PETITION DOCUMENT: • APPLICANT: PROPERTY OWNER: REQUEST: LOCATION: PROJECT PLANNER: STAFF RECOMMENDS: CONDITIONAL USE PERMIT NO. 04-27 (MENALDI RESIDENCE) Art Kent, 325 2nd Street, Domenic Menaldi, 9001 Beach CA 92646 Huntington Beach CA 92648 Bermuda Drive, Huntington To permit the construction of a 110 square foot rooftop mechanical equipment deck above the second story top plate line in conjunction with an existing 4,532 square foot, two-story single-family residence. 9001 Bermuda Drive (northeast corner of Magnolia Street and Bermuda Drive) Paul Da Veiga Approval based on suggested findings and conditions of approval Paul DaVeiga, Staff Planner, provided a report stating the purpose, location, zoning, and existing uses of the requested project. He referenced floor plans and discussed construction related to the 110 square foot, 3Id story roof deck, stairway access, roof hatch, and solar energy equipment. The Zoning Administrator asked how and by whom the roof deck solar energy equipment would be maintained. Staff directed the question to Domenic Menaldi, Property Owner, who explained the maintenance process he himself would use to maintain the equipment. The Zoning Administrator made reference to the roof deck site plan depicting the solar energy equipment location and roof hatch, asking staff to confirm the remaining deck square footage. Staff provided a figure of 50 square feet of open deck space. Staff stated that the project plans were reviewed by an interested neighbor, and that a phone call was also received by an area resident with questions on the request. THE PUBLIC HEARING WAS OPENED. Domenic Menaldi, property owner, provided progress photos of construction taking place on the property during the past 19 months. Mike Adams, Huntington Beach, explained delays in construction and the purpose of the solar equipment. Mike Murray, 3`d Street, spoke in support of the request. Sandy Adams, Bermuda Drive, spoke in support of the request. Vickie Adams, Bermuda Drive, spoke in support of the request. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Zoning Administrator asked how often the mechanical equipment would be serviced by the property owner. Architect Vince Latora explained that the process includes a high-pressure spray wash that would be performed every 6 weeks, depending on weather conditions. • Domenic Menaldi addressed safety issues related to the access stairway. 0 The Zoning Administrator voiced concerns about the open 50 square feet of deck being used as recreational space (gather, sunbath, etc.) Mr. Latora stated that the open space area surrounding the solar energy equipment was closer to 40 square feet and is intended for maintenance of the solar equipment only, not for pleasure. He also added that maintaining the solar equipment from the 3`d floor metal roof on the home would be dangerous. The Zoning Administrator voiced concerns regarding potential recreational deck space being advertised as a mechanical deck. The Zoning Administrator asked for the roof wall height. Staff responded 5 feet. The Zoning Administrator reiterated concerns about the potential for the roof deck to be used for recreational purposes in the future, should the solar energy equipment be removed. Mike Adams requested that the plans be signed off so that the property owner could proceed with unrelated construction. Discussion ensued about revising and resubmitting plans and continuing the item in order to consider re -advertising as a proposed rooftop deck in lieu of an equipment deck.
