wolfe, Staff Planner, displayed project plans stating the purpose, location and zoning of the request. Staff stated that the proposed request is subject to approval by the Planning Commission as stated in the staff report pursuant to a condition of approval on a previous entitlement. Mary Beth Broeren, Zoning Administrator, stated that although she was going to refer the requested project to the Planning Commission, she was going to open the public hearing to allow those individuals present the opportunity to speak. THE PUBLIC HEARING WAS OPENED. Dave Rose, 420 McKinley Street, #111, Corona, representing the property owner, concurred with staff s recommendation. Jim Cox, 6522 Corrine Circle, opposed approval of further alcohol permits in the city. Ms. Broeren advised Mr. Cox that he will have an opportunity to speak on this issue at the Planning ® Commission hearing as well as talking with staff. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. CONDITIONA L USE PERMIT NO. 00-53 WAS REFERRED BY THE ZONING • ADMINISTRATOR TO THE PLANNING COMMISSION PURSUANT TO PREVIOUSLY IMPOSED CONDITIONS OF APPROVAL PERTINENT TO THE SUBJECT PROPERTY (ADMINISTRATIVE REVIEW NO. 82-31). ITEM 2• COASTAL DEVELOPMENT PERMIT NO. 00-18 (BOLSA CHICA STATE BEACH APPLICANT: Paul Webb, California State Parks, 8885 Rio San Diego Drive, Suite 270, San Diego, CA 92108 PROPERTY OWNER: California State Parks, Orange Coast District, 3030 Avenida Del Presidente, San Clemente, CA 92672 REQUEST: To permit the following: 1) Demolition of eleven existing restrooms; 2) Construction of ten new restroom buildings; 3) Construction of one combination restroom/shower building; 4) Demolition of all five concessions buildings; 5) Replacement of four concessions buildings; 6) Demolition and replacement of the park headquarters building and lifeguard tower; 7) Construction of a new maintenance shop/yard and central storage facility; 8) Reconfiguration of the coastal multi -use trail; 9) Replacement of all sewer laterals, water lines, and other utilities; 10) Removal of some parking islands; and 11) Resurfacing of the parking lots. LOCATION: 17851 Pacific Coast Highway (PCH between Warner Avenue and Seapoint Avenue) PROJECT PLANNER: Sandra Thornton Sandra Thornton, Staff Planner, displayed project plans, photographs and elevations stating the purpose, location and zoning of the request. Staff stated that the project is exempt from landscaping requirements because it is a State facility, and the project conforms to the General Plan, including the Local Coastal Program. Staff recommended approval of the request based upon the findings and subject to the conditions as outlined in the staff report. Two informational telephone calls were received concerning the proposed project. Ms. Broeren stated that she received a telephone call from an individual asking why the State is going through the City's Coastal Development Permit process when the State is exempt from City requirements. THE PUBLIC HEARING WAS OPENED. Mike Tope, 3030 Avenue Del Presidente, San Clemente, representing the applicant, stated he was available to answer questions. • ZA Minutes — 10/18/00 2 (OOZM1018) Mindy Lebow, 16662 Island Circle, #3, resident, asked what would happen to the existing camping ® area. Mr. Tope explained that the existing camping area would remain; however, it may be subject to closure during construction thereby restricting camping during those months. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Ms. Broeren inquired as to whether the State had received any comments concerning their environmental process. The State representative stated that two letters were received: (1) from the State Water Quality Control Board concerning water runoff, and (2) from the State Lands Commission concerning a conflict with the project and potential lowlands restoration project. Ms. Broeren confirmed that the State was addressing both comment letters. COASTAL DEVELOPMENT PERMIT NO. 00-18 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) WORKING DAYS. CEQA DETERMINATION — COASTAL DEVELOPMENT PERMIT NO. 00-18: The State of California has prepared a negative declaration which satisfies the requirements of CEQA. ® FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 00-18: 1. Coastal Development Permit No. 00-18 for the development project, as proposed or as modified by conditions of approval, conforms with the General Plan, including the Local Coastal Program. The General Plan and Local Coastal Program encourage the development of public parks and water -related recreational uses within areas designated as Open Space - Shoreline. The project will provide the public with an upgraded public safety facility, improved restrooms, and upgraded concession buildings. The redevelopment and upgrade of an existing public beach area is consistent with the General Plan as well as the Local Coastal Program. 2. The project is consistent with the requirements of the CZ Overlay District, the base zoning district, as well as other applicable provisions of the Municipal Code. The project meets all development regulations for the Open Space zoning district, including minimum setbacks and maximum height. The project is exempt from landscaping requirements because it is a state facility. 3. At the time of occupancy the proposed development can be provided with infrastructure in a manner that is consistent with the Local Coastal Program. All necessary infrastructure for the proposed development is currently in place and available at the site. 4. The development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. This project will perpetuate low cost visitor and recreational facilities as recommended by Chapter 3 of the California Coastal Act and will improve access to coastal isresources and will enhance aesthetics from PCH and surrounding properties. In addition, the project proposes to meander the multi use trail which will result in the gain and loss of sand. The ZA Minutes — 10/18/00 3 (OOZM1018) result will be a net loss of no sand and will serve to slow the multi use trail users down near high traffic pedestrian crossings. is CONDITIONS OF AP PROVAL - COASTAL DEVELOPMENT PERMIT NO. 00-18: 1. The site plan, floor plans, and elevations received and dated September 8, 2000 shall be the conceptually approved layout with the inclusion of a site plan which shows the areas where sand will be lost and gained. The site plan will reflect no net loss of sand as indicated in the project description. 2. The use shall comply with the following: a. The existing six-inch water service serving the site shall require a backflow protection device to be installed per the City of Huntington Beach Water Division standards for domestic, fire, and irrigation water services. (PW) b. Turf areas shall be protected from sand deposition by sand walls. Existing walls shall be repaired and/or added to for this protection. (PW) c. Consideration shall be given to removing proposed and/or existing turf areas due to the unusually high degree of maintenance required. (PW) d. Provide additional plantings of Washingtonia Robusta-Palms around the concession, comfort stations and other structures along with the main entry area. Palms to be 10-foot (brown trunk) minimum height. Provide irrigation to each. (PW) 0 e. The Water Ordinance #14.52, the "Water Efficient Landscape Requirements" apply for projects with 2500 square feet of landscaping and larger. (PW) f. All landscape planting, irrigation, and maintenance shall comply with the City Arboricultural and Landscape Standards and Specifications. (PW) g. Installation of required landscape and irrigation systems shall be completed within 12 months of the entitlement. (PW) h. All landscape irrigation and planting installation shall be certified to be in conformance to the City approved landscape plans by the Landscape Architect of record in written form to the City Landscape Architect prior to the final landscape inspection and approval. (PW) i. Fire hydrants should be installed or located within approximately 600 feet of each other. The existing hydrants should be tested to determine their adequacy. New hydrants, if needed, should be tactically located within 150 feet from buildings. Fire flows must be able to provide minimum flow requirements for the largest building on site. (FD) Fire access roads shall be provided for emergency vehicles including fire engines. Provide proper street width and radius turning width. Signs shall be installed and curbs shall be painted to prohibit parking in emergency access and fire hydrant locations. (FD) ZA Minutes — 10/18/00 4 (OOZM1018) k. All fire rings shall have warning signs to caution hidden heat dangers of fire rings. (FD) ® 1. Provide key boxes for emergency personnel to have access to all locked openings. (FD) is in. Fire extinguishers shall be installed and located in areas to comply with national standards. (FD) The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the Zoning Administrator may be required pursuant to the HBZSO. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. Coastal Development Permit No. 00-18 shall not become effective until the ten working day appeal period has elapsed. For projects in the appealable area of the coastal zone, there is an additional ten working day appeal period that commences when the California Coastal Commission receives the City's notification of final action. 2. Coastal Development Permit No. 00-18 shall become null and void unless exercised within one year of the date of final approval which is October 18, 2001 or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 00-18, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. All applicable fees from the Building, Public Works, and Fire Departments shall be paid prior to the issuance of Building Permits. 5. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. 6. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 7. An encroachment permit shall be required for all work within the right-of-way.
