ZONING ADMINISTRATOR: Mary Beth Broeren STAFF MEMBER: Paul Da Veiga, Amy Wolfe, Ramona Kohlmann (recording secretary) MINUTES: None ORAL COMMUNICATION: None ITEM 1• ENTITLEMENT PLAN AMENDMENT NO.00-16 (WIRELESS COMMUNICATION FACILITY) APPLICANT: TACIT Communications, 3001 Redhill Avenue, Building 5, Suite 222, Costa Mesa, CA 92626 PROPERTY OWNER: Sparks Enterprises, P.O. Box 1477, Huntington Beach, CA 92647 REQUEST: An Entitlement Plan Amendment to relocate a previously approved monopalm to the westerly portion of the subject property fronting along Springdale Street, and to increase the height of the monopalm from 50 feet to 55 feet. LOCATION: 6034 Warner Avenue (southeast corner of Warner Avenue and Springdale Street) PROJECT PLANNER: Paul Da Veiga Paul Da Veiga, Staff Planner, displayed project plans and photographs stating the purpose, zoning and location of the request. Staff stated that they could not support the request because the Zoning and Subdivision Ordinance indicates that all commercial structures within 45 feet of a residential zone shall have a maximum height of 18 feet. The proposed monopalm would be approximately 20 feet from residential uses and approximately 50 feet from Springdale Street, which is a primary arterial. Staff research of existing monopalms revealed locations behind commercial uses that were not in public view contrary to the proposed project. Potential impacts were noted by staff such as a cable tray or structural support extending from a building to the existing monopalms and security devices such as chain link fences. Staff recommended denial of the request based upon the suggested findings as outlined in the staff report and recommended compliance with the original Conditional Use Permit (CUP). One telephone call was received from a resident of the neighboring mobile home park with general questions ® concerning the project. No other verbal or written comments were received in response to the public notification. ( THE PUBLIC HEARING WAS OPENED. Tom Sparks, P.O. Box 1477, property owner, stated that the originally approved CUP, with the approved use of a monopalm, was not discussed with him. Mr. Sparks stated that he is not in agreement with using a monopalm at the previously approved location because of the contrast with the 16' existing live palm trees on the property. He stated that live palm trees do not exist at the proposed location, therefore, the monopalm would not look out of place. Mr. Sparks responded to the suggested findings for denial and presented alternatives in order to meet findings for approval. 7ereme Brixey, 3001 Redhill Avenue, Building 5, Suite 22, Costa Mesa, applicant, presented alternative suggestions such as landscaping to screen the base, reducing the antenna to meet the zoning code, and eliminating the need for equipment at the base of the monopalm. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Mary Beth Broeren, Zoning Administrator, asked what the reason was for relocating the approved monopalm as setforth in the original CUP. Mr. Sparks stated that the original request was for a slimline monopole and not a monopalm as was revised and approved at the original CUP hearing. A detailed discussion ensued concerning alternative locations, structures and equipment. Ms. Broeren stated that she was going to continue the request and encouraged the applicant to seek alternative solutions. ENTITLEMENT PLAN AMENDMENT NO.00-16 WAS CONTINUED TO THE FEBRUARY 28, 2001 MEETING. THE MEETING WAS ADJOURNED AT 1:55 PM BY THE ZONING ADMINISTRATOR TO THE NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR ON WEDNESDAY, JANUARY 31, 2001 AT 1:30 PM.
