Call to Order Mayor Green called the adjourned regular meetings of the City Council/Redevelopment Agency of the City of Huntington Beach to order at 5:00 p.m. in the Council Chambers. City Council/Redevelopment Agency Meeting Roll Call Present: Sullivan, Coerper, Green, Boardman, Cook, Houchen _ (Mayor Pro Tem Hardy had requested permission to be absent from the meeting pursuant to Resolution No. 2001-54.) Absent: Hardy .Am otion was made, by Boardman, second Coerper to add an item to.tonight's agenda regarding the need to take action concerning the'city's position on AB'710. CityAttor7ney Jennifer McGrath clarified for Council that this is allowed per government code section 54954.2(B)(2) ` The motion carried by the following roll call vote: AYES: Sullivan, Coerper, Green, Boardman, Cook, Houchen NOES: None ABSENT: Hardy Public Comments Richard Hart, Chair of the Public Works Commission, stated his concerns regarding reductions in the Public Works Department budget. He informed Council that the Commission has identified $8.5 million of necessary projects, and recommended that Council increase funding in 2004/2005, Mr. Hart also stated his opinion that the infrastructure fund should receive priority allocation for.unexpected funds received by the city, and distributed a Late Communication. Dean Albright spoke regarding deferred maintenance costs and how, in his opinion, this results in a higher cost later on. Mr. Albright also informed council that the city has only one skilled electrician and for safety reasons electricians should work in pairs. The City Council made several inquiries relative to Mr. Hart's Late Communication. Public Works Director Robert F. Beardsley responded by discussing the budget for sidewalk, curb, and gutter repairs. (2) August 23, 2004 - Council/Agency Minutes - Page 2 The City Clerk Announced Late Communications Pursuant to the Brown (Open Meetings) Act, City Clerk Joan L. Flynn announced Late Communications regarding agenda items that had been received by her office following distribution of the agenda packet: Communication submitted by Richard Hart dated August 23, 2004 titled At its meeting on. August 18, 2004, the Public Works Commission requested that I prepare the following letter regarding concerns with the Public Works Department budget, (City Council/Redevelopment Agency) Budget Study Session No. 2 Held — Presentation of Fiscal Year 2004- 2005 Proposed Budget (320.20) City Administrator Penelope Culbreth-Graft began the PowerPoint report by giving an overview of the budget. Administrative Services Director Clay Martin continued the report by addressing the questions that had been raised by councilmembers at the last budget study session. Councilmembers made inquiries relative to equipment replacement, retiree medical subsidies, supplemental retirement, CalPERS (California Public Employees Retirement System) and Worker's Compensation. Further inquiries were made regarding the proceeds from the sale of 214 5 h Street, the increased revenues from the Hyatt project, claims expenses, and the city service levels. Staff responded to the inquiries, and agreed to return to Council'with additional information on. the following: Worker's Compensation; Fund balances relative to supplemental retirement and retiree medical subsidy; Proceeds from the sale of 214 51h Street; Allocation of the increased revenues from the Hyatt project; and a proposal addressing the issues surrounding city service levels. (City Council) Item Added to Agenda per Previous Council Vote - Approved City Council Position of Support on Legislation Pending before the Federal, State, or Regional Government Regarding Assembly Bill 710 (Correa) Restructuring of the OCTA Board (640,90) Councilmember Boardman distributed communications dated August 23, 2004 and titled Mayor's Memo - AB 710 (Correa) Restructuring of the OCTA Board and California State Senate — Dick Ackerman - AB 710 informing Council that Assembly Bill 710 was approved as amended by the Senate. She reported that this bill will go back to the Assembly in the next day or two for concurrence, and then on to the Governor for approval. A motion was made by Boardman, second Coerper to approve a position of support for Assembly Bill 710 as amended on August 19, 2004 and authorize the Mayor to send a letter to the legislators and Governor on same. The motion carried by the following roll call vote: AYES: Sullivan, Coerper, Green, Boardman, Cook, Houchen NOES: None ABSENT: Hardy (3) August 23, 2004 - Council/Agency Minutes - Page 3 Motion to Recess to Closed Session — Approved A motion was made by Boardman, second Coerper to recess to Closed Session on the following items. The motion carried by the following roll call vote: AYES: Sullivan, Coerper, Green, Boardman, Cook, Houchen NOES: None ABSENT: Hardy (City Council) Closed Session -- Pursuant to Government Code Section 54956.9(a) to confer with its City Attorney regarding pending litigation which has been initiated formally and to which the city is a party. The title of the litigation is City of Huntington Beach v. Huntington Beach Police Officers' Association; United States District Court Case No. SA 01-1125 JVS;.and Scottsdale Insurance Company v. Huntington Beach Police Officers Association, and the related counterclaim, American States Insurance v. City of Huntington Beach, United States District Court Case No. SA 03-1143 JVS. Subject: City of Huntington Beach v. HBPOA (Gun Range), and related cases. (120.80) Reconvened City Council/Redevelopment Agency Meeting — 6:32 P.M. — Council Chambers. No Actions Taken Which Require a Reporting Pursuant to Government Code §54957.1(a) (3) (B))• Mayor Green asked City.Attorney Jennifer McGrath if there were any actions taken by the City Council or Redevelopment Agency in Closed Session that required a reporting. City Attorney McGrath responded that there were no actions to report.
