ITEM 1: CONDITIONAL USE PERMIT NO. 01-38 (SHIN RESIDENCE)
APPLICANT/
PROPERTY OWNER: Shin Trust PT/Daniel Shin, 8628 E. Imperial Highway, Downey, CA
90242
• REQUEST: To: (a) permit the construction of an approximately 1,034 sq. ft third -
story addition and (b) allow the height of the dwelling to exceed 30 ft. —
permit a 34 ft. maximum building height.
LOCATION: 17242 Sandra Lee Street (northeast corner of Los Patos Avenue and
Sandra Lee Street)
PROJECT PLANNER: Amy Wolfe
Amy Wolfe, Staff Planner, displayed project plans and elevations stating the purpose, location and
zoning of the requested project. Staff stated that the proposed project will comply with the
Development Standards and General Plan.
Staff recommended approval of the request based upon the findings and subject to the conditions as
outlined in the staff report. One letter was received from Peter Clark, 17121 Sandra Lee Street,
neighboring property owner, expressing concerns regarding the proposed height. No'other written or
verbal comments were received in response to the public notification.
Mary Beth Broeren, Zoning Administrator, and staff discussed the windows and site coverage.
THE PUBLIC HEARING WAS OPENED.
Ted Dowding, 17192 Sandra Lee Lane, neighboring property owner, expressed opposition to any
zoning changes and to the third story addition.
® Ms. Broeren stated that a zoning change was not being considered and explained the purpose of the
meeting as well as the process for a conditional use permit.
Daniel Shin, 8628 E. Imperial Highway, Downey, applicant, stated that he spoke with his immediate •
neighbors concerning the proposed project and received no objections. Mr. Shin stated that he has
reviewed the conditions. He stated that he is contemplating reducing the square footage to below
5000 square feet in order to avoid having to install an automatic fire sprinkler and alarm system as
setforth in Condition No. 5.a.1.
Ms. Broeren and staff reviewed the plans and discussed options for reducing the total square footage.
Ms. Broeren confirmed with the applicant his understanding that any significant reduction in the total
square footage, resulting in substantial changes to the appearance, would require an amendment. She
advised the applicant that he would have to submit revised plans wherein staff can determine the best
course of action.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
CONDITIONAL USE PERMIT NO. 01-38 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN
TEN (10) CALENDAR DAYS.
FINDINGS FOR PROJECTS EXEMPT FROM CEQA: 0
The Zoning Administrator finds that the project will not have any significant effect on the environment
and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to
section 15301 of the CEQA Guidelines because minor alteration of an existing structure involving
negligible or no expansion of use beyond that previously existing requires no further environmental
review.
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 01-38:
Conditional Use Permit No. 01-38 for (a) the construction of an approximately 1,034 sq. ft third -
story addition and (b) to allow the height of the dwelling to exceed 30 ft. and permit a 34 ft.
maximum building height will not be detrimental to the general welfare of persons working or
residing in the vicinity or detrimental to the value of the property and improvements in the
neighborhood. The proposed addition will improve the appearance and value of the existing
dwelling while maintaining building design compatibility with the surrounding neighborhood.
2. The conditional use permit will be compatible with surrounding uses because the proposed
addition has been integrated into the design of the roof in a manner which will maintain the
appearance of two-story construction and ensure the privacy of adjoining properties.
3. The proposed conditional use permit will comply with the provisions of the base district and other
applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance •
and any specific condition required for the proposed use in the district in which it would be
located, including maximum height, site coverage and minimum setbacks.

4. The granting of the conditional use permit will not adversely affect the General Plan. It is
consistent with the Land Use Element designation of RL-7 (Residential Low -Density - 7 Dwelling
is Units/Acre) on the subject property. In addition, it is consistent with the following goals and
policies of the General Plan:
a. Require that all new residential development within existing residential neighborhoods be
compatible with existing structures, including the maintenance of privacy on abutting
residences. (LU 9.2.1. d)
b. Require that all structures be constructed in accordance with the requirements of the City's
building and other pertinent codes and regulations. (LU 4.2.1)
CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO. 01-38:
1. The site plan, floor plans, and elevations received and dated June 12, 2001 shall be the
conceptually approved layout with the following modification:
a. If outdoor lighting is included, energy saving lamps shall be used. All outside lighting shall be
directed to prevent "spillage" onto adjacent properties and shall be shown on the site plan and
elevations.
2. Prior to issuance of demolition permits, the following shall be completed:
a. The applicant shall follow all procedural requirements and regulations of the South Coast Air
is the
Management District (SCAQMD) and any other local, state, or federal law regarding
the removal and disposal of any hazardous material including asbestos, lead, and PCB's. These
requirements include but are not limited to: survey, identification of removal methods,
containment measures, use and treatment of water, proper truck hauling, disposal procedures,
and proper notification to any and all involved agencies.
b. Pursuant to the requirements of the South Coast Air Quality Management District, an asbestos
survey shall be completed.
c. The applicant shall complete all notification requirements of the South Coast Air Quality
Management District.
d. The City of Huntington Beach shall receive written verification from the South Coast Air
Quality Management District that the Notification procedures have been completed.
e. All asbestos shall be removed from all buildings prior to demolition of any portion of any
building.
f. A truck hauling and routing plan for all trucks involved in asbestos removal and demolition of
the existing structures shall be submitted to the Department of Public Works and approved by
the Director of Public Works.
® g. The applicant shall disclose the method of demolition on the demolition permit application for
review and approval by the Building and Safety Director.

3. Prior to submittal for building permits, the following shall be completed:
a. Zoning entitlement conditions of approval shall be printed verbatim on one of the first three
pages of all the working drawing sets used for issuance of building permits (architectural,
structural, electrical, mechanical and plumbing) and shall be referenced in the sheet index. The
minimum font size utilized for printed text shall be 12 point.
b. All Fire Department requirements shall be noted on the building plans. (FD)
4. During demolition, grading, site development, and/or construction, the following shall be adhered
to:
a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough
to prevent dust raised when leaving the site.
b. Wet down areas in the late morning and after work is completed for the day.
c. Use low sulfur fuel (.05%) by weight for construction equipment.
d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage
smog alerts).
e. Discontinue construction during second stage smog alerts.
f. Ensure clearly visible signs are posted on the perimeter of the site identifying the name and •
phone number of a field supervisor to contact for information regarding the development and
any construction/ grading activity.
5. The structure(s) final building permit(s) cannot be approved until the following has been
completed:
a. All improvements to the property shall be completed in accordance with the approved plans
and conditions of approval specified herein, including:
1) An automatic fire sprinkler and alarm system shall be installed throughout. Shop drawings
shall be submitted and approved by the Fire Department prior to system installation. (FD)
2) Submit a Fire Protection Plan in compliance with City Specification 426 for Fire
Department approval. (FD)
3) Address numbers will be installed to comply with Fire Dept. City Specification No. 428.

b. The existing domestic water service and meter shall be abandoned per Water Division
standards. (PW)

c. A separate backflow protection device shall be installed, per Water Division standards, and
sized to meet the minimum requirements set by the California Plumbing Code and Uniform Fire
Code. The water service shall be a minimum 1-inch in size. (PW)
d. A 36-inch box tree shall be installed in the front yard. (PW)
6. The applicant shall obtain the necessary permits from the South Coast Air Quality Management
District and submit a copy to Planning Department.
7. Compliance with all conditions of approval specified herein shall be accomplished and verified by
the Planning Department.
8. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material,
shall be disposed of at an off -site facility equipped to handle them.
9. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the site plan, elevations and floor
plans are proposed as a result of the plan check process. Building permits shall not be issued until
the Planning Director has reviewed and approved the proposed changes for conformance with the
intent of the Planning Commission's action and the conditions herein. If the proposed changes are
of a substantial nature, an amendment to the original entitlement reviewed by the Planning
Commission may be required pursuant to the Huntington Beach Zoning and Subdivision
Ordinance.
® 10. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all
plans and information submitted to the City for review and approval.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
Conditional Use Permit No. 01-38 shall not become effective until the ten -calendar day appeal
period has elapsed.
2. Conditional Use Permit No. 01-38 shall become null and void unless exercised within one year of
the date of final approval or such extension of time as may be granted by the Director pursuant to
a written request submitted to the Planning Department a minimum 30 days prior to the
expiration date.
3. The Zoning Administrator reserves the right to revoke Conditional Use Permit No. 01-38,
pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington
Beach Zoning and Subdivision Ordinance or Municipal Code occurs.
4. All applicable fees from the Building, Public Works, and Fire Departments shall be paid prior to
the issuance of Building Permits.
5. The development shall comply with all applicable provisions of the Municipal Code, Building
Department, and Fire Department as well as applicable local, State and Federal Fire Codes,
Ordinances, and standards, except as noted herein.

6. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be
prohibited Sundays and Federal holidays. 0
7. The applicant shall submit a check in the amount of $43.00 for the posting of the Notice of
Exemption at the County of Orange Cleric's Office. The check shall be made out to the County
of Orange and submitted to the Planning Department within two (2) days of the Zoning
Administrator's action.
8. Traffic Impact Fees shall be paid at the time of final inspection or issuance of a Certificate of
Occupancy. (PW)
9. An encroachment permit shall be required for all work within the right-of-way. (PW)
NON-PUBLIC ITEM:
ITEM 2 RECONSIDERATION OF CONDITIONAL USE PERMIT NO.01-35 (DI PAOLO
FENCE
APPLICANT/
PROPERTY OWNER: David Di Paolo, 15461 Shasta Lane, Huntington Beach, CA 92647
REQUEST: To construct a 6-ft. 8-in., in lieu of the 3-ft. 6-in., high masonry fence
within the front yard setback area, and allow it to encroach into the
required vision clearance triangle at a driveway/street intersection. •
LOCATION: 15461 Shasta Lane (west side of Shasta Lane at intersection of
McFadden Avenue and the 405 Freeway)
PROJECT PLANNER: Ron Santos
Ron Santos, Staff Planner, stated that the Zoning Administrator initially reviewed the item on July 18,
2001, and the applicant has requested a hearing for reconsideration. Staff recommended that the item
be scheduled for the August 15, 2001 Zoning Administrator meeting.
AS THIS IS A NON-PUBLIC ITEM, THE PUBLIC HEARING WAS NOT OPENED.
RECONSIDERATION OF CONDITIONAL USE PERMIT NO. 01-35 WAS APPROVED BY
THE ZONING ADMINISTRATOR.
THE MEETING WAS ADJOURNED AT 1:45 PM BY THE ZONING ADMINISTRATOR TO
THE NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR
