ZONING ADMINISTRATOR: Mary Beth Broeren STAFF MEMBER: Ron Santos, Paul Da Veiga, Ramona Kohlmann (recording secretary) MINUTES: May 22 and 29, 2002 APPROVED AS SUBMITTED ORAL COMMUNICATION: NONE ITEM 1: CONDITIONAL USE PERMIT NO. 01-59 (SIMONS FENCE) ® APPLICANT/ PROPERTY OWNER: Claire G. Simons, 10331 Kamuela Drive, Huntington Beach, CA 92646 REQUEST: To permit a six-foot eight -inch high block wall in lieu of a maximum six feet along the rear property line of an existing single-family residential parcel. LOCATION: 10331 Kamuela Drive (north side of Kamuela Drive, west of Fiji Avenue) PROJECT PLANNER: Ron Santos Ron Santos, Staff Planner, stated that the applicant has requested a continuance to the June 19, 2002 meeting in order to accommodate the applicant's vacation plans. Mary Beth Broeren, Zoning Administrator, confirmed with staff that no written or verbal comments were received in response to the public notification. AS THERE WERE NO PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST, THE PUBLIC HEARING WAS NOT OPENED. CONDITIONAL USE PERMIT NO. 01-59 WAS CONTINUED TO THE JUNE 19, 2002 MEETING WITH THE PUBLIC HEARING OPEN. • ITEM 2: CONDITIONAL USE PERMIT NO 01-32 (TEEN DRIVING ACADEMY APPLICANT: Victor Guerra, 15871 Gothard Street, Huntington Beach, CA 92674 PROPERTY OWNER: Emily H.M. Kuo Lee, 5848 Edinger Avenue, Huntington Beach, CA 92649 REQUEST: To permit the operation of an existing 1,300 sq. ft. driving school within a 15,178 sq. ft. shopping center. The request includes a reduced parking request for the driving school to allow a nine -space reduction in required parking. LOCATION: 15871 Gothard Street (west side of Gothard Street, north of Edinger Avenue) PROJECT PLANNER: Ron Santos Ron Santos, Staff Planner, displayed project plans and photographs stating the purpose, location and zoning of the requested project. Staff presented a review of the suggested findings and conditions of approval as well as a parking survey and a table of existing uses as submitted by the applicant. Staff presented documents received in support of the request. Staff recommended approval of the request based upon the findings and subject to the conditions as outlined in the staff report. Staff stated that there is no record of code violations and no written or • verbal comments were received in opposition to the request. Mary Beth Broeren, Zoning Administrator, asked what the hours of operation would be. Staff stated that the intended hours of operation will be Monday through Friday 9:00 AM to 6:00 PM, Saturday 9:00 AM to 4:00 PM and closed on Sunday. Ms. Broeren advised that the traffic study, as submitted by the applicant, was inadequate. She stated that because the traffic study was conducted during the December 30, 31 and January 1 holidays it could not be a good representation of traffic given the fact that people are on holiday and the adjoining businesses are closed. THE PUBLIC HEARING WAS OPENED. Corrie Kates, Foothill Project Management, 117-1/2 28`" Street, Newport Beach, representing the applicant, stated that they have read, accept and will comply with the conditions of approval. Martin C. Springfield, 15861 Gothard, adjacent business owner, spoke in support of the proposed project stating that there is adequate parking. Josette Springfield, 15861 Gothard, adjacent business owner, spoke in support of the proposed project stating that parking has not been a problem. 9 ZA Minutes 06/05/02 2 (02zm0605) Victor Guerra, 15871 Gothard, applicant, spoke in support of the proposed project emphasizing the ® fact that because the students will be dropped off/picked up, cars will not be waiting for students during the five hours of instruction. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Ms. Broeren stated that due to the unique nature of the business, the requested reduction in required parking is not an issue. CONDITIONAL USE PERMIT NO. 01-32 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. SHE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR PROJECTS EXEMPT FROM CEQA: The Zoning Administrator finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to section 15301 of the CEQA Guidelines. The project consists of the operation of a commercial use in an existing commercial building, involving negligible or no expansion of use beyond that previously existing. ® FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO.01-32: 0 Conditional Use Permit No. 01-32 for the establishment, maintenance and operation of the proposed 1,300 sq. ft. driving school, and to allow a nine space reduction in required parking at an existing 15,178 shopping center, will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of property and improvements in the neighborhood. The proposed driving school will not generate a demand for parking spaces beyond the number available on -site, since students of the driving school are typically not licensed drivers. The school will not generate significant volumes of traffic, noise, odors or other detrimental impacts. 2. The conditional use permit will be compatible with surrounding uses. The proposed driving school will be established in an existing commercial center, surrounded by other commercial uses of similar nature and intensity, including retail and restaurant uses. The proposed Conditional Use Permit No. 01-32 will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located, excepting the request to allow a reduction in required parking. The proposed driving school is a permitted use in the CG (Commercial General) base district. No new construction or site modifications are proposed. ZA Minutes 06/05/02 3 (02=0605) 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Commercial General on the subject property. In addition, it is consistent with the following goals and policies of the General Plan: a. Provide for the continuation of existing and the development of a diversity of retail and service commercial uses that are oriented to the needs of local residents, serve the surrounding region, and capitalize on Huntington Beach's recreational resources (LU 10.1) b. Encourage the expansion of the range of goods and services provided in Huntington Beach to accommodate the needs of all residents in Huntington Beach and the market area (ED 2.4.3) The proposed driving school will service local residents and residents in the surrounding region, thereby expanding the service -based commercial opportunities in the City. It will be located in an existing retail shopping center, which includes other service uses. CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO. 01-32: The site plan, floor plans, and elevations received and dated May 10, 2002 shall be the conceptually approved layout. 2. Prior to issuance of a new or amended Certificate of Occupancy, the following shall be completed: a. Address numbers shall be installed on structures to comply with Fire Dept. City Specification 428. (FD) b. Fire extinguishers shall be installed and located in areas to comply with Huntington Beach Fire • Code Standards found in City Specification #424. (FD) c. Exit signs and exit path markings will be provided in compliance with the Huntington Beach Fire Code and Title 24 of the California Administrative Code. (FD) d. The facility shall provide restrooms for each sex when classified as an assembly use or retail use. Refer to Uniform Plumbing Code Chapter 4 and Table 4-1 for required facilities. The applicant shall demonstrate compliance with all applicable restroom facility requirements, to the satisfaction of the Department of Building and Safety. (B&S) e. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Planning Department. 3. The use shall comply with the following: a. The classroom use shall be limited to the area indicated on the floor plan received and dated May 10, 2002. b. A maximum of 25 students shall be permitted per class. c. The classroom use shall be limited to driving instruction. 4. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. • ZA Minutes 06/05/02 4 (02zm0605) INFORMATION ON SPECIFIC CODE REOUIREMENTS: 1. Conditional Use Permit No. 01-32 shall not become effective until the ten calendar day appeal period has elapsed. 2. Conditional Use Permit No. 01-32 shall become null and void unless exercised within one year of the date of final approval which is June 5, 2003 or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 3. The Zoning Administrator reserves the right to revoke Conditional Use Permit No. 01-32, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. The use shall comply with all applicable provisions of the Municipal Code, Building Division, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. 5. The applicant shall submit a check in the amount of $43.00 for the posting of the Notice of Exemption at the County of Orange Clerk's Office. The check shall be made out to the County of Orange and submitted to the Planning Department within two (2) days of the Zoning Administrator's action. 6. A new or amended Certificate of Occupancy must be approved by the Planning Department and issued by the Building and Safety Department prior to commencement of the use.
