ITEM 1: VARIANCE 01-18 (MASTERSON RESIDENCE)
APPLICANT: Karen Otis, 16871 Sea Witch Lane, Huntington Beach, CA 92649
PROPERTY OWNER: Bruce Masterson, 16256 Tisbury Circle, Huntington Beach, CA 92649
® REQUEST: Variance to: (a) construct an approximately 53 sq. ft. garage addition
and 53 sq. ft. 2nd story deck addition at a 7-ft. 1-in. front yard setback,
in lieu of 20 ft. and 15 ft., respectively; and (b) to allow 54% lot
coverage in lieu of the existing 53%.
LOCATION: Location: 16256 Tisbury Circle (Huntington Harbor, north side of
Tisbury Circle, west of Mistral Drive)
PROJECT PLANNER: Ron Santos
Ron Santos, Staff Planner, displayed project plans and photographs stating the purpose, location and
zoning of the requested project. Staff presented a review of the suggested findings and recommended
a denial of the proposed project based upon the suggested findings for denial as outlined in the staff
report. No written or verbal comments were received in response to the public notification.
Mary Beth Broeren, Zoning Administrator, confirmed that approval has been received from the
homeowner's association. Ms. Broeren reviewed the plans and dimensions with staff.
THE PUBLIC HEARING WAS OPENED.
Karen Otis, 16871 Sea Witch Lane, applicant, approached the plans and explained that a carport does
not currently exist at the proposed site. She stated that their intent is to gain additional parking and
garage space.
J. S. Wayne, Huntington Harbour Property Owners' Association (HOA), stated that they have
reviewed and approved the proposed project. •
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Ms. Broeren stated that she did visit the site and observed the traffic movement. Ms. Broeren
expressed her concern for vehicular turns because of the cul-de-sac and obstruction of visibility caused
by any vehicular overhang. A general discussion ensued concerning the possibility of remodeling the
structure, and the applicant suggested relocating the landscaping. Ms. Broeren stated that site
coverage is not an issue, but that the concern is for the overhang on to the sidewalk and difficulty of
maneuvering into the parking space.
Ms. Broeren stated that she was inclined to deny the request. She stated that she was willing to
continue the item if the applicant could demonstrate a viable turning radius. The applicant agreed to a
two -week continuance.
VARIANCE NO. 01-18 WAS CONTINUED TO THE MARCH 27, 2002, MEETING WITH
THE PUBLIC HEARING CLOSED.
ITEM 2: CONDITIONAL USE PERMIT NO 01-72NARIANCE NO. 02-02 (SHAPIRO
RESIDENCE) .
APPLICANT: Karen Otis, 16871 Sea Witch Lane, Huntington Beach, CA 92649
PROPERTY OWNER: Patty and Len Shapiro, 4071 Figaro Circle, Huntington Beach, CA
92649
REQUEST: CUP: (a) to construct a 47 sq. ft. I" floor addition to an existing
single-family dwelling with an existing non -conforming side yard
setback of 4-ft. 7-in. in lieu of 5 ft.; (b) to construct 3`d floor additions
totaling approximately 238 sq. ft. at an approximate overall height of 32
ft.; and (c) to allow habitable floor area above the 2nd story top plate
line. VAR: to allow habitable floor area above the 2nd story top plate
line not within the confines of the roof volume.
LOCATION: 4071 Figaro Circle (Huntington Harbor, north side of Figaro Circle,
west of Edgewater Lane)
PROJECT PLANNER: Ron Santos
Ron Santos, Staff Planner, displayed project plans, elevations and photographs stating the purpose,
location and zoning of the requested project. Staff stated that they do not support the variance,
however, there is no objection to the conditional use permit. Staff recommended denial of the request
based upon the suggested findings for denial as outlined in the staff report. Staff supports the request
if the applicant were to revise the habitable area of the third -floor addition. Staff stated that no written
or verbal comments were received in response to the public notification. •

Mary Beth Broeren, Zoning Administrator, reviewed the plans and photographs with staff, and
• confirmed with staff that the homeowners' association has approved the proposed project.
THE PUBLIC HEARING WAS OPENED.
Karen Otis, 16871 Sea Witch Lane, applicant, spoke in favor of the proposed project. Ms. Otis
explained the intent of the proposed project stating that it is not construction of a new third story. She
presented a model of the proposed project and stated that the third floor addition will not change the
existing roof peak. She demonstrated the aesthetics of the exterior improvements in order to conform
to code.
Ms. Broeren asked J. S. Wayne, Huntington Harbour Property Owners' Association (HOA), what the
HOA's position has been with similar projects in the past. Mr. Wayne stated that they have not
opposed existing non -conforming projects. He explained that it is not their position to require
homeowners to tear down existing structures to conform to City code.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Ms. Broeren stated that she visited the site and observed the existing third story. She reviewed the
plans and photographs and engaged in a discussion with staff and the applicant concerning the
requirement for the setback on the deck and the planter design. Ms. Broeren confirmed with the
applicant that the existing roof would not be removed or altered.
Is Ms. Broeren stated that she understands staff s recommendation for denial explaining the purpose of
the code and requirements for consistency with any new developments. She stated that in this case a
third story already exists and changes are not being proposed that would affect the highest point of the
roof area. Ms. Broeren stated that the modifications are relatively minor and are an improvement to
the aesthetics of the home especially the rear elevation.
Ms. Broeren stated that she would approve the request and suggested a continuance to allow staff
adequate time to draft conditions of approval. The applicant agreed to a one -week continuance.
CONDITIONAL USE PERMIT NO. 01-72NARIANCE NO. 02-02 WERE CONTINUED TO
THE MARCH 20, 2002, MEETING WITH THE PUBLIC HEARING CLOSED.
THE MEETING WAS ADJOURNED AT 2:20 PM BY THE ZONING ADMINISTRATOR TO
THE NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR
