HomeMy WebLinkAbout2001-01-090 William Gallegos, 208 A 5th Street, Huntington Beach CA 92648, spoke in opposition to rooftop entertainment, and stated that the noise level in the immediate area was already high and unacceptable. He also said that he and his wife have made several complaints to the Police Department, and that Police have done very little to assist. The Commission asked how many times Mr. Gallegos called the Police. Mr. Gallegos responded many, and also stated that the Police do not always respond quickly. The Commission asked Mr. Gallegos if he would be opposed to acoustic entertainment only and Mr. Gallegos replied that he is opposed to any Wind of music. Keith Bohr, applicant, 415 Townsquare Lane, #219, Huntington Beach CA 92648, spoke in favor of the item, strongly disagreeing with Mr. Gallegos' statement that the Police were not enforcing the law with regard to noise in that area. He provided information to the Commission on structural elements included in the proposal that would inhibit sound travel, including a 3' glass wall, and explained that the type of music planned for the restaurant would be background in nature, perhaps cable radio without commercials, and would not override the 20 foot audible sound requirement included in the conditions of approval. The Commission asked the applicant to elaborate on the 3' glass wall. Jeff Bergsma, Project Architect, approached the podium to explain the possibility of adding an additional foot in height to the proposed wall to further inhibit sound travel. THERE WERE NO OTHERS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Vice Chairperson Shomaker excused herself from further action on the item because she owns property near the proposed development and this poses a potential conflict of interest. The Commission inquired about historical elements with regard to the proposed architecture. Staff stated that the proposed Spanish Mediterranean architectural theme is consistent with the Downtown Design Guidelines. The Commission stated that conditions included within the Conditional Use and Entertainment Permits should be consistent. Staff explained the reasons for the separation of conditions. The Commission also suggested that a 6-month review period be added to the conditions of approval. A question was asked regarding the 50% reduction of the parking fee. Staff stated the costs associated with the in -lieu parking agreement was approved by the City Council in the early 1990's as part of an Owner Participation Agreement established by the Redevelopment Agency to help recycle property in the downtown. An encroachment permit shall be required for all work within the right-of-way. (PW) A Certificate of Occupancy must be issued by the Planning Department and Building and Safety Department prior to occupying the building. C.
