B-1. ZONING MAP AMENDMENT NO. 02-02, LOCAL COASTAL PROGRAM
AMENDMENT NO. 02-03 (GENERAL PLAN CONSISTENCY): Applicant: City
of Huntington Beach Request: ZMA: To rezone four subareas of properties to
make the zoning designations consistent with the current General Plan land use
designations as follows:
Subarea A (First Christian Church): Rezone from RL and RL-O (Residential Low
Density — Oil Production Overlay) to PS (Public -Semipublic). Location: 1207
Main Street (south of Adams, between 17th and Main)
Subarea B (Smith School): Rezone from RM (Residential Medium Density) to
PS (Public -Semipublic). Location: 770 171h Street (east side, south of Adams)
Subarea C (AES Generating Station): Rezone from IG-O-CZ-FP2 (General
Industrial — Oil Production Overlay — Coastal Zone Overlay — Floodplain
Overlay) to PS-O-CZ-FP2 (Public -Semipublic — Oil Production Overlay — Coastal
Zone Overlay — Floodplain Overlay). Location: 21730 Newland Street (east side,
north of PCH)
Subarea D (Edison Tanks): Rezone from IG-O-CZ-FP2 (General Industrial — Oil
Production Overlay — Coastal Zone Overlay — Floodplain Overlay) to PS-O-CZ-
FP2 (Public -Semipublic — Oil Production Overlay — Coastal Zone Overlay -
Floodplain Overlay) and from IL-CZ-FP2 (Limited Industrial — Coastal Zone
Overlay — Floodplain Overlay) to PS-CZ-FP2 (Public -Semipublic — Coastal Zone
Overlay — Floodplain Overlay). Location: Northwest comer of Magnolia Street
and Banning Avenue
LCPA: To amend the City's Local Coastal Program in accordance with the ZMA
for Subareas C and D and forward to the California Coastal Commission for
certification. Project Planner: Ricky Ramos
Zoning Map Amendment No. 02-02 request:
- City -initiated request to rezone the First Christian Church, one parcel at
the Smith Elementary School, the AES Generating Station, and an
Edison tank site to conform to the existing General Plan designation.
Local Coastal Program Amendment No. 02-03 request:
- Amend the City's Local Coastal Program in accordance with the Zoning
Map Amendment for Subareas C (AES Generating Station) and D
(Edison Tanks).
Staff's Recommendation: Approve Zoning Map Amendment No. 02-02 and
Local Coastal Program Amendment No. 02-03 with findings and forward it to
the City Council based upon the following:
- It will bring the subject properties into conformance with the existing
General Plan designation and is consistent with City Council direction
resulting from the 1996 General Plan update.
- The proposed zoning designation for each subarea is a more accurate
reflection of the actual use of the site.
- Approval of the request will not have any adverse environmental
impacts. Zoning Map Amendment No. 02-02 and Local Coastal Program

Amendment No. 02-03 are within the scope of the previously certified
EIR No. 94-1 for the comprehensive General Plan update.
- This action is consistent with goals, objectives, and policies of the
General Plan because it supports development in accordance with the
Land Use Plan Map. It will also further goals, objectives, and policies
that pertain to achievement and maintenance of a variety of land uses
that support the religious, educational, and institutional needs of
residents and businesses in Huntington Beach.
Staff made a presentation to the Commission.
Questions/comments included:
■ How will the change in zoning designations affect the proposed
Poseidon Desalination Plant?
■ Is there a current law that allows the use of old tract maps?
THE PUBLIC HEARING WAS OPENED.
Brian Goeble, San Nicolas Circle, Huntington Beach, spoke in reference to
Subarea A and urged the Commission to consider parking related problems on
San Nicolas Circle that currently exist due to First Christian Church and
Huntington Christian School parking overflow.
WITH NO ONE ELSE PRESENT TO SPEAK, THE PUBLIC HEARING WAS
CLOSED.
Discussion ensued regarding parking at Huntington Christian School.
The Commission suggested that the residents consider parking by permit only
on San Nicolas Circle and recommended they contact the Public Works
Department for more information.
A MOTION WAS MADE BY LIVENGOOD, SECONDED BY HARDY, TO
APPROVE ZONING MAP AMENDMENT NO. 02-02; LOCAL COASTAL
PROGRAM AMENDMENT NO. 02-03 WITH FINDINGS AND FORWARD TO
THE CITY COUNCIL BY THE FOLLOWING VOTE:

FINDINGS FOR APPROVAL - ZONING MAP AMENDMENT NO. 02-02:
1. Zoning Map Amendment No. 02-02 to change the zoning on the following
properties:
a. + 7.3 acre First Christian Church campus from RL and RL-O (Residential
Low Density — Oil Production Overlay) to PS (Public -Semipublic) to
conform to the existing General Plan designation of designation of P(RL-
7) (Public with underlying designation of Residential Low Density);
b. + 0.75 acre parcel at the Smith Elementary School from RM (Residential
Medium Density) to PS (Public -Semipublic) to conform to the existing
General Plan designation of P(RL-7) (Public with underlying designation
of Residential Low Density) and to match the zoning of the remainder of
the school;
c. + 50 acre AES Generating Station from IG-O-CZ-FP2 (General Industrial
— Oil Production Overlay — Coastal Zone Overlay — Floodplain Overlay)
to PS-O-CZ-FP2 (Public -Semipublic — Oil Production Overlay — Coastal
Zone Overlay — Floodplain Overlay) to conform to the existing General
Plan designation of P (Public); and
d. + 28 acre Edison tank site from IG-O-CZ-FP2 (General Industrial — Oil
Production Overlay — Coastal Zone Overlay — Floodplain Overlay) to PS-
O-CZ-FP2 (Public -Semipublic — Oil Production Overlay — Coastal Zone
Overlay - Floodplain Overlay) and from IL-CZ-FP2 (Limited Industrial —
Coastal Zone Overlay — Floodplain Overlay) to PS-CZ-FP2 (Public -
Semipublic — Coastal Zone Overlay — Floodplain Overlay) to conform to
the existing General Plan designation of P (Public)
is consistent with goals, policies, and objectives of the General Plan
because it supports development in accordance with the land uses depicted
in the Land Use Plan.Map. It will also further goals, policies, and objectives
that pertain to achievement and maintenance of a variety of land uses that
support the religious, educational, and institutional needs of residents and
businesses in Huntington Beach.
2. In the case of a general land use provision, the zoning map amendment is
compatible with the uses authorized in and the standards prescribed for the
zoning district for which it is proposed. This amendment would change the
land use designation rather than a general land use provision. Future
development will be compatible with the development standards.
3. A community need is demonstrated for the change proposed. With the
adoption of the General Plan in 1996, the community as a whole determined
a need to modify land use designations to accurately reflect the use on a
property. The Zoning Map Amendment will allow the zoning designations on
the subject properties to conform to the General Plan. It will also permit the

existing uses on the subject site to continue to provide services which have
been offered to residents and businesses in the community.
4. Its adoption will be in conformity with public convenience, general welfare
and good zoning practice. The subject sites are presently designated on the
General Plan; the proposed rezoning action will bring each site into
conformity with the current General Plan designation.
5. The Planning Commission finds that Zoning Map Amendment No. 02-02 is
covered within the scope of Environmental Impact Report No. 94-1 prepared
for the 1996 General Plan update which was certified by the City Council on
May 13, 1996 and that no further environmental review is required.
FINDINGS FOR APPROVAL — LOCAL COASTAL PROGRAM AMENDMENT
NO. 02-03:
1. Local Coastal Program Amendment No. 02-03 to the Huntington Beach
Local Coastal Program in accordance with Zoning Map Amendment No. 02-
02 for Subareas C (AES Generating Station) and D (Edison Tanks) is
consistent with the General Plan designations.
2. Local Coastal Program Amendment No. 02-03 is in accordance with the
policies, standards and provisions of the California Coastal Act because it
will allow the zoning designations of the Subareas C and D to be consistent
with the land use plan in the certified Coastal Element.
3. The development conforms to the public access and public recreation
policies of Chapter 3 of the California Coastal Act because the request is
only a Zoning Map Amendment which does not impact public access and
public recreational opportunities.

Commissioner Livengood stated that a Design Review Board meeting is
scheduled for this Thursday, October 10, 2002.

E-2. PLANNING COMMISSION INQUIRIES/COMMENTS
Commissioner Stanton — None.
Commissioner Kerins — Suggested the Commission consider scheduling a
future study session to discuss allowing public comments to be at the beginning
of the study session.
Commissioner Kerins stated that the Development Assistance Committee (DAC)
is scheduled to review a proposal by Calvary Chapel to move into the former
Burlington Coat Factory site on Edinger Avenue. He suggested the DAC
carefully review the proposed use for a potential zoning/use conflict with the
Edinger Corridor Specific Plan. Staff stated that the issue would be discussed
at this week's DAC meeting.
Commissioner Hard v — Asked staff to assist the residents on San Nicolas
Circle on the requirements to apply for permit parking. Staff from Public Works
explained the procedure.
Commissioner Shomaker — Advised the residents on San Nicolas Circle that a
minimum 80 % of the property owners will be required to sign the petition to
have the City consider permit parking.
Commissioner Livengood — None.
Commissioner Kokal — Noted that few items are scheduled for the upcoming
Planning Commission meetings. He asked why items at the September
meetings could not have been staggered and or scheduled for the October or
November PC meeting. Staff explained the State requirements on permit
streamlining and timely processing.
Commissioner Porter — Asked if the status of underground utilities at Atlanta
Avenue and Beach Boulevard could be presented at the next Planning
Commission study session.
Commissioner Porter suggested that the Commission consider a future study
session to address zoning and General Plan conflicts that could exist
throughout the City where park sites are located adjacent to school sites.
