PUBLIC COMMENTS PERTAINING TO STUDY SESSION / CLOSED SESSION ITEMS (3 Minute Time Limit) - None STUDY SESSION 1. The Police Chief presented and discussed a reorganization plan for the Police Department Police Chief Ken Small provided a PowerPoint presentation entitled Police Department Reorganization and Staffing, with the following titled slides: City Council Strategic Plan July 2011, (1. Department Organization Chart, 2. Revised Beat Plan Maps, 3. Revised Minimum Staffing Levels, 4. Revised Protocol - Calls for.Service), Why Reorganization?, Executive & Administrative Operations Divisions Organization Charts (Sworn - Current, Sworn - Reorg, Location of Vacancies) Uniform Division Organization Chart (Sworn - Current, Sworn-Reorg, and Sworn - Reorg & Location of Vacancies), Investigation Division Organization Chart (Sworn Current, Sworn-Reorg, Reorg & Location of Vacancies), Overview of Modifications, Modification of Beat Plan, Revised 8 Beat Plan, Revised Minimum Staffing, Friday and Saturday, Council/PFA Minutes March 19, 2012 Page 2 of 12 Comparable Staffing Levels, Southern California/Orange County Beach Cities, Calls for Service, and Questions. Councilmember Harper and Chief Small discussed Police enforcement in Huntington Harbor, and how Huntington Beach compares to other beach communities with harbor enforcement. Councilmember Carchio and Chief Small discussed how the summer plan relocates officers from gang and other units into divisions that support events that bring in 13 million plus visitors into the City. Councilmember Bohr and Chief Small discussed managing expectations from residents, and adjusting to working with less. Mayor Pro Tern Dwyer and Chief Small discussed salaries, higher property values, mandated staffing for the Fire Department, two-tier and fully -funded pensions. Councilmember Shaw and Chief Small discussed how the Public Information Officer helps educate the public of Police presence in the community, and enforcement activity in the downtown during the summer. Mayor Hansen discussed creating a communication plan for the citizens, and changing the ways the City works with staff resources. He cited the example of a physician's assistant prescribing medicine versus seeing a doctor to show how working with less is what the City must consider at this time in order to continue deployment of resources to meet community needs. Mayor Pro Tern Dwyer stated that the Fire Department's mandated staffing (4-man/vehicle) rule should be at the center of future MOU discussions. Councilmember Boardman voiced concerns about pitting Fire against Police. Councilmember Harper suggested that the City review public safety plans in other cities such as Santa Ana and Irvine. Pursuant to Government Code § 54956.9, the City Council recessed into Closed Session to confer with the City Attorney regarding the following lawsuits: Squirrell v. City of Huntington Beach, et al., Orange County Superior Court Case Nos. 30-2010-00355326 and 30-2010 00406621. Junior Life Guard incident of July 14, 2009, resulting in the death of minor participant. Council/PFA Minutes March 19, 2012 Page 3 of 12 3. Pursuant to Government Code § 54956.9, the City Council recessed into Closed Session to confer with the City Attorney regarding the following lawsuit: Griffin Dewatering Corp. v. Dorsey Dean Allison, et al., Orange County Superior Court Case No. 30-2010-00344707 (consolidated with Hillcrest Contracting, Inc. v. City of Huntington Beach, Orange County Superior Court Case No. 30-2011-00441151). In this case, Hillcrest Contracting, Inc. (contractor) claims the City breached its contract for worked performed on the Newland Street Improvement Plan. 4. Pursuant to Government Code § 54956.9, the City Council recessed into Closed Session to confer with the City Attorney regarding the following lawsuit: Pacific Mobile Home Park, LLC v. City of Huntington Beach (Atlanta Widening Project), Orange County Superior Court Case No. 30-2011-00449749. Councilmember Boardman announced the Allied Arts Board "Artist in Residence" Program on March 20 and a poetry event on March 22. Councilmember Harper memorialized Brian Garland, Huntington Beach Union High School Trustee who passed on March 13. Mayor Hansen reported that the proposed 19th Street (Banning) Bridge has been formally removed from the Master Plan of Arterial Highways (MPAH) map, and on his attendance at Eagle Scout Court of Honor for the Halverson brothers. CITY MANAGER'S REPORT City Manager Fred Wilson reported that that 4th of July Board is still accepting applications from non -profits for fireworks booth assignment. CONSENT CALENDAR 1. Approved and adopted minutes A motion was made by Carchio, second Dwyer to approve and adopt the minutes of the City Council/Public Financing Authority Regular Meeting of March 5, 2012, as written and on file in the Office of the City Clerk. Revised and Recirculated Mitigated Negative Declaration (MND) for Atlanta Widening Project and Pacific Mobile.Home Park, LLC v. City of Huntington Beach, Orange County Superior Court Case No. 30-2011-00449749 A motion was made by Carchio, second Dwyer to revise the Mitigated Negative Declaration (MND) to address the deficiencies the Court identified in the adverse Judgment, and then recirculate the MND for public comment before presenting it for approval at a Public Hearing before the City Council; and, refrain from conducting any activity that would interfere with the City's ability to comply with CEQA, pending approval of axecirculated MND. Adopted Ordinance No. 3935 amending Ordinance No. 3354 which granted a Petroleum Pipeline Franchise Approved for introduction March 5, 2012 A motion was made by Carchio, second Dwyer to Adopt Ordinance No. 3935, "An Ordinance of the City of Huntington Beach Amending Ordinance No. 3354 Which Granted an Oil Pipeline Franchise." Adopted Resolution No. 2012-13 ordering the Vacation of a Right -of -Way Easement at Crystal Street Senior Civil Engineer Steve Bogart gave a PowerPoint presentation with slides entitled: Crystal Street Vacation Existing Site, Background, and Recommendation. In response to an inquiry from Councilmember Harper, staff provided information on property ownership and right-of-way (ROW) where Clay Street ends. Mayor Hansen opened the public hearing. The City Clerk announced receipt of a PowerPoint communication from Travis Hopkins, Director of Public Works, entitled Crystal Street Vacation. With no one present to speak on the item, Mayor Hansen closed the public hearing. A motion was made by Carchio, second Boardman to adopt Resolution No. 2012-13, "A Resolution of the City Council of the City of Huntington Beach Ordering the Vacation Of That Certain Public Right -of -Way Easement Generally Located West of Gothard Street and North of Clay Avenue (Crystal Street Vacation);" and, instruct the City Clerk to record the resolution and Council/PFA Minutes March 19, 2012 Page 9 of 12 the attached exhibits with the Orange County Recorder. Approved Amendment to the Housing and Urban Development (HUD) FY 2010- 2014 Consolidated Plan, FY 2011-12 Action Plan, and Amendment to the Citizen Participation Plan Deputy Director of Economic Development Kellee Fritzal provided a PowerPoint entitled CDBG/HOME Consolidated Plan Amendment, with titled slides: Consolidated Plan, Action Plan - 2011-12, Citizen Participation Plan, Next Steps, and Questions. Mayor Hansen opened the public hearing. City Clerk Flynn announced receipt of a PowerPoint communication from Bob Hall, Deputy City Manager, entitled CDBG/HOME Consolidated Plan Amendment. With no one present to speak on the item, Mayor Hansen closed the public hearing. A motion was made by Boardman, second Shaw to approve amendments to the FY 2010-2014 Consolidated Plan; and, approve amendments to the 2011-12 Action Plan; and, approve amendment to the Citizen Participation Plan. The motion carried by the following roll call vote: AYES: Shaw, Harper, Dwyer, Hansen, Carchio, Bohr, and Boardman NOES: None ADMINISTRATIVE ITEMS 12. Received and Filed City of Huntington Beach City Attorney's Office (CAO) Performance Review Cathy Standiford with Management Partners Incorporated provided a PowerPoint entitled City of Huntington Beach City Attorney's Office Review, with titled slides: Tonight's Presentation, Background, Project Approach, General Fund Budget per Capita, CAO General Fund Allocations, CAO Budget per Capita, Staffing Levels, Total Staffing Comparison, Attorney Staffing Comparison, Administrative Staff Comparison, Request for Legal Services, Litigation Workload, Customer Service, Areas for Improvement, Recommendations - Customer Service, Recommendations - Performance and Accountability, and Conclusion. Councilmember Bohr and Ms. Standiford discussed the number of agencies audited by Management Partners (elected City Attorneys vs. appointed), best practices in communication, including returning phone calls and emails, removing the Outlook "Out -of -Office" instant email feature, customer service standards, annual performance evaluations, and what is established in relation to a "second in command" in the office. City Attorney McGrath discussed recommendations made in past department audits that have been put into place, and what current recommendations could be improved upon now. Mayor Pro Tern Dwyer and Ms. Standiford discussed outsourcing litigation services and the time reported in the Study to return Requests for Legal Services. Council/PFA Minutes March 19, 2012 Page 10 of 12 Councilmember Carchio voiced concerns about operational modifications not being implemented had the audit not been performed. Councilmember Shaw discussed the importance of delegating work, and shared his impression of the positive factors in the report. Councilmember Boardman discussed her knowledge and involvement in past City Attorney Department audits, questioned the City Attorney's budget for employee training, and whether outsourcing litigation would require a Charter amendment. Mayor Pro Tem Dwyer and City Attorney McGrath discussed producing a model of how the office should be restructured to improve administerial functions in the City Attorney's Office. Mayor Hansen and City Attorney McGrath discussed progress in relation to performance evaluations and established performance measures, the Pro Law System, and the challenges which keep two Assistant City Attorneys from operating effectively as a "second -in -command." Mayor Hansen summarized comments made by Council, and reiterated concerns about annual performance evaluations not being done. Discussion ensued about the presence of any internal review processes in place within the organization, which City department should be audited next, and whether or not the City has the resources to conduct another departmental audit. A motion was made by consensus to receive and file City Attorney's Office Performance Review. The motion carried by the following roll call vote: AYES: Shaw, Harper, Dwyer, Hansen, Carchio, Bohr, and Boardman NOES: None COUNCILMEMBER ITEMS 13. Request submitted by Councilmember Carchio approved to direct staff to research and draft an animal protection ordinance that would eliminate the commercial sale and/or resale of dogs and cats in the City Councilmember Carchio requested that staff play a video produced by the Human Society that educates the public on the deplorable conditions for dogs who are forced to reproduce through "puppy mills." Councilmember Carchio discussed his personal feelings about why the City should not allow any commercial sale and/or resale of dogs and cats in the City. Councilmember Shaw described buying a physically problematic animal from a retailer and not a responsible breeder as a consumer matter that requires responsible attention. He discussed how people purchase animals on a whim, depending on what they see in commercials or popular movies, and offered support for the proposal to not allow commercial sale of cats and dogs in Huntington Beach. Mayor Pro Tem Dwyer voiced concerns about existing pet retailers in the City not being informed of the request, and the legal risks in not allowing them to continue the sale of cats and Council/PFA Minutes March 19, 2012 Page 11 of 12 dogs should the proposed Ordinance be crafted and approved. Councilmember Bohr read an excerpt from a letter submitted by Leg Up Rescue that supports the proposed Ordinance, and provided statistics on the number of cats and dogs euthanized annually in the City. He shared feelings about why the Ordinance should move forward, and thanked Councilmember Carchio for bringing it forward. Councilmember Boardman voiced concerns about puppy mills and the poor conditions of pet stores in general who sell cats and dogs, and provided support for the proposed Ordinance. Mayor Hansen voiced concerns about allowing the sale of cats and dogs by responsible breeders, but not a responsible retailer. Discussion ensued, and City Attorney McGrath attempted to clarify the intent of the proposal and suggested that her office provide Council options on how to proceed. She also stated that she would contact existing retailers to communicate Council's direction to draft an Ordinance that prohibits the commercial sale and/or resale of dogs and cats in retail pet stores in the City. A motion was made by Carchio, second Shaw to direct staff to research and draft an ordinance that would eliminate the commercial sale and/or resale of dogs and cats in retail pet stores in the City of Huntington Beach and provide said ordinance for City Council consideration.
