PUBLIC HEARING ITEMS B-1. 20NING MAP AMENDMENT NO. 01 -03 (GENERAL PLAN CONSISTENCY RODGERS SENIOR CENTEft, Applicant: City of Huntington Beach Request: To rezone the Rodgers Senior Center from OS -PR (Open Space — Park and Recreation) to PS (Publio-Semipublic) to make the zoning designation consistent with the current General Plan land use designation of Public. Location: 1706 Orange Avenue (northwest comer of 17'h Street and Orange Avenue) Project Planner: Kicky Ramos Zoning Map Amendment No. 01-03 request: - City initiated request to rezone the Rodgers Senior Center from OS -PR (Open Space — Park and Recreation) to PS (Public -Semipublic) to conform to the existing General Plan designation of P(RMH-25-d) (Public with underlying designation of Residential Medium High Density). Continued Item: November 13,2001 Meeting — Planning Commission continued this item to the November 27, 2001 study session to review the General Plan goals, future development plans, and any deed restrictions on the site. At the study session Ron Hagan, Director,of Community Services, provided an update on future development plans for the'center as well as the deed restriction (Attachment No. 5). Staffs Recommendation: Approve Zoning Map Amendment No. 01-03 for Subarea D with findings and forward it to the City Council based upon the following: - It will bring the subject property into conformance with the existing General Plan designation and is consistent with City Council direction resulting from the 1996 General Plan update. - The proposed zoning designation is a more accurate reflection of the actual use of the site. - Approval of the request will not have any adverse environmental impacts. Zoning Map Amendment No. 01-03 is within the scope of the previously certified EIR No. 94-1 for the comprehensive General Plan update. - This action is consistent with goals, objectives, and policies of the General Plan because it supports development in accordance with the Land Use Plan Map. It will also further goals, objectives, and policies that pertain to achievement and maintenance of a variety of land uses that support the recreational, religious, governmental, and human services needs of residents and businesses in Huntington Beach. Staff made a presentation to the Commission. THE PUBUC HEARING WAS OPENED: Mike Olafson, 18th Street, requested that the Commission guarantee the Senior Center property will not be sold, and will stay as open space and not be (02P=0123) PC Minutes January 23, 2002 Page 3 developed as residential. He also voiced his approval of plans to remodel the Center. Sally Olafson, 18th Street, discussed future options to protect the Senior Center property from being rezoned. WITH NO ONE ELSE PRESENT, THE PUBLIC HEARING WAS CLOSED. The Commission stated the City only plans to renovate and remodel the Rodgers Senior Center property and has no intention of selling it. Staff explained the underlying designation related to the General Plan. A MOTION WAS MADE BY LIVENGOOD, SECOND BY KERINS, TO APPROVE ZONING MAP AMENDMENT NO. 01-03 FOR SUBAREA "D" WITH FINDINGS BY APPROVING THE DRAFT ORDINANCE AND FORWARDING TO THE CITY COUNCIL FOR ADOPTION BY THE FOLLOWING VOTE: AYES: Mandic, Kerins, Shomaker, Livengood, Borden NOES: None ABSENT: Hardy, Kokal ABSTAIN: None MOTION PASSED A MOTION WAS MADE BY MANDIC, SECOND BY KERINS, TO FORWARD MINUTE ACTION TO THE CITY COUNCIL REQUESTING THAT THE CITY COUNCIL RE-RECORD THE DEED RESTRICTION ON THE RODGERS SENIOR CENTER PROPERTY WHICH LIMITS THE USE OF THE LAND TO RECREATIONAL- PURPOSES ONLY, BY THE FOLLOWING VOTE: AYES: Mandic, Kerins, Shornaker, Livengood, Borden NOES: None ABSE14T: Hardy', Ko'kal ABSTAIN: None MOTION PASSED FINDINGS FOR APPROVAL - ZONING MAP AMENDMENT NO. 01-03 SUBAREA D Zoning Map Amendment No. 01-03 to change the zoning on the + 2 acre Rodgers Senior Center from OS -PR to PS (Public -Semipublic) to conform to the existing General Plan designation of P(RMH-25-d) (Public with underlying designation of Residential Medium High Density) is consistent with the objectives, policies, general land uses and programs specified in the General Plan. The Zoning Map Amendment would bring the zoning into conformance with the General Plan. This action is consistent with goals, policies, and objectives of the General Plan because it supports (02pem0123) PC Minutes January 23, 2002 Page 4 development in accordance with the land uses depicted in the Land Use Plan Map. It will also further goals, policies, and objectives that pertain to achievement and maintenance of a variety of land uses that support the recreational, religious, governmental, and human services needs of residents and businesses in Huntington Beach. - 2. - In the case of a general land use provision, the zoning map amendment is compatible with the uses authorized in and the standards prescribed for the zoning district for which it is proposed. This amendment would change the land use designation rather than a general land use provision. Future development will be compatible with the development standards. 3. A community need is demonstrated for the change proposed. With the adoption of the General Plan in 1996, the community as a whole determined a need to modify land use designations to accurately reflect the use on a property. . The Zoning Map Amendment will allow the zoning designation on the subject property to conform to - the General Plan. It will also permit the existing use on the subject site to continue to provide 'services, which have been offered to the community. 4. Its adoption will be in conformity with public convenience, general welfare and good zoning practice. The subject site is presently designated on the General Plan; the proposed rezoning action Vill bring tKe site into conformity with the current General Plan designation. 5. The Planning Commission finds that Zoning Map Amendment No. 01 -03 is covered within the scope of Environmental Impact Report No. 94-1 prepared for the 1996 General Plan update which was certified by the City Council on May 13,' 1996 and that no further environmental review is required. B-2. CONDITIONAL USE PERMIT NO.-643 (dAILIFOONKIMOCOTS AUTO SALES LOT): Applicant: David Mahgerefteh Request: To establish a used auto sales business including'the occupancy of a 960 sq. ft. office unit and display area for up to ten (10) vehicles at an existing comm - e . rcial office complex. Location: 17301 Beach Boulevard, Unit 1 (west side, north of Slater Avenue) Proiect Planner: Wayne Carvalho Conditional Use Permit No. 01-43 request: Establish an auto sales lot consisting of a display area for up to 10 vehicles and occupancy of a 960 sq. ft.- suite at an existin g commercial office complex. Staffs Recommendation: Approve Conditional Use Permit No, 01-43 based upon the following: Ample parking will be provided on -site. Auto sales use is compatible with adjacent auto dealerships. Business will not be detrimental to other office and retail uses in complex. (02PUW123) PC Minutes January 23, 2002 Page 5 Commissioners Mandic, Kerins, Shomaker, Livengood and Borden all disclosed that they had spoken with the applicant and visited the project site. Staff made a presentation to the Commission. Questions and comments included: Will the landscaping on Beach Boulevard in front of the vehicle display area be improved with this request? Staff explained that a landscape plan is included in the conditions of approval. Discussion ensued regarding the construction, width and irrigation plans of the landscape planter. THE PUBLIC HEARING WAS OPENED. David Mahgerefteh, applicant and owner of Cal Imports, spoke in favor of the item. Mr. Mahgerefteh stated that he has owned the property for over five (5) years and will work with staff to comply with all conditions of approval. The Commission asked if additional parking spaces were necessary for vehicle display. Mr. Mahgerefteh explained how the vehicles are displayed. The Commission inquired about the hours of operation.' David Page, Beach Boulevard, spoke in favor of the item. Mr. Page has three commercial units at the same location and described Cal Imports as a good tenant with a steady and clean business environment. WITH NO ONE ELSE PRESENT TO SPEAK, THE PUBLIC HEARING WAS CLOSED. The Commission voiced concerns regarding the zoning code landscaping requirements on Beach Boulevard. Staff 'explained that the conditions apply to new construction or major remodels only. The Commission asked if - the' applic ant is allowed to display more than ten (10) cars. Staff replied yes, and further explained that the number is based on the square footage of the display area. Staff stated that the applicant could be allowed to display -up to fifteen (15) vehicles in the designated display area. (02p=0123) PC Minutes January 23, 2002 Page 6 A MOTION WAS MADE BY LIVENGOOD, SECOND BY MANDIC, TO APPROVE CONDITIONAL USE PERMIT NO. 01-43 WITH FINDINGS AND MODIFIED CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: AYES: Mandic, Kerins, Shomaker, Livengood, Borden NOES: None ABSENT: Hardy, Kokal ABSTAIN: None MOTION PASSED FINDINGS AND CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 01-43 FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 01-43: Conditional Use Permit No. 01-43 for the establishment, maintenance and operation of the vehicle sales lot including occupancy of an existing 960 sq. fL office suite and 2,500 sq. ft. outdoor display area will not be detrimental to the general welfare of persons working or residing' in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The removal of ten parking spaces for display of vehicles will not result in a parking'shorifall for the office complex.- Based on the conditions imposed, the use will not be detrimental to the existing tenants in the center. 2. The conditional use permit will be compatible with abutting auto sales In addition, the auto sales lot will be compatible with the businesses. existing office and retail businesses -on site. The location of the sales office and display.area along Beach Boulevard will minimize any impacts to the existing businesses on site. 3. The_ proposed vehicle sales lot will comply with,the provisions of the base district and other applipabI6 p , rovisifons in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance. The vehicle sales'lot in conjunction with an existing office complex will be provided with ample parking in compliance with the, City's parking requirements. 4. The granting of the'condifional use permit will not adversely affect the implementation of the General Plan goals and policies. The project is consistent with the Land Use Element designation of CG-F1 on the subject property and Subarea 6G and the following policies of the General Plan: Policy LU 4.2.4 Require that all development be designed to provide adequate space for access, parking, supporting functions, open space, and other pertinent elements. (02pomOI23) PC Minutes January 23, 2002 Page 7 Policy LU 10.1.12 Require that Commercial General uses by designed and developed to achieve -a high level of quality, distinctive character, and compatibility with existing uses and development. The proposed auto sales business will be provided with ample on site parking and will not impact the existing office complex. The auto sales lot is designed to be compatible with the adjacent auto dealerships to the north and south of the project site. The restrictions on the display area will minimize impacts to the office and retail tenants who share the site. CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO. 01-43: 1. The site plan received and dated July 10, 2001 shall be the conceptually approved layout. 2.- Within 30 days from the date of this approval, the following shall be completed: a. A revised Certificate of Occupancy shall be obtained from the Department of Building and Safety. b. Landscaping shall be provided within the existing landscape planter adjacent to the vehicle display area and Beach Boulevard. The landscaping shall be reviewed and approved by the Citys Landscape Architect and Planning Department prior to installation. c. Address numbers shall be installed on structures to comply with Fire Dept. City Specification 428. (FD) d. Fire access roads shall be provided in compliance with Fire Dept, City Specification 401. Include the Circulation Plan and dimensions of all access roads. (FD) e. Fire lanes shall be designated and posted to comply with Fire Dept. City Specification No. 415. (FD) f. - Fire extinguishers shall be installed and located in areas to comply with Huntington Beach Fire Code Standards found in City Specification No. 424. (FD) g. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Planning Department. 3. The use shall comply with the following: a. A maximum of 15 vehicles may be displayed in the parking area between Beach Boulevard and the north building. Vehicle display in other areas of the site is prohibited. (02POM01 23) PC Minutes January 23, 2002 Page 8 b. -, Due to the proximity of residential units to the west, there shall be no exterior audible public address or employee paging system. c. There shall be no outside storage of inoperable vehicles or vehicle parts. d. No repair work shall be conducted in conjunction with this business. e. Hours of operation shall be limited to between 9:00 AM and 8:00 PM daily. 4. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the Planning Commission's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the Planning Commission may be required pursuant to the Huntington Beach Zoning and Subdivision Ordinance. 5. The applicant and/or applicants representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. INFORMATION ON SPECIFIC CODE REQUIREMENTS: Conditional Use Permit No. 01-43 shall not become effective until the ten - calendar day appeal period has elapsed. 2. Conditional Use Permit No. 0143 shall become null and void unless exercised within one year of the date of final approval, which is November 13, 2002, or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 3. The Planning Commission reserves the right to revoke Conditional Use Permit No. 01-43 pursuant to a public hearing for revocabon,-if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. The development shall comply with all applicable provisions of the Municipal Code, Building Division, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. 5. All applicable fees from the Building, Public Works, and Fire Departments shall be paid prior to the issuance of Building Permits. 6. The applicant shall submit a check in the amount of $43.00 for the posting of the Notice of Exemption at the County of Orange Clerks Office. The check (0:21�123) PC Minutes January 23, 2002 Page 9 shall be made out to the County of Orange and submitted to the Planning Department within two (2) days of the Planning Commission's action. 7. All landscaping shall be maintained in a neat and clean manner, and in conformance with the HBZSO. Prior to removing or replacing any landscaped areas, check with the Departments of Planning and Public Works for Code requirements. Substantial changes may require approval by the Planning Commission. 8.1 All permanent, temporary, or promotional signs shall conform to Chapter 233 of the HBZSO. Prior to installing any new signs, changing sign' faces, or installing promotional signs, applicable permit(s) shall be obtained from the Planning Department. Violations of this ordinance requirement may result in permit revocation, recovery of code enforcement costs, and removal of installed signs. C. CONSENT CALENDAR C-1. Commissioner Kerins — Inquired about the Specific Plan's concept of a Transportation Center not being included in recent documentation received by the Commission relating to the 31 Acres/Pacific City Development. He suggested the Commission discuss this at the annual workshop scheduled in February. He also complimented staff s comments relati ing to the Brightwater Development Project Environmental Impact Report. Commissioner Hard — None. Commissioner Livengood — Inquired about public notification requirements for Smart & Final's request for exterior modifications at 6872 Edinger. Staff explained -that this request will be presented to the Design Review Board and does not generally require public notification. Commissioner Kokal — None. Commissioner Borden — Inquired about staff's recomme ' ndation for a "reverse layout' plan for an applicant to construct a service station at the northeast comer of Beach Boulevard and Warner Avenue.
