HomeMy WebLinkAbout2012-08-27Special Meeting Minutes City Council/Public Financing Authority City of Huntington Beach Monday, August 27, 2012 5:00 PM - Council Chambers Civic Center, 2000 Main Street Huntington Beach, California 92648 5:00 PM — COUNCIL CHAMBERS CALL TO ORDER — 5:01 PM ROLL CALL - (Councilmember Joe Shaw requested and was granted permission to be absent pursuant to Resolution No. 2001-54) Present: Harper (arrived 5:06), Dwyer, Hansen, Carchio, Bohr, and Boardman Absent: Shaw ANNOUNCEMENT OF SUPPLEMENTAL COMMUNICATIONS (Received After Agenda Distribution) Pursuant to the Brown "Open Meetings" Act, City Clerk Joan Flynn announced receipt of a request to be absence memo received by Councilmember Joe Shaw. PUBLIC COMMENTS PERTAINING TO SPECIAL MEETING CLOSED SESSION ITEM (3 Minute Time Limit) Mr. Brown Act read a paragraph by Ralph M. Brown regarding the public's right to be informed so they can retain control over their government. RECESS TO CLOSE SESSION A motion was made by Carchio, seconded by Dwyer, to recess to Closed Session. The motion carried by the following vote: AYES: Harper, Dwyer, Hansen, Carchio, Bohr, and Boardman NOES: None ABSENT: Shaw CLOSED SESSION Pursuant to Government Code § 54956.9, the City Council recessed into Closed Session to confer with the City Attorney regarding MCP_v. Vadnais, City of Huntington Beach, et al., Orange County Superior Court Case No. 30-2008 00113320. The case concerns the cross -complaint the City has filed against Bureau Veritas for the negligent design of the Warner Avenue Gravity Sewer line. Council/PFA Regular Minutes August 27, 2012 Page 2 of 2 CLOSED SESSION REPORT BY CITY ATTORNEY On Monday, August 27, 2012, the City Council convened in closed session to discuss the matter of MCP v. Vadnais, et al, Orange County Superior Court Case No. 30-2008- 00113320. By a 6-0 vote (Shaw did not participate), the Council voted in closed session to accept the settlement offer of $1,500,000.00 which would include a release of all claims between the City and the Design Professionals. ADJOURNMENT — 5:27 PM The next regularly scheduled meeting is Tuesday, September 4, 2012, at 4:00 PM in Room B- 8, Civic Center, 2000 Main Street, Huntington Beach, California.
