ITEM 1: CONDITIONAL USE PERMIT NO. 00-78 (MORRISSEY ADDITION)
APPLICANT: Robert Thornton, 250 Newport Center Drive, #M100, Newport Beach,
CA 92660

REQUEST: To permit a 604 sq. ft. single story addition to an existing residence with
a nonconforming 3 ft. side setback and allow the addition to maintain a
3 ft. side setback in lieu of the minimum 5 ft.
LOCATION: 708 11t' Street (east side of I Ph Street, north of Palm Avenue)
PROJECT PLANNER: Wayne Carvalho
Wayne Carvalho, Staff Planner, displayed project plans stating the purpose, location and zoning of the
request. Staff recommended approval of the request based upon the findings and subject to the
conditions as outlined in the staff report. The proposed project will not impact the privacy of the
adjacent neighbors and will be compatible with surrounding uses. One letter was received from a
neighboring property owner in support of the proposed project. No other written or verbal comments
were received in response to the public notification.
THE PUBLIC HEARING WAS OPENED.
Robert Thornton, 250 Newport Center Drive, #M100, Newport Beach, applicant, stated that
aesthetics was a primary concern for the proposed project.
Mark Morrissey, 708 11t' Street, property owner, stated that he has read and concurs with staff
suggested conditions of approval.

CONDITIONAL USE PERMIT NO.00-78 WAS APPROVED BY THE ZONING is
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN
TEN (10) CALENDAR DAYS.
FINDINGS FOR PROJECTS EXEMPT FROM CEOA:
The Zoning Administrator finds that the project will not have any significant effect on the environment
and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to
section 15301 of the CEQA Guidelines, because the project involves a minor addition to an existing
structure which will maintain the same setback as the existing residential building.
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 00-78:
Conditional Use Permit No. 00-78 to permit a 604 sq. ft. single story room addition to maintain a
three (3) ft. side setback as with the existing residence will not be detrimental to the general
welfare of persons working or residing in the vicinity or detrimental to the value of the property
and improvements in the neighborhood. Based upon the conditions imposed, the design and
location of the single story addition will not impact the privacy of the adjacent neighbors.
2. The conditional use permit will be compatible with surrounding uses. The addition is designed to •
be architecturally compatible with the existing residence. Furthermore, the addition is one story in
height and is adjacent to the open yard area of the residence next door.
3. The proposed Conditional Use Permit No. 00-78 will comply with the provisions of the base
district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and
Subdivision Ordinance and any specific condition required for the proposed use in the district in
which it would be located. The addition will comply with the existing three (3) ft. setback subject
to approval of this conditional use permit.
4. The granting of the conditional use permit will not adversely affect the General Plan. It is
consistent with the Land Use Element designation of Low Density Residential on the subject
property. In addition, it is consistent with the following goals and policies of the General Plan:
a. Require that single family residential units be designed to convey a high level of quality and
character. (LU 9.1.2)
b. Avoid building materials, colors, and construction elements that visually dominate their setting
and contrast significantly with the character of their neighborhood. (LU 9.1.2)
The proposed addition will consist of the same architecture, including compatible colors and
materials as the existing residence. The design of the structure is compatible with other residences
in the immediate area. •

CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO. 00-78:
is 1. The site plan, floor plans, and elevations received and dated December 18, 2000 shall be the
conceptually approved layout with the following modifications:
a. Depict all gas meters, water meters, electrical panels, air conditioning units, mailbox facilities
and similar items on the site plan and elevations. If located on a building, they shall be
architecturally designed into the building to appear as part of the building. They shall be
architecturally compatible with the building and non -obtrusive, not interfere with sidewalk
areas and comply with required setbacks.
b. If outdoor lighting is included, energy saving lamps shall be used. All outside lighting shall be
directed to prevent "spillage" onto adjacent properties and shall be shown on the site plan and
elevations.
2. Prior to submittal for building permits, zoning entitlement conditions of approval shall be printed
verbatim on all the working drawing sets used for issuance of building permits (architectural,
structural, electrical, mechanical and plumbing) and shall be referenced in the index.
3. Prior to issuance of building permits, the property owner shall dedicate 2.50 feet off of the rear of
the subject property adjacent to the alley to the City of Huntington Beach. (PW)
4. During construction, the following shall be adhered to:
® a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough
to prevent dust raised when leaving the site;
b. Wet down areas in the late morning and after work is completed for the day;
c. Use low sulfur fuel (.05%) by weight for construction equipment;
d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage
smog alerts);
e. Discontinue construction during second stage smog alerts.
f. Ensure clearly visible signs are posted on the perimeter of the site identifying the name and
phone number of a field supervisor to contact for information regarding the development and
any construction/ grading activity.
5. Prior to final building permit inspection and approval, the following shall be completed:
a. Compliance with all conditions of approval specified herein shall be accomplished and verified
by the Planning Department.
® b. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material,
shall be disposed of at an off -site facility equipped to handle them.

c. The existing Benjamina Ficus tree(s) located along the public alley shall be trimmed back to
avoid encroaching over the public right-of-way. In addition, all trash and debris, including •
dead leaves and landscaping outside of the existing rear block wall shall be removed.
6. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the site plan, elevations and floor
plans are proposed as a result of the plan check process. Building permits shall not be issued until
the Planning Director has reviewed and approved the proposed changes for conformance with the
intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are
of a substantial nature, an amendment to the original entitlement reviewed by the Zoning
Administrator may be required pursuant to the HBZSO.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
Conditional Use Permit No. 00-78 shall not become effective until the ten calendar day appeal
period has elapsed.
2. Conditional Use Permit No. 00-78 shall become null and void unless exercised within one year of
the date of final approval which is February 7, 2002 or such extension of time as may be granted
by the Director pursuant to a written request submitted to the Planning Department a minimum
30 days prior to the expiration date.
3. The Zoning Administrator reserves the right to revoke Conditional Use Permit No. 00-78,
pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington •
Beach Zoning and Subdivision Ordinance or Municipal Code occurs.
4. All applicable fees from the Building, Public Works, and Fire Departments shall be paid prior to
the issuance of Building Permits.
5. The development shall comply with all applicable provisions of the Municipal Code, Building
Department, and Fire Department as well as applicable local, State and Federal Fire Codes,
Ordinances, and standards, except as noted herein.
6. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be
prohibited Sundays and Federal holidays.
7. The applicant shall submit a check in the amount of $43.00 for the posting of the Notice of
Exemption at the County of Orange Clerk's Office. The check shall be made out to the County
of Orange and submitted to the Planning Department within two (2) days of the Zoning
Administrator's action.
8. All landscaping shall be maintained in a neat and clean manner, and in conformance with the
HBZSO. Prior to removing or replacing any landscaped areas, check with the Departments of
Planning and Public Works for Code requirements. Substantial changes may require approval by
the Zoning Administrator.
9. State -mandated school impact fees shall be paid prior to issuance of building permits. •

0 10. An encroachment permit shall be required for all work within the right-of-way. (PW)
ITEM 2: CONDITIONAL USE PERMIT NO. 01-01 (ANIMALZ "R" US CARE CENTER)
APPLICANT: Neil Boodman, 10212 Jon Day Drive, Huntington Beach, CA 92646
PROPERTY OWNER: Jodyne Roseman, General Partner, Pacific Plaza Shopping Center, 1741
Grand Avenue, Del Mar, CA 92014
REQUEST: To permit the establishment of an animal hospital within a vacant suite
of an existing commercial shopping center.
LOCATION: 8851 Adams Avenue (northwest corner of Magnolia Street and Adams
Avenue)

Sandra Thornton, Staff Planner, displayed project plans stating the purpose, location and zoning of the
request. Staff recommended approval of the request based upon the findings and subject to the
conditions as outlined in the staff report and because the project will comply with the Zoning and
Subdivision Ordinance. No written or verbal comments were received in response to the public
notification.

THERE WERE NO PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST
AND THE PUBLIC HEARING WAS CLOSED.
Mary Beth Broeren, Zoning Administrator, asked the applicant if they have ownership in any other
animal hospital in the City. Mr. Boodman stated that they do not. A general discussion ensued
concerning acoustical soundproofing.
CONDITIONAL USE PERMIT NO.01-01 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN
TEN (10) CALENDAR DAYS.

The Zoning Administrator finds that the project will not have any significant effect on the environment

section 15301 of the CEQA Guidelines, because the development proposal involves minor tenant
improvements to an existing private structure.
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 01-01:
• 1. Conditional Use Permit No. 01-01 for the establishment, maintenance and operation of the animal
hospital within a vacant suite of an existing commercial shopping center will not be detrimental to

the general welfare of persons working or residing in the vicinity or detrimental to the value of the
property and improvements in the neighborhood. The project will be buffered by adequate
setbacks from adjacent residential development to the west and north. 0
2. The conditional use permit will be compatible with surrounding uses because the use will be
conducted primarily within the building. In addition, the facility will be soundproofed to ensure
project compliance with the Huntington Beach Noise Ordinance.
The proposed Conditional Use Permit No. 01-01 will comply with the provisions of the base
district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and
Subdivision Ordinance and any specific condition required for the proposed use in the district in
which it would be located. The project is located within the Pacific Plaza Shopping Center and
will not affect the previously approved parking, landscaping, setbacks or building height.
4. The granting of the conditional use permit will not adversely affect the General Plan. It is
consistent with the Land Use Element designation of Commercial General on the subject property.
In addition, it is consistent with the following goal of the General Plan:
LU 11 — Achieve the development of projects that enable the residents to live in proximity to their
jobs, commercial services, and entertainment, and reduce the need for automobile use.
CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO. 01-01:
1. The site plan, and elevations received and dated January 3, 2001 shall be the conceptually
approved layout. The floor plans received and dated January 3, 2001 shall be modified to include .
soundproofing in order to ensure compliance with the Huntington Beach Noise Ordinance.
2. Prior to submittal for building permits, the following shall be completed:
a. Zoning entitlement conditions of approval shall be printed verbatim on all the working drawing
sets used for issuance of building permits (architectural, structural, electrical, mechanical and
plumbing) and shall be referenced in the index.
b. All Fire Department requirements shall be noted on the building plans. (FD)
3. The use shall comply with the following:
a. Automatic fire sprinkler and fire alarm systems shall be redesigned to comply with tenant
improvement. Shop drawings shall be submitted and approved by the Fire Department prior to
system installation. (FD)
b. Address numbers shall be installed to comply with City Specification 428. (FD)
c. Fire extinguishers shall be installed and located in areas to comply with HBFC standards found
in City Specification #424. (FD)

d. Any medical gas system must comply with Huntington Beach Fire Code (1997 Uniform Fire
Code) Article 74 "COMPRESSED GASES", Section 7404. Shop drawings shall be submitted
and approved by Building and Fire prior to system installation. (FD)
e. Temporary boarding of animals (maximum 30 days) is allowed only if incidental to the hospital
use. (Code Requirement)
f. The staff of the animal hospital shall clean up after the animals that are taken outside and all
landscaping and grounds shall be permanently maintained in a neat and clean manner.

8. All signs shall conform to the HBZSO. Prior to installing any new signs, or changing sign faces,
a building permit shall be obtained from the Planning Department.
9. Traffic Impact Fees shall be paid at the time of final inspection or issuance of a Certificate of Is
Occupancy. (PW)
10. State -mandated school impact fees shall be paid prior to issuance of building permits.
11. A Certificate of Occupancy must be issued by the Planning Department and Building and Safety
Department prior to occupying the building.
