HomeMy WebLinkAbout2013-01-14Minutes City Council/Public Financing Authority Special Meeting City of Huntington Beach Monday, January 14, 2013 5:30 PM — 4th Floor Administrative Conference Room #2 Civic Center, 2000 Main Street Huntington Beach, California 92648 CALL TO ORDER - 5:33 PM ROLL CALL Present: Sullivan, Hardy, Harper, Boardman, Carchio, Shaw, and Katapodis Absent: None ANNOUNCEMENT OF SUPPLEMENTAL COMMUNICATIONS (Received After Agenda Distribution) — None. PUBLIC COMMENTS PERTAINING TO SPECIAL MEETING/CLOSED SESSION ITEM(S) (3 Minute Time Limit): Mark Alpert, Hart, King & Coldren for Pacific Mobile Home Park, voiced concerns about Council's actions to date. He discussed the financial impacts of the property owner's failed escrow, voiced concerns about the welfare of twenty (20) residents along Huntington Street affected by decisions involving sidewalks, and the amount of taxpayer dollars being spent on litigation. He stated how he has served the best interests of his clients and park residents, and suggested that Council consider the best interests of the City of Huntington Beach and abandon their reconsideration, dismiss the cross - complaint, and negotiate a sidewalk plan. RECESS TO CLOSED SESSION — 5:37 PM A motion was made by Shaw, second Carchio, to recess to Closed Session. The motion was carried by the following vote: AYES: Sullivan, Hardy, Harper, Boardman, Carchio, Shaw, and Katapodis NOES: None CLOSED SESSION 1. Pursuant to Government Code § 54956.9, the City Council recessed into Closed Session to confer with the City Attorney regarding Pacific Mobile Home Park, LLC v. City of Huntington Beach, Orange County Superior Court Case No. 30-2011-00497684, Court of Appeal Case No. G047060, challenging the City's denial of Tentative Tract Map No. 17397 and CDP No. 10-017, to subdivide an existing for -rent mobile home park of 252 units for ownership purposes. RECONVENE OPEN SESSION — 6:19 PM CLOSED SESSION REPORT BY CITY ATTORNEY The City Attorney reported that by a unanimous vote in Closed Session, the City Council determined to abandon reconsideration of the November 19, 2012 action to approve Pacific Mobile Home Park's application for a tentative tract map and coastal development permit. The City Council further directed the City Attorney not to appeal the Superior Court's orders of December 10, 2012 and January 8, 2012, except that the City Attorney is authorized to pursue appellate relief if Superior Court does not take off calendar the pending contempt hearing.
