AWARDS AND PRESENTATIONS
SPECIAL ANNOUNCEMENT - Mayor Bohr announced the week of March 15 - 22 as Sunshine
Week. The first national Sunshine Week was launched March 13, 2005 to raise awareness
about Open Government to the public. The American Society of Newspaper Editors, the
American Library Association, the National Freedom of Information Coalition, the League of
Women Voters, Common Cause California, California First Amendment Coalition, and other
organizations are all sponsors of Sunshine Week. The City thanks the League of Women Voters
for participating in Sunshine Week and helping to raise awareness of the importance of Open
Government to the public.
PRESENTATION - Mayor Bohr called on Police Chief Small who described how certain
Huntington Beach Police Officers are being recognized by the Orange County Chapter of
Mothers Against Drunk Drivers (MADD), and introduced MADD representatives Vicky Macia
and Amanda Byrnes. Ms. Macia read excerpts from the commendation regarding life-saving
efforts of officers, and how the MADD organization honors the following Police Officers who
made 25-99 DUI arrests in 2008: Officer Corwin Bales (27); Officer Shaun Randell (32); Officer
Brian Nor (36); and Officer Michael Dexter (43). Chief Small also recognized Officer Ty Nyuyen
who contributed to 42% of all Huntington Beach DUI arrests in 2008 with 445 arrests.

PRESENTATION - Mayor Bohr was joined by Margie Bunten to announce the winners of the
Centennial Celebration Youth and Education Month Elementary Art Contest and Middle School
Essay Contest and their teachers to receive awards from the Centennial Celebration
Committee.
Mayor Bohr and Ms. Bunten were joined by Pam Daugherty from Huntington Beach Adult
School, Duane Dishno, Retired Superintendent, Huntington Beach City School District, Chris
Grisey, from the Huntington Beach Girl Scouts of America, Rebekah Harvard, Orange County
Council, Boy Scouts of America, Karen Hill, Girl Scout Council of Orange County -Huntington
Beach, Janis Mantini from Boeing, Ed Pavloff, Boy Scouts of America, Dr. Van Riley,
Superintendent, Huntington Beach Union High School District, and Diane Ryan from the Adult
Education School.
The following names represent winners honored for their participation in an art and essay
contest with the theme - "What was it like to live in Huntington Beach 100 years ago?"
Art contest winners for grades Kindergarten and First: Lauren Petroff, Smith Elementary, and
teacher Ms. Krogstad; Randal Macias, Circle View Elementary, and teacher Miss Costello; and
Trae Mortonere, Sea Cliff Elementary, and teacher Mrs. Chalabain.

leaders received special Centennial Patches for the scouts.
Mayor Bohr introduced Les Baron, President/Scout Executive for the Orange County Council
Boy Scouts of America, Margaret Naylor, Field Director for the Orange County Council Boy
Scouts of America, Ed Pavloff, Assistant District Commissioner, and Pat Brenden, Scoutmaster
for Troop 1. Mayor Bohr was also joined by William Paxon, Eagle Scout honoree in 1939, and
Reuben Hipolito, Eagle Scout honoree in 2000. Major Bohr introduced Karen Hill, Girl Scout
Council of Orange County, Chris Grisey, Huntington Beach Girl Scouts of America, and Gina

Magee, Vice President of Membership Operations for the Girl Scout Council of Orange County.
Proclamations were exchanged between Boy Scout and Girl Scout affiliations, followed
by Mayor Bohr's recognition and presentation of City proclamations. Mayor Bohr also
distributed centennial patches, and received coffee cups and boxes of Girl Scout cookies.
MAYOR'S AWARD - Mayor Bohr called on Stephanie Beverage, Director of Library Services to
present the Mayor's Award to the Children's Library Senior Librarian Mary Pat Gonzalez.
Director Beverage introduced Mary Pat Gonzales and described her accomplishments including
efforts to refurbish the Main Children's Library Theater, establishing Campfire Story Time,
coordinating 57 annual children's programs, working for the Huntington Beach Library for 15
years, and for celebrating her 35th wedding anniversary. Director Beverage described Mary Pat
as an amazing professional, and stated that HBTV-3 viewers can still catch her reading on Story
Time Theater.
Mary Pat stated her pleasure in working for the Huntington Beach Library, and thanked Director
Beverage and fellow Library staff members.
PUBLIC COMMENTS

Cadet Samuel Galima, Cadet Public Relations Committee, United States Military Academy at
West Point, discussed his personal background, educational achievements and active
memberships in the Junior Officer Training Corp Program, Jazz Band Musical Program, and
Accelerated Curricular Excellence (ACE) Program. He described his community service
experiences and provided a brief history about the West Point Academy and their related
programs. (00:37:10)
Councilmember Coerper discussed the benefits of attending West Point, and Cadet Galima
noted that the West Point Drill Team took first place at a recent competitive event held at the
Anaheim Stadium.
Robert Johnson, Cape Ann resident, discussed Abraham Lincoln and read from the Gettysburg
Address. He stated his opinion that nowhere in the Address does it state the government is
more important than those they serve. He also expressed concerns that Cape Ann
homeowners have the burden of homeownership without property rights, and urged Council
to treat everyone fairly. (00:45:45)
Pati and Art Kent, Huntington Beach residents since 1965, spoke to Council to request
permission to hold an Eagle Court of Honor for their youngest son Bradon Kent on either May
27 or 28 at 6:30 p.m. in the Council Chambers. They also informed Council that their oldest
son Brandon held his Eagle Court of Honor in the Chambers in 1991. (00:48:00)
Mayor Bohr congratulated the Kents, and asked them to leave contact information with City
staff.

George Mitchell, Cape Ann resident, spoke regarding the inclusionary housing resale pricing
formula and his perception of miscommunication and deceit by consultants and staff. He also
stated his opinion that he did not receive a discounted price on his Cape Ann home, and
described his efforts to collect home sales information by zip code in Orange County during a
six-month span of time, indicating that prices were primarily lower in all areas. He stated his
opinion that he paid fair market value for his property in 1999, and also discussed how
inclusionary housing material similar to the manual published in 2004 was not available.

Councilmember Dwyer questioned dollar amounts color -coded in Mr. Mitchell's report.
Councilmember Hardy questioned comparing a brand new home to older homes in other cities
and pointing out that most properties on the list were not located in coastal communities.
Councilmember Hardy also questioned why Mr. Mitchell decided to buy a home in Huntington
Beach if he felt properties available in other cities provided a better value.
Connie Ngo, Cape Ann resident, voiced concerns that Council may not understand issues
experienced by Cape Ann homeowners, and read from a self -prepared list of items she feels
Council needs to consider before making decisions on the inclusionary housing program. She
requested that Council and other people of authority use government funds to resolve affordable
property issues, and questioned previous statements by Councilmembers Hardy and Dwyer
about Cape Ann units being cheap, and questioning what the City has lost. (01:00:53)
Councilmember Hardy described being attracted to a detached home, even if it was considered
a condominium. She discussed housing value increasing and decreasing since 2005, and her
understanding that the City is trying to clarify the program, hold workshops for future owners,
and stated that Ms. Ngo has seen a 50% increase in home value in 10 years since she
purchased her home. Ms. Ngo voiced her belief that she did not sign a statement
acknowledging her participation in the City's affordable housing program.
Councilmember Coerper requested that staff put together information in response to claims by
speakers that staff and consultants misrepresented the program.

DISCLOSURE REPORTING
Councilmember Coerper discussed attending the 3-1 5k Run and fundraising event held on
Sunday, March 15.
Councilmember Dwyer thanked the City of Anaheim and Mayor Curt Pringle for hosting the
Restoring Community Conference on March 13 and described the event. He also recognized
Aaron Klemm, Energy Project Manager and the Ad Hoc Green Board for activity and programs
that will benefit Huntington Beach.
CITY ADMINISTRATOR'S REPORT
2. (City Council) Update on Strategic Plan
City Administrator Fred Wilson provided an update on the strategic plan, specifically alerting

Council that a document will be delivered this week, and updates will be provided on a monthly
basis.
Mayor Pro Tern Green requested that the Council meeting be held in honor of Betty Mays who
recently passed.
CITY TREASURER'S REPORT
3. (City Council) Reviewed and accepted Shari L. Freidenrich, City Treasurer's Investment
Summary Report of City Investment Portfolio, Bond Proceeds, Deferred Compensation, and
Retiree Medical Trust Activity for January 2009.
City Treasurer Freidenrich recognized the many contributions of Betty Mays, and provided a
PowerPoint report.
A motion was made by Coerper, second Green to review and accept the Monthly Investment
Report. Following review of the report by motion of Council, accept the Monthly Investment
Report for January 2009, pursuant to Section 17.0 of the Investment Policy of the City of
Huntington Beach. Vote to follow.
Councilmember Coerper and Treasurer Freidenrich discussed deferred compensation
investments, market value (City investment portfolio), and interest rate information identified
within the report.
Mayor Pro Tern Green and Treasurer Freidenrich discussed the decrease of 13% for Highway
Users Tax, and whether it reflects the cost of gas being too high. Treasurer Freidenrich
explained how the figures identified represent gas prices and consumption of gas in the last
quarter of 2008, and are distributed on a per capita basis. Mayor Pro Tern Green voiced
concerns about a precipitous decline in tax.

4. (City Council/Redevelopment Agency) Approved and adopted minutes.
A motion was made by Hansen, second Hardy to approve and adopt the minutes of the City
Council/Redevelopment Agency Special meeting of February 3, 2009, as written and on file in
the Office of the City Clerk. The motion carried by the following roll call vote:

5. (City Council) Approved a sole source purchase of a digital voice recording and transcription
system in the amount of $170,974.71 from Versatile Information Products, Inc., using funding
from the State Law Enforcement Services Fund (SLESF) grant award.
A motion was made by Hansen, second Hardy to waive the formal bidding requirement per
Municipal Code Section 3.02.080(b) (4), Sole Source Goods and Services exemption; and,
authorize the purchase of a digital voice recording and transcription system from Versatile
Information Products, Inc., using funding from the State Law Enforcement Services Fund grant
award. The motion carried by the following roll call vote:

6. (City Council) Approved the Environmental Board appointments of Sue Gordon and Bo
Glover for a first term to expire June 30, 2013, as recommended by City Council liaisons,
Councilmembers Jill Hardy and Devin Dwyer.
A motion was made by Hansen, second Hardy to approve the appointments of Sue Gordon and
Bo Glover to the Environmental Board for a first term to expire June 30, 2013, as recommended
by City Council liaisons Jill Hardy and Devin Dwyer. The motion carried by the following roll call

7. (City Council) Adopted Resolution No. 2009-11 approving the Supplemental Employee
Retirement Plan and Trust; authorize the Mayor and City Clerk to execute the Plan and Trust
Establishing the City Treasurer, Director of Finance and the City Administrator (or his/her
designee) as the members of the Retirement Board; and, authorized the City Administrator to
execute an agreement between the City and US Bank for investment and trust related services
in a form approved by the City Attorney.
Councilmember Coerper and City Administrator Wilson discussed how the U.S. Bank will
administer the established Trust, along with associated costs. Discussion ensued on how
investments impact CalPers, and how the Trust establishes a Retirement Board comprised of
the City Administrator, City Treasurer and Finance Director to recommend investments options.
City Treasurer Freidenrich explained the City has prefunded the Supplemental Pension Fund for
years, and described dollars earmarked, total plan liability, establishing a trust, and determining
investment vehicles and risk tolerance. She also explained that the City is required to make an
annual contribution to the plan, based on an actuarial study.
Councilmember Coerper questioned researching the U.S. Bank. City Administrator Wilson
described the request for proposal (RFP) process, and how five city departments were involved
in reviewing information submitted by five qualified companies.
Rod Skidmore, representing the U.S. Bank, introduced himself and provided a brief company
bio.

A motion was made by Coerper, second Hansen to Adopt Resolution No. 2009-11, "A
Resolution of the City Council of the City of Huntington Beach Approving the Supplemental
Employee Retirement Plan and Trust and Establishing the Retirement Board;" and, authorize
the Mayor to execute the Plan and Trust establishing the Retirement Board; and, authorize the
City Administrator to execute the agreement between the City and US Bank for investment and
trust related services in a form approved by the City Attorney. The motion carried by the
following roll call vote:

8. (City Council) Adopted Resolution Nos. 2009-12, 2009-13, 2009-14, 2009-15, 2009-16, 2009-
17, 2009-18, and 2009-19 adopting Side Letter Agreements with all employee bargaining units
modifying each respective Memorandum of Understanding (MOU) regarding supplemental
retirement benefit options.
A motion was made by Hansen, second Hardy to adopt Resolution No. 2009-12, "A Resolution
of the City Council of the City of Huntington Beach Amending the Memorandum of
Understanding Between the City and the Huntington Beach Police Officers' Association
(HBPOA), by Adopting the Side Letter of Agreement;" and, adopt Resolution No. 2009-13, "A
Resolution of the City Council of the City of Huntington Beach Amending the Memorandum of
Understanding Between the City and the Huntington Beach Police Management Association, by
Adopting a Side Letter of Agreement Regarding Supplemental Retirement Benefit Options;"
and, adopt Resolution No. 2009-14, "A Resolution of the City Council of the City of Huntington
Beach Amending the Memorandum of Understanding Between the City and the Marine Safety
Officers Association, by Adopting a Side Letter of Agreement Regarding Supplemental
Retirement Benefit Options;" and, adopt Resolution No. 2009-15, "A Resolution of the City

9. (City Council/Redevelopment Agency) Approved and authorized the Mayor and City Clerk to
execute an affordable housing agreement with Dave Bishop, Pathways to Independence, for
one unit of a four -unit apartment building located at 5111-5115 Dunbar Avenue (Tract 14448),
Unit One.
A motion was made by Hansen, second Hardy to approve the "Declaration of Conditions,
Covenants and Restrictions for Property (Affordable Housing Restrictions -Rental)" by and
between Dave Bishop, Pathways to Independence, the City of Huntington Beach, and the
Redevelopment Agency of the City of Huntington Beach; and, authorize the Mayor, City Clerk
and Deputy Executive Director to sign and execute. The motion carried by the following roll call
vote:

10. (City Council) Approved and authorized the Fire Chief to execute the Public Safety
Interoperable Communications (PSIC) Grant Agreement in the amount of $241,837 with the City
of Santa Ana for purchase of 700MHZ portable radios; and, appropriated $302,296 into a new
fund and authorize offsetting revenue of $241,837 in new grant revenues, and $60,459 in a
matching requirement.
A motion was made by Hansen, second Hardy to approve and authorize the Fire Chief to accept

ADMINISTRATIVE ITEMS
11. (City Council) Approved a City Council position on legislation pending before the Federal,
State, or Regional Governments as recommended by the City Council Intergovernmental
Relations Committee (IRC) members: Councilmember Jill Hardy, Chair, Mayor Keith Bohr, and
Councilmember Don Hansen.
Councilmember Green and Stephanie Beverage, Director of Library Services discussed the time
it takes to test children's books for toxic materials. Director Beverage explained that the Library
community is working hard to get an exemption from the Act for library books because their
studies indicate that the level of contaminants in books is extremely low, and that the ruling is
directed specifically towards toys that have experienced problems with lead poisoning.
Councilmember Green stated her opinion that children should be able to expect safe products in
a library, and requested notice if actual problems do exist.
Councilmember Hardy stated that the toys in library have been tested.
Councilmember Carchio questioned if the recent ruling resulted from problems reported in
China. Director Beverage stated that books produced and published in China have received

attention, and indicated that she would forward information related to publishing and the safety
study to the Council.
A motion was made by Hardy, second Coerper to SUPPORT S 292 - Eliminating a federal
withholding tax on certain payments made to vendors by government entities; and authorize the
Mayor to send a letter to the Governor requesting the formation of a Local Government Advisory
Group consisting of emergency management stakeholders to work with the California Offices of
Emergency Services and Homeland Security in the formation of the new cabinet -level California
Emergency Management Agency as prescribed under AB 38 (Nava); and, receive and file a
letter sent to Cheryl Falvey, General Counsel to the Consumer Product Safety Commission
regarding a recent ruling requiring testing for toxic material in books. The motion carried by the
following roll call vote:

12. (City Council) Approved for Introduction Ordinance No. 3828 amending Chapter 1.18 of the
Huntington Beach Municipal Code (HBMC) relating to administrative citations.
A motion was made by Coerper, second Green to after City Clerk reads by title, approve for
introduction Ordinance No. 3828, "An Ordinance of the City of Huntington Beach Amending
Chapter 1.18 of the City of Huntington Beach Municipal Code Relating to Administrative
Citations." The motion carried by the following roll call vote:

ORDINANCES FOR ADOPTION
13. (City Council) Adopted Ordinance No. 3827 temporarily superseding certain City municipal
and zoning code provisions relating to the required time of payment of specific development
impact fees. Approved for Introduction March 2, 2009.

Councilmember Dwyer thanked fellow Councilmembers Hardy and Carchio for their attendance
at the First Christian Church grand opening of new classrooms.
Mayor Pro Tern Green thanked the Huntington Beach Human Relations Task Force and the
Library Board for presenting author George Guthridge at an event, who used his story -telling
talents to share information about programs and the culture of Alaska.
Mayor Bohr congratulated Brian Joseph Sesic for earning his Eagle Scout Court of Honor on
March 8.
