ITEM 1: TENTATIVE PARCEL MAP NO. 2003-156 (RAINBOW DISPOSAL LOT
CONSOLIDATION)
APPLICANT: John McNamara, Anacal Engineering Co., 1900 E. La Palma Ave.,
Ste. 202, Anaheim, CA 92805
PROPERTY OWNER: Rainbow Disposal Company, Inc., 17121 Nichols St., Huntington
Beach, CA 92647
REQUEST: To consolidate five (5) lots into one, 17.59-acre parcel.
LOCATION: 17121 Nichols Street (west side, south of Warner Ave.)
PROJECT PLANNER: Wayne Carvalho
Wayne Carvalho, Staff Planner, displayed project plans and stated the purpose, location, zoning,
and existing uses of the requested project. Staff presented a review of the proposed project and
the suggested findings and conditions of approval as outlined in the executive summary. Staff
suggested deletion of the last sentence in Finding No. 4 as follows:
The lot consolidation or the type of improvements will not conflict with easements, acquired
by the public at large, for access through or use of, property within the existing property
unless alternative easements, for access or for use, will be provided. There are no publie
easements on the prope4y.
Staff recommended approval of the request based upon the suggested findings and subject to the
suggested conditions as outlined in the executive summary and with the modification as
recommended above. No written or verbal comments were received in response to the public
notification.
THE PUBLIC HEARING WAS OPENED. •
John McNamara, Anacal Engineering Co., 1900 E. La Palma Ave., Ste. 202, Anaheim, applicant,
had no comments at this time.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Mike Strange, Acting Zoning Administrator, and the applicant discussed the reasons for the
request.
TENTATIVE PARCEL MAP NO. 2003-156 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING MODIFIED FINDINGS AND
CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT
THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO
THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR PROJECTS EXEMPT FROM CEOA:
The Zoning Administrator finds that the project will not have any significant effect on the
environment and is exempt from the provisions of the California Environmental Quality Act
(CEQA) pursuant to section 15315 of the CEQA Guidelines, because the project consists of the
consolidation of five (5) industrial parcels into one parcel in conformance with the General Plan
and Zoning requirements. 0
FINDINGS FOR APPROVAL - TENTATIVE PARCEL MAP NO.2003-156:
1. Tentative Parcel Map No. 03-156 for the consolidation of five (5) parcels into one (1),
17.59 acre parcel is consistent with the General Plan Land Use Element designation of
General Industrial on the subject property. The proposed consolidation complies with all
applicable code provisions of the Subdivision Map Act and the HBZSO.
2. The site is physically suitable for the type and density of development. The site is currently
occupied by the Rainbow Waste Disposal facility that will continue to operate following the
recordation of the map. The proposed lot consolidation will comply with all applicable code
provision of the HBZSO including the minimum parcel size of 20,000 sq. ft. as required by the
IG (General Industrial) zoning district. The proposed lot consolidation complies with the
City's Standard Engineering Specifications for improvement and design, floodwater drainage
control, appropriate improved public roads, sanitary disposal facilities, water supply
availability, and environmental protection.
3. The lot consolidation or the proposed improvements will not cause serious health problems or
substantial environmental damage or substantially and avoidably injure fish or wildlife or their
habitat. The site is currently developed with a waste disposal facility and does not serve as
habitat for either fish or wildlife. •

4. The lot consolidation or the type of improvements will not conflict with easements, acquired
by the public at large, for access through or use of, property within the existing property
unless alternative easements, for access or for use, will be provided.
CONDITIONS OF APPROVAL — TENTATIVE PARCEL MAP NO.2003-156:
1. The tentative parcel map received and dated June 9, 2003 shall be the approved layout with
the following modifications:
a. The area within the parcel map boundary extending to a line 32 feet westerly of and
parallel with the existing centerline of Nichols Street shall be dedicated and/or rededicated
to the City of Huntington Beach as an easement for public street purposes. The
dedication and/or rededication shall be done on the final parcel map. (PW)
b. The existing water line easement encumbering the northerly portion of the property and
identified as Easement and Encumbrance No. 19 on the tentative parcel map shall be
removed through the tentative and final map process pursuant to Section 66445 0) of the
Subdivision Map Act. An appropriate reference in the City Engineer's Statement on the
final parcel map shall be included to effect the abandonment of the water line easement
thereby removing it from title to the property. (PW)
2. The following conditions shall be completed prior to recordation of the final map unless
otherwise stated. Bonding may be substituted for construction in accordance with the
is provisions of the Subdivision Map Act. (PW)
a. A reproducible mylar copy and print of the final parcel map shall be submitted to the
Department of Public Works at the time of recordation.
b. The engineer or surveyor preparing the final map shall comply with Sections 7-9-330
and 7-9-337 of the Orange County Subdivision Code and Orange County Subdivision
Manual, Subarticle 18 for the following items:
1) Tie the boundary of the map into the Horizontal Control System established
by the County Surveyor.
2) Provide a digital -graphics file of said map to the County of Orange.
c. Provide a digital -graphics file of said map to the City per the following criteria:
1) Design Specification:
a) Digital data shall be full size (1: 1) and in compliance with the California coordinate
system — STATEPLANE Zone 6 (Lambert Conformal Conic projection), NAD 83
datum in accordance with the County of Orange Ordinance 3809.
b) Digital data shall have double precision accuracy (up to fifteen significant digits).
c) Digital data shall have units in US FEET.
d) A separate drawing file shall be submitted for each individual sheet.
e) Digital data shall be in compliance with the Huntington Beach Standard Sheets,
drawing names, pen color and layering conventions.

f) Feature compilation shall include, but shall not be limited to: Assessor's Parcel
Numbers (APN), street addresses and street names with suffix. •
2) File Format and Media Specification:
a) Shall be in compliance with the following file format:
➢ AutoCAD (version 13 or later) drawing file: _.DWG
b) Shall be in compliance with the following media type:
CD Recordable (CD-R) 650 Megabytes
3. The final parcel map shall be recorded with the County of Orange. (PW)
4. Notification to all applicable regulatory agencies of the change in facility boundaries shall be
made (i.e., State Water Quality Control Board Industrial General Storm Water Permit). (PW)
INFORMATION ON SPECIFIC CODE REQUIREMENTS - TENTATIVE PARCEL
MAP NO.2003-156:
1. Tentative Parcel No. 2003-156 shall not become effective until the ten -calendar day appeal
period has elapsed.
2. Tentative Parcel No. 2003-156 shall become null and void unless exercised within two (2)
years of the date of final approval which is September 3, 2005. An extension of time may be
granted by the Planning Director pursuant to a written request submitted to the Planning
Department a minimum 60 days prior to the expiration date.
3. The subdivision shall comply with all applicable provisions of the Municipal Code,
Building Division, and Fire Department as well as applicable local, State and Federal Fire
Codes, Ordinances, and standards, except as noted herein.
4. All applicable fees from the Building, Public Works, and Fire Departments shall be paid
prior to map recordation.
5. The applicant shall submit a check in the amount of $43 for the posting of the Notice of
Exemption at the County of Orange Clerk's Office. The check shall be made out to the
County of Orange and submitted to the Planning Department within two (2) days of the
Zoning Administrator's action.
