ZONING ADMINISTRATOR: Mary Beth Broeren STAFF MEMBER: Rami Talleh, Ron Santos, Ramona Kohlmann (recording secretary) MINUTES: October 20 and 27, 2004 APPROVED AS SUBMITTED ORAL COMMUNICATION: NONE ITEM 1: TENTATIVE PARCEL MAP NO. 04-29 (LORGE CIRCLE INDUSTRIAL SUBDIVISION) APPLICANT: David Seidner, 375 Bristol Street, Ste 50, Costa Mesa, CA 92626 PROPERTY OWNER: Jeff Grand Partners, L.P., 375 Bristol St., Suite 50, Costa Mesa, CA 92626 REQUEST: To permit the subdivision of two parcels currently developed with two 15,342.5 sq. ft. multi -tenant industrial buildings for condominium purposes. LOCATION: 7451 Lorge Circle (terminus of Lorge Circle east of Gothard Street) PROJECT PLANNER: Rami Talleh Rami Talleh, Staff Planner, displayed project plans and photographs and stated the purpose, location, zoning, and existing uses of the requested project. Staff presented a review of the proposed project and the suggested findings and conditions of approval as outlined in the executive summary. Staff suggested modifications to the suggested conditions of approval as follows: • That the Tentative Parcel Map (TPM) be amended to reflect the current unit configuration, which is a total of four units in each building. • That the TPM be amended to reflect eight additional on -site parking spaces as approved under previous entitlements. Staff stated that the applicant has been advised that they will be required to comply with the • City's landscape ordinance. One telephone call was received from a neighboring property owner inquiring into the nature of the project. No other written or verbal comments were received in response to the public 40 notification. Mary Beth Broeren, Zoning Administrator, reviewed the project plans and engaged in discussions with staff concerning the parking requirements. THE PUBLIC HEARING WAS OPENED. Michael A. Murphy, 711 W. 17" St., Ste D-5, Costa Mesa, CA, representing the property owner, stated that they were available to answer any questions. David Seidner, 375 Bristol Street, Ste 50, Costa Mesa, CA, property owner, stated that they are in the process of planting cypress trees. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Discussions ensued concerning placement of additional parking. Ms. Broeren confirmed with the applicant their agreement to the reciprocal parking easement. Ms. Broeren stated that she was going to approve the request with modifications as follows: Modify suggested Condition of Approval No. 1 as follows: 1. The Tentative Parcel Map No. 04-29 for subdivision of two parcels currently developed with two 15,342.5 sq. ft. multi -tenant industrial buildings for condominium purposes received and dated September 10, 2004, shall be the approved layout with the exception of the following revisions: a. Accurately identifv the number of units (4) and unit configuration for each building. b. Identify a minimum of 75 parking spaces on site. c. The subject property shall enter into or submit evidence of existing irrevocable reciprocal driveway and parking easement(s) between both parcels. The location and width of the accessway shall be reviewed and approved by the Planning Department and Public Works Department and depicted on the parcel map. The legal instrument shall be submitted to the Planning Department a minimum of 30 days prior to recordation of the final parcel map. The document shall be approved by the Planning Department and the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder prior to recordation of the final parcel map. A copy of the recorded document shall be filed with the Planning Department for inclusion in the entitlement file prior to recordation of the final parcel map. The recorded agreement shall remain in effect in perpetuity, except as modified or rescinded pursuant to the expressed written approval of the City of Huntington Beach. • ZA Minutes 11/10/04 2 (04zm1110) Add suggested Condition of Approval No. 3 as follows: 3 Prior to submittal of the final map submit a copy of the revised tentative parcel map pursuant to Condition No 1 to the Planning Department for inclusion in the entitlement file. TENTATIVE PARCEL MAP NO. 04-29 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND MODIFIED CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR PROJECTS EXEMPT FROM CEQA: The Zoning Administrator finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to section 15315 of the CEQA Guidelines, because the project consists of the division of property in an urbanized area zoned for commercial use into four or fewer parcels, in conformance with the General Plan and zoning, with no variances or exceptions required; and with all services and access to the proposed parcels available. FINDINGS FOR APPROVAL - TENTATIVE PARCEL MAP NO. 04-29: 1. Tentative Parcel Map No. 04-29 for subdivision of two parcels currently developed with two 15,342.5 sq. ft. multi -tenant industrial buildings for condominium purposes is consistent with the General Plan Land Use Element designation of IG (General Industrial) on the subject property, and other applicable provisions of the Huntington Beach Zoning and Subdivision Ordinance (ZSO). The proposed subdivision will create a total of 8 condominium units available to small incubator type industrial businesses to facilitate the growth of start-up industrial uses within the City. 2. The site is physically suitable for the type and density of development. The site consists of two parcels, which are developed with two 15,342.5 square foot multi -tenant industrial buildings. The project involves the subdivision of the multi -tenant buildings into 4 condominium units each. No added square footage or expansion of the use is proposed in conjunction with the proposed subdivision. Currently the site complies with parking, floor area ratio, setbacks, maximum building height, and other provisions of the ZSO. 3. The design of the subdivision will not cause serious health problems or substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. The subdivision is proposed for a developed property. No new development is proposed. The site does not serve as habitat for fish or wildlife. 4. The design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision unless alternative easements, for access or for use, will be provided. No easements acquired by the public at large for access through or use of the property exist ® within the proposed subdivision. At least 90 days before recordation of the final map, CC&Rs shall be submitted to the Planning Department. The CC&Rs shall be approved by the City Attorney and shall identify common areas and improvements, including parking areas, driveways and landscaping; and existing, proposed and necessary easements. The CC&Rs shall include provisions for maintenance of all common areas, including freestanding walls and landscaping, by the to -be -formed property Owner's Association. The CC&Rs must be in recordable form and recorded prior to recordation of the map. 3. Prior to submittal of the final map, submit a copy of the revised tentative parcel map pursuant to Condition No. 1 to the Planning Department for inclusion in the entitlement file. INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject of this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project.
