Mayor Cook called the Special Meeting of the City Council of the City of Huntington Beach to
order at 3:11 p.m. in the Council Chambers.
Call to Order

Councilmember Shirley Dettloff has requested permission to be absent from the Special
Meeting.
Present: Garofalo, Cook, Houchen, Green, Boardman (Bauer arrived 3:11 p.m.)

You are hereby notified that a Special Meeting of the City Council of the City of Huntington
Beach, California, is called for and will be held at City Hall, 2000 Main Street, Huntington Beach,
California 92648 in the Lower Level, Council Chambers at the hour of 3.00 p.m., Thursday,
December 13, 2001. The meeting is for the purpose of considering the following:
Please take notice that the Honorable Debbie Cook, Mayor of the City of Huntington Beach has
called a Special Meeting of the City Council of the City of Huntington Beach to consider in
Closed Session, pursuant to Govemment Code §54957.1(a), a report of the December 10, 2001

Superior Court action in the case of Blackford v. Brockway, et al., Orange County Superior
Court Case No. 01 CC15111.
The City Council shall also determine a course of action in response to the Court's December
10, 2001 order, including but not limited to whether to seek appellate review of the order and
how to revise the March 5, 2002 utility tax ballot questions in response to the Court's order.
Pursuant to Government Code §54957.1(a), Council shall reconvene in Open Session to report
any action taken.
Public Comments (Restricted to Special Meeting Agenda Item Only)
Chuck Schied requested a copy of the December 10, 2001 report referenced in the Call for
Special Meeting notice.
City Attorney Hutton responded that the report referenced in the notice is to be her oral report to
be made in closed session.
The City Attorney informed Council that the date in the Call for Special Meeting notice should
have read December 12, 2001.
Motion to Recess to Closed Session — Approved
A motion was made by Garofalo, second Green to recess to Closed Session (restricted to the
item listed in the Call for Special Meeting notice). The motion carried by the following roll call
vote:
AYES: Garofalo, Bauer, Cook, Houchen, Green, Boardman,
NOES: None
ABSENT: Dettloff
(City Council) Closed Session — Pursuant to Government Code Section 54956.9(a) to confer
with its attorney regarding pending litigation which has been initiated formally and to which the
city is a party. The title of the litigation is Ed Blackford v. Connie Brockway, Orange County
Superior Court Case No. 01CC15111. Subject: Ed Blackford v. Connie Brockway. (120.80)
Reconvened (with Green and Dettloff Absent) in the Council Chambers - 3:45 P. M.
Announcement Made by City Attorney of Action Taken in Closed Session Pursuant to
Government Code Section 54957.1 at the December 13, 2001 City Council Closed
Session to Discuss the Matter of Ed Blackford v. Connie Brockway (120.80)
City Attorney Gail Hutton announced that the City Council convened in Closed Session on
Thursday, December 13, 2001 to discuss the matter of Ed Blackford v. Connie Brockway,
Orange County Superior Court'Case No. 01CC15111. The City Council voted unanimously,
with Dettloff absent, to file an appeal to the court order modifying the utility tax ballot arguments
and ballot statement.
