ITEM 1: ENTITLEMENT PLAN AMENDMENT NO. 03-14 (PIERSIDE PAVILLION
VENDING CARTS)
40 APPLICANT: Jeff Bergsma, 221 Main Street, Suite S, Huntington Beach,
California 92648
PROPERTY OWNER: Pierside Pavillion, LLC, 2 Park Plaza, #1140, Irvine, CA 92614
REQUEST: To amend Coastal Development Permit No. 00-22/Entitlement Plan
Amendment No. 00-12 to allow two additional vending carts on
private property side of sidewalk along the north side of Pacific
Coast Highway, east of Main Street.
LOCATION: 300 Pacific Coast Highway (north side of PCH, east of Main
Street).
PROJECT PLANNER: Ron Santos
Ron Santos, Staff Planner, displayed project plans and photographs. Staff stated the purpose,
location, zoning, and existing uses of the requested project. Staff presented a review of the
proposed project and the suggested findings for denial as outlined in the executive summary.
Staff stated that the Design Review Board recommended that one existing vending cart be
relocated to the proposed location subject to a one-year review before consideration of the
second proposed cart.

Star stated that although the Department of Public Works did not recommend approval of the
proposed project, because of the high volume of pedestrian traffic, they did submit conditions of go
approval in the event of an approval by the Zoning Administrator.
Staff recommended denial of the request based upon the suggested findings as outlined in the
executive summary. No written or verbal comments were received in response to the public
notification including the business owners.
THE PUBLIC HEARING WAS OPENED.
Jeff Bergsma, 221 Main Street, applicant, spoke on behalf of the proposed project and urged the
Zoning Administrator's approval. Mr. Bergsma stated that the intent is to give a positive active
atmosphere to the subject site and remove some of the problem traffic from Main Street.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Mary Beth Broeren, Zoning Administrator, reviewed photographs of the subject site, as submitted
by the applicant, to demonstrate minimum clearance requirements for pedestrian traffic.
Discussion ensued:
• Reasons for changing the originally approved entitlement.
• Increase in pedestrian traffic resulting from future development of the surrounding site.
• The three-foot right-of-way clearance recommended by the Department of Public Works. of
• Smaller carts or kiosks as were discussed at the DRB meeting.
Ms. Broeren expressed concerns related to visual clutter impacting aesthetics, pedestrian access,
increased weekend traffic resulting from continuing development of the surrounding area, and the
inability to achieve the setback requirements recommended by the Department of Public Works
given the fact that the curb is raised.
Ms. Broeren stated that she was going to continue the item to allow the applicant time to consider
implementing the use of smaller carts. The applicant agreed to a four -week continuance.
ENTITLEMENT PLAN AMENDMENT NO. 03-14 WAS CONTINUED TO THE
NOVEMBER 12, 2003 MEETING WITH THE PUBLIC HEARING CLOSED.
THE MEETING WAS ADJOURNED AT 1:55 PM BY THE ZONING
ADMINISTRATOR TO THE NEXT REGULARLY SCHEDULED MEETING OF THE
ZONING ADMINISTRATOR ON WEDNESDAY, OCTOBER 22, 2003 AT 1:30 PM.
