Call to Order
Mayor Green called the Special Meeting of the City Council of the City of Huntington Beach to
order at 4:00 p.m. in the Council Chambers.
City Council Roll Call
Present: Sullivan, Coerper, Hardy, Green, Cook
Absent: Boardman, Houchen
Assistant City Clerk Read Call for Special Meeting
Assistant City Clerk Elizabeth Ehring read the Call for Special Meeting Notice to discuss the
following items in closed session and for possible report out by the City Attorney of any action
taken:

You are hereby notified that a Special Meeting of the City Council of the City of Huntington
Beach, California is called for and will be held at City Hall, 2000 Main Street, Huntington Beach,
California 92648 in Council Chambers at the hour of 4:00 p.m. The meeting is for the purpose
of considering the following:
Closed Session of the City Council
Recommended Action: Motion to recess to Closed Session on the following items:
1. (City Council) Closed Session — Pursuant to Government Code Section 54956.9(c) to
confer with its attorney regarding pending litigation. Based on existing facts and
circumstances, the legislative body of the local agency has decided to initiate or is deciding
whether to initiate litigation. Number of Potential Cases: one. Subject: Potential Litigation

By unanimous consent, with all present, Boardman and Houchen absent, Council recessed to
Closed Session on the following items.

Session on December 18, 2003 Approved to Support League -Sponsored Regarding the
Matter of the Vehicle License Fee (VLF) Backfill (120.80)
On Thursday, December 18, 2003, the City Council convened in closed session to discuss
whether to initiate litigation regarding the matter of Vehicle License Fee Backfill. The City
Council voted to initiate to support the league -sponsored litigation re: VLF backfill. The Council
voted as follows: 5 Ayes; 0 Noes; 2 Absent ( Boardman, Houchen).

(City Council) City Attorney's Report of Action Taken by the City Council in Closed
Session on Thursday, December 18, 2003 Pursuant to Government Code §54957.1(a)(2) —
Approved to Initiate Litigation in Re: State Board Equalization Assessment of Huntington
Beach AES Power Plant Property Tax (120.80)
On Thursday, December 18, 2003, the City Council convened in closed session to discuss to
initiate litigation regarding the matter of State Board of Equalization reassessment of property
tax of AES property. The City Council voted to initiate litigation against State Board of
Equalization. The Council voted as follows: 5 Ayes; 0 Noes; 2 Absent (Boardman, Houchen).
