ANNOUNCEMENT OF SUPPLEMENTAL COMMUNICATIONS FOR STUDY SESSION/
CLOSED SESSION ITEMS (Received After Agenda Distribution)
Pursuant to the Brown "Open Meetings" Act, City Clerk Joan Flynn announced supplemental
communications that were received by her office following distribution of the Council agenda
packet:
Communication submitted by Robert Dingman for Closed Session Item No. 3 dated November
3, 2014, entitled Senior Center, Measure C.
PUBLIC COMMENTS PERTAINING TO STUDY SESSION / CLOSED SESSION ITEMS
(3 Minute Time Limit) — None.
STUDY SESSION
1. Orange County Sanitation District representatives presented, optimization of
disinfection practices of OCSD's ocean outfall
Travis Hopkins, the City's Director of Public Works, introduced Jeffrey L. Armstrong, Samuel
Choi; and Mike Von Winckelmann, representatives from the Orange County Sanitation District.
Mr. Armstrong provided a PowerPoint entitled Changes in Biological Communities Near the
OCSD Outfall that included the following titled slides: Changes in Marine Communities, Benthic
Community Changes, Two -Phased Approach, Phase I Results, Phase II Results, Most Likely
Causes, and Questions.

Councilmember Boardman and OCSD representatives discussed fat soluble, biomagnifying
compounds made from the chlorination process, and consumable standards for fish tissue.
Councilmember Sullivan and OCSD representatives discussed effluent level output compared to
that in a family swimming pool, and the fact that the disinfection process is not a human health
concern.
Mr. Choi presented Impact of Orange County Sanitation District Wastewater Disinfection on
Beach Water Quality that included the following, titled slides: OCSD Core and Regional
Monitoring Program.
Councilmember Boardman and OCSD representatives discussed the size of the initial mixing
zone.
Mr. Choi continued the presentation with Enterococci, Impact of Runoff on Huntington Beach,
and Monitoring Enterococcus.
Councilmember Boardman and OCSD representatives discussed similar environmental issues
that exist near Newport Beach Harbor.
Mr. Choi concluded the presentation with Summary, and Questions.
Councilmember Boardman and OCSD .representatives discussed testing water (length of time,
faster methods, how long is DNA detectable after bacteria dies). Discussion ensued regarding
the disinfection process being conducted as a precautionary measure that the OCSD now
realizes is not needed because they have no evidence to support it. Other issues discussed
were related to the degradation process and increased public outreach.
RECESS TO CLOSED SESSION — 4:44 PM
Mayor Harper announced: Pursuant to Government Code § 54957.6, the City Council shall
recess to Closed Session to meet with its designated labor negotiators and Fred Wilson, City
Manager regarding the following: SCLEA and MSMA
Mayor Harper announced: Pursuant to Government Code § 54956.8, the City Council takes this
opportunity to publicly introduce and identify designated property negotiator, City Manager Fred
Wilson, who will be participating today's in Closed Session discussions regarding negotiations
concerning price and terms of payment for the real properties located at 21500 Pacific Coast
Highway, the "Hyatt Property" and 21100 Pacific Coast Highway, the "Hilton Property. "
CLOSED SESSION
2. Pursuant to Government Code § 54957, the City Council recessed to Closed
Session to discuss the following personnel matter: City Manager's Evaluation.
3. Pursuant to Government Code § 54956.9(d)(1), the City Council recessed to
Closed Session to confer with the City Attorney regarding the following lawsuit:
Parks Legal Defense Fund v. The City of Huntington Beach, et al.; Orange County
Superior Court Case No. 30-2012-00570541. In this second lawsuit challenging the

Senior Center, a public interest advocacy organization alleges that the City
violated CEQA, City Charter Section 612 (Measure C), the City's General Plan, and
the Public Trust Doctrine.
4. Pursuant to Government Code Section 54956.8, the City Council recessed to
Closed Session to give instructions to the City's Negotiator, Fred (Nilson, City
Manager, concerning price and terms of payment for the purchase of real property
in located at 21500 Pacific Coast Highway (APN 024-251-01) the "Hyatt Property".
The negotiating parties are: The real property owner, the Successor Agency to the
former Redevelopment Agency of City of Huntington Beach and the current
lessee/purchaser, PCH Beach Resorts, LLC.
S. Pursuant to Government Code Section 54956.8, the City Council recessed to
Closed Session to give instructions to the City's Negotiator, Fred Wilson, City
Manager, concerning price and terms of payment for the real property in located
at 21100 Pacific Coast Highway (APN 024-01 and 02) the Hilton Property. The
negotiating parties are: the property owner, the Successor Agency to the former
Redevelopment Agency of City of Huntington Beach and the current
lessee/purchaser, Mayer Financial LLP.
6. Pursuant to Government Code § 54957.6, the City Council recessed to Closed
Session to meet with its designated labor negotiators and Fred Wilson, City

AWARDS AND PRESENTATIONS
Mayor Harper announced November as National Native American Heritage Month as part
of the city's Human Relations Task Force Federal Heritage Month program.
Mayor Harper called on Janeen Laudenback and John Valinsky from Community
Services to recognize and thank the sponsors for the City of Huntington Beach `Locals
Only' Surf Contest.
Mayor Harper called on Rotary Club representatives to provide a recap of the recent
Surfboards on Parade auction.
Mayor Harper called on Greg Neneman, Exalted Ruler for the Huntington Beach Elks
Lodge #1959, who presented an overview of what the local lodge is doing for the
community through helping the needy, law enforcement, schools and -veterans in the
City.

Mike Ali invited Council to attend the Veterans Day Assembly and Spaghetti Lunch at Pier Plaza
on Tuesday, November 11, 2014. (00:25:12)
Gil Coerper discussed the Mounted Enforcement Unit in the Police Department, naming horses
Grace, Drifter, Roddy, and Kelly Blue. He discussed horses being stabled at the Equestrian
Center, and the Memorandum of Understanding between the City and the County to work as a
unit when needed for outside events. Mr. Coerper closed by informing the public the price of
the spaghetti lunch, with funds raised to support the H.B. Police Department and Mounted Unit.

Kevin Carlin, Huntington Beach Community Forum member, spoke regarding the November 4,
2014 election. He voiced concerns about permit parking and rent control, and his opinion that
Huntington Beach residents are moderate in their politics. He voiced concerns about Connie
Boardman and Joe Shaw, and his support for Eric Peterson, Lyn Semeta, Hector Valdez, and
Alex Polsky. (00:30:34)

Terrence S. Haxton spoke in support of Connie Boardman, Joe Shaw, and Mark Bixby in the
November 4, 2014 election for Huntington Beach City Council. He voiced concerns about
candidates Barbara Delgleize, Mike Posey, and Billy O'Connell using Lucy Dunn on campaign
material characterizing her as environmentally sensitive. (00:33:52)
Dean Terhuwe voiced concerns about Jennifer McGrath settling lawsuits without going to trial
and withholding data that would support her findings for a well run department. He also voiced
concerns about Connie Boardman and Joe Shaw's lack of support for the Huntington Beach
Central Park Senior Center and the amount of funds spent on litigation. He continued with
concerns about the ban of plastic bags. (00:36:53)
Yvonne Mauro, speaking on behalf of Moe Kannodie, read a statement of his concern about
claims of serious crime in the downtown area by the City Council, which are not true. The
statement closed with satirical comments about the plastic bag ban. (00:40:07)
Joseph Mastropaulo voiced concerns about traffic congestion. (00:41:50)
Mike Posey, Council candidate #3 on the November 4, 2014 ballot - thanked all Council for their

Lyn Semeta spoke about change in Huntington Beach, and her candidacy for City Council on
the November 4, 2014 ballot. (00:45:21)
Tim Geddes voiced concerns about the Republican party's involvement in the City's non-
partisan election for the positions of City Attorney and City Council in Huntington Beach.

Ian Clare, Huntington Beach Community Forum, asked Council to repeal their vote on parking
permit districts for 7th, 8th and 9th Streets in the downtown area. (00:50:17)
Pat Taylor, Rancho Huntington Mobilehome Park, spoke regarding the rental increase for 2015
of $200 per month if the residents did not sign a lease agreement with park owners. (00:53:16)
Cari Swan spoke regarding the November 4, 2014 election, and voiced her concerns about
Councilmembers Katapodis, Hardy, Shaw and Boardman. (00:56:37)
Stephanie Green encouraged residents of Huntington Beach to vote yes on Measure T - state
approved, safe and sane fireworks use in Huntington Beach. (00:59:b4)
Cindy Cross encouraged the public to vote in the November 4, 2014 election and bring change
to the City of Huntington Beach. (01:01:45)
Diane Breckshot voiced concerns about Councilmember Shaw belittling other candidates in the
way he refers to their occupation and that he chose not to refute claims. (01:04:34)
Mary Jo Baretich spoke in support of voting in the November 4, 2014, specifically requesting
that the public to support Joe Shaw, Connie Boardman and Mark Bixby. (01:07:05)

Maureen L voiced concerns about Council candidates Shaw, Boardman and Bixby - (01:10:35)
Susan Welfringer, Huntington Beach Downtown Business Improvement District, wanted to thank
Councilmembers in advance for approval of the free parking in downtown during the holiday
season. She also thanked the Police Department, Mounted Unit, Fire Department, Marine
Safety, and Parks & Recreation for being involved with the downtown Halloween event.

Shawn Runyan voiced concerns about the legitimacy of Joe Shaw running for Council when he
has documents showing so many different addresses. (01:22:06)
Michael Hoskinson voiced concerns about high density development in Huntington Beach.

Gabriel Mauser voiced concerns about Council voting without regard to how the citizens feel,
and was specifically disappointed with Council's vote on parking permit districts on 7th, 8th, and

Clay Allison voiced concerns about candidates Shaw, Boardman and Bixby not listening to what

DISCLOSURE REPORTING
Councilmember Carchio reported attending the Fountain Valley Chamber of Commerce 2014
Mayor's Ball on October 25; Councilmember Boardman reported attending a Compassionate
Cities meeting and how Huntington Beach was recognized for their level of compassion;
Councilmember Katapodis reported attending Orange County Council of Governments meeting;
and Mayor Harper also attended the Orange County Council of Governments meeting.
CITY MANAGER'S REPORT
City Manager Fred Wilson reported the California Energy Commission's approval of the new
power plant in Huntington Beach. What's next? Construction in 2016 and 2017, and new
operation online in 2020.

Report
A motion was made by Carchio, second Shaw to receive and file the "City of Huntington Beach

Needs Task Force with a term to expire August 30, 2017.

Comprehensive Transportation Funding Program (CTFP)
A motion was made by Carchio, second Shaw to adopt Resolution No. 2014-81, "A Resolution
of the City Council of the City of Huntington Beach Approving the Submittal of One Improvement
Project to the Orange County Transportation Authority for Funding Under the Comprehensive
Transportation Funding Program."

Research
Councilmember Carchio pulled the item to ask if Hurley was approached about new lifeguard
towers, and whether or not they should be consulted about their interest.

Industrial Design Research of two lifeguard towers.

8. Approved and authorized execution of Amendment No. 1 to Agreement between the
City and Paragon Partners, Ltd., in an amount not to exceed $39,220.00 for additional
appraisal, acquisition, and relocation services for the Atlanta Avenue Widening
Project
A motion was made by Carchio, second Shaw to approve and authorize the Mayor and City
Clerk to execute "Amendment No. 1 to Professional Services Contract Between the City of
Huntington Beach, Paragon Partners, Ltd., for Appraisal, Acquisition, and Relocation
Implementation Services" for the Atlanta Widening Project.

9. Approved and authorized execution of a three-year Professional Services Contract

Clerk to execute the "Professional Services Contract between the City of Huntington Beach and
Sierra Analytical Laboratories, Inc. for Water Quality Analyses and Sampling."

10. Approved and authorized execution of Consent to Assignment of Sublease for
Meadowlark Golf Course with lessee American Gold Corporation and CNL Income

execution of an Estoppel Certificate
Pulled by Councilmember Carchio to provide information on Meadowlark Golf Course including
lease terms, price, maintenance, etc.
A motion was made by Carchio, second Katapodis to approve the Consent to Assignment of
Sublease Agreement by and between the City of Huntington Beach and American Golf
Corporation, a California corporation, as the lessee, and CNL Income EAGL Meadowlark, LLC,
a Delaware limited liability company, as the subtenant of the lessee, and CF ARCIS, LLC., a
Delaware limited partnership; and, authorize the Mayor and City Clerk to sign and execute the
Consent to Assignment of Sublease Agreement; and, authorize the City Manager to sign the
Estoppel Certificate relating to the Meadowlark Golf Course property; and, authorize the City
Manager or designee to take any action and execute any and all documents and agreements
necessary to implement this agreement.

Range Property Management Plan Prepared Pursuant to California Health and Safety Code
Section 34191.5."

14. Adopted Ordinance Nos. 4037, 4038, 4039 and 4040 amending four chapters of the
Huntington Beach Zoning and Subdivision Ordinance (HBZSO) that will reorganize
entitlement permits of certain applications to the lower hearing body, codify existing
policies, and clarify certain sections of the HBZSO.

Huntington Beach Amending Chapter 211 of the Huntington Beach Zoning and Subdivision
Ordinance Titled C Commercial Districts (Zoning Text Amendment No 12-001)"; and, adopt
Ordinance No. 4039, "An Ordinance of the City Council of the City of Huntington Beach
Amending Chapter 212 of the Huntington Beach Zoning and Subdivision Ordinance Titled I
Industrial Districts (Zoning Text Amendment No 12-001 )"; and, adopt Ordinance No. 4040, "An

15. Approved for introduction Ordinance No. 4041 dissolving the Huntington Beach
Hotel/Motel Business Improvement District (BID)
City Manager Fred Wilson referred to the Council's September 15, 2014 adoption of a resolution
establishing the Huntington Beach Tourism Business Improvement District (TBID) that
essentially replaces the Huntington Beach Hotel/Motel Business Improvement District (BID).
Mayor Harper opened the public hearing. With no one present to speak on the item, the public
hearing was closed. _
A motion was made by Shaw, second Hardy to after the City Clerk reads by title, approve for
introduction Ordinance No. 4041, "An Ordinance of the City of Huntington Beach
Disestablishing the Huntington Beach Hotel/Motel Business Improvement District by Repealing
Uncodified Ordinance Number 3569."

A motion was made. by Harper, second Boardman to adopt Resolution No. 2014-82. "A
Resolution of the City Council of the City of Huntington Beach Establishing the Application
Process, Review Procedures, and Required Contract Provisions for the Implementation of a
Mills Act Program in the City of Huntington Beach Pursuant to Government Code Section
50280, ET SEQ., and Setting an Application Fee."

17. Request Submitted by Councilmember Carchio Approved - Public and private
partnership to identify funding to construct a playground on the beach
A motion was made by Carchio, second Sullivan to approve Councilmember Carchio working
with city staff and community stakeholders, to lead an effort to identify funding to construct a
universally accessible playground on the beach.

COUNCILMEMBER COMMENTS (Not Agendized)
Councilmember Carchio encouraged participation in the Nov. 11 spaghetti lunch following the
Veterans Day Ceremony at the pier, and reminded everyone how important it is to be a
knowledgeable voter.
Councilmember Sullivan reminded everyone of the public comments opportunity at 6 p.m. on
Thursday, Nov. 6, for comments on the ASCON issue, and acknowledged and thanked the
Bolsa Chica Conservancy for their great work in educating our youth.
Councilmember Boardman reported she attended the Allied Arts Board Awards to recognize the
many artists in the community, as well as attending the City employee Halloween breakfast
where it appeared the employees were very generous with their treats for Mariners Church
community outreach needs. She also reminded everyone to attend the Nov. 11, 11 a.m.,
Veterans Day Ceremony at the pier, and announced the Bolsa Chica Land Trust (BCLT)
fundraiser on Nov. 13 at the Boudin Restaurant at Ellis & Beach where 20% of proceeds will
benefit the BCLT.
Mayor Pro Tern Shaw reported attending a great show at the HB Playhouse, the Allied Arts
Board Awards to recognize all of the various arts within the City, and the Halloween event at the
Newland House.
Councilmember Hardy reminded everyone to vote tomorrow if they had not yet.
Councilmember Katapodis attended the Mr. Surf City contest as a contestant and finished 2nd
Runner-up. He added that the event raised approximately $63,000 for many charities, including
the 9/11 Memorial, and he attended the ribbon cutting for the new Living Spaces store on
Edinger at Goldenwest. He acknowledged the recent deaths of two California police officers and
asked everyone to stop and thank the next officer they see for their service.

Mayor Harper thanked all of the volunteers who clean up the wetlands and replace pickle weed
through the California Resources Corporation; he participated in the Surf City 10 Mile/10K Run;
attended the Anaheim Mayors' Prayer Breakfast with special guest Amy Grant; also attended
the Living Spaces ribbon cutting, the Downtown HB Halloween celebration family -friendly event,
the Newland House Halloween event, as well as the Sunset Beach Community Center
Halloween event. He also just participated in the "Roadeo" at OCTA's closest terminal on
MacArthur Blvd. which serves Huntington Beach where the drivers and mechanics, as well as
board members, drove a course to showcase their skills.
Mayor Harper also invited people to attend the Veterans Day Ceremony at 11 a.m. at Pier
Plaza to recognize all veterans, and encouraged attendance at the Veterans Day car show at
Huntington City Beach from 9 - 3.
Mayor Harper summarized various recent/ongoing City projects, including the popular Van's
skate park near Old World, Bella Terra and Goldenwest College; the upcoming ground breaking
for the new Senior's .Center & thanked Councilman Sullivan for his persistence on behalf of this
project; the recent Robin Samsoe Plaque to recognize victims' rights; stopping the Styrofoam
ban; modifying over 6 ordinances covering various issues; and ensuring the safe and sane
fireworks issue will be determined by City residents. He noted that more Huntington Beach
residents vote than in any other city in Orange County and Mayor Harper challenged Huntington
Beach residents to continue meeting that milestone. He ended by expressing his appreciation
for being allowed to serve as Mayor for the past year and Councilmember for the past four
years.
