Neither the City nor the City Council endorses any particular religious belief or form of invocation. AWARDS AND PRESENTATIONS Mayor Katapodis acknowledged November as National Diabetes Awareness Month to bring attention to the impact of diabetes and provide educational opportunities for managing this disease. Mayor Katapodis called on Victoria Alberty to present the Adoptable Pet of the Month, Zeus, a Terrier mix. Additional details on Zeus, or other adoptable pets, can be found at www.waggintrails.org. Mayor Katapodis presented a commendation to members of the recent Veterans Honor Ride, a very successful event with 136 participants, which started at the Huntington Beach Pier. Representatives of the group provides[ certificates of appreciation for the support of various City departments. Mayor Katapodis presented commendations to the 2017 Miss Huntington Beach Jena Jean Farris and her court, first runner-up Sophia Silveria, and second runner-up Tia Giron. Council/PFA Regular Minutes November 21, 2016 Page 2 of 12 Mayor Katapodis recognized athletes from the Ocean View High School Cross Country team for qualifying for CIF Finals. ANNOUNCEMENT OF SUPPLEMENTAL COMMUNICATIONS (Received After Agenda Distribution) Pursuant to the Brown "Open Meetings" Act, City Clerk Robin Estanislau announced supplemental communications that were received by her office following distribution of the Council agenda packet: Administrative Public Hearing Item No. 13, two items: 1) Revised Sales Tax Sharing Agreement submitting a correction to Section 2.1 on page 3 and signatures on page 9; and revised Agreement Declaring Conditions, Covenants and Restrictions for Property submitting a Legal Description as Exhibit A and signatures on page 3; and 2) a PowerPoint presentation submitted entitled Sales Tax Sharing Agreement Subaru Dealership. Councilmember Items, Item No. 15, six (6) email communications were received from: Gino J. Bruno, Michael Daly, James F. and Claire Y. Kirk, Joseph Mastropaolo, Cad Swan, and Carol Woodworth Mayor Pro Tem Sullivan announced that he is withdrawing from consideration Item #15 regarding formation of districts for City Council elections. He shared that Article III of the City Charter states "elected from the City at large" and that more recently the voters have already opposed the formation of districts. He closed his remarks by stating that pulling this item does not mean he has changed his position on the issue. PUBLIC COMMENTS (3 Minute Time Limit) — 7 Speakers The number [hh:mm: ss] following the speakers' comments indicates their approximate starting time in the archived video located at http.//www.surfcity-hb.org/government/agendas. Susan Welfringer, Huntington Beach Downtown Business Improvement District (HBDBID) Manager, was called to speak and shared that because of the steady rain on Sunday, November 20, the Tree Lighting Celebration has been postponed to Sunday, November 27, at 4 p.m. She also reminded the community of Small Business Saturday, November 26, and the Light the Light of Love event on Sunday, December 4. (00:31:48) Amory Hanson was called to speak and shared his support for Councilmember Items, Item No. 14, a plan to open the Huntington Central Library on Sundays. (00:34:58) Victor Valladares was called to speak and expressed his appreciation for code enforcement actions over the weekend in Oak View. He also shared a map that shows over 43 multi -family Oak View dwellings with underserved garbage receptacles (receptacles that are too small, and/or with not enough garbage pick-ups) and asked for the Council's continued efforts to make the necessary changes for this public nuisance. (00:36:36) Andrew Valladares, young son of Victor Valladares, was called to speak and stated he is happy to report that Rainbow Environmental has agreed to enclose certain collection areas, and he will be able to breathe fresh air. (00:38:46) Council/PFA Regular Minutes November 21, 2016 Page 3 of 12 Barbara Robinson was called to speak and expressed her appreciation and honor for Mayor Katapodis, and Councilmembers Delgleize and Posey for their participation and support of lake Park and preserving green space for public use which, to her, shows support for preserving quality of life for the future. (00:39:27) Catherine Johnson was called to speak and shared her appreciation for Mayor Katapodis and his comments at the recent Lake Park dedication about preserving the green space and history of Huntington Beach for public use. (00:41:33) Gina Clayton-Tarvin, President, Ocean View School District (OVSD) Board of Trustees, was called to speak and thanked the Ocean View residents who re-elected her and also passed Measure R, the general obligation bond to fix the schools and fields. She also announced that the OVSD has reached a complete and final resolution for their litigation against Rainbow Environmental, and described some of the details. (00:42:23) COUNCIL COMMITTEE - APPOINTMENTS - LIAISON REPORTS, AB 1234 REPORTING, AND OPENNESS IN NEGOTIATIONS DISCLOSURES Councilmember Posey announced his appointment of Michelle Schultz to the Community Services Commission to replace Jerry Moffatt who resigned. Councilmember Delgleize announced her appointment of John Scandura to the Planning Commission to replace Patrick Brenden who has been unofficially elected to City Council. Mayor Katapodis reported attending Orange County Sanitation District (OCSD) and Orange County Transportation Authority (OCTA) meetings. CITY MANAGER'S REPORT City Manager Fred Wilson introduced Mike McCabe of Air Support LLC, who provided an overview of the 2016 Breitling Huntington Beach Air Show. Mike McCabe thanked City staff and the community for their support of the Breitling Air Show, and presented a video highlighting the event. Mayor Katapodis presented a certificate of appreciation to Mike McCabe on behalf of the City Council. A Public Safety Recap was also provided. Police Chief Robert Handy and Fire Chief David Segura both reported a great, safe and successful event thanks to the cooperation of various City departments with fifteen (15) other local law enforcement and safety agencies. Councilmember Hardy recognized some of the concerns expressed by members of the community, and there was discussion on increasing advertising next year to create more public awareness of the event. It may not be possible to minimize noise as planes fly over the residential community, but that issue will be looked at to see if anything can be changed. It was also suggested that all the area schools be notified of the schedule ahead of time so as not to have any testing scheduled during the flight practice on Friday. Councilmember Delgleize thanked Mr. McCabe for the successful event and keeping his word on what activities were to take place. Council/PFA Regular Minutes November 21, 2016 Page 4 of 12 Mayor Katapodis shared that the letters he received from elementary students expressed delight at the Air Show with the request to do it again next year. CONSENT CALENDAR Councilmember Hardy requested to pull Item No. 4, suggesting that the voting results for Councilmember Item Nos. 16 and 17 may require that the regularly scheduled meeting of December 6, 2016 be held. Councilmember Posey pulled Item No. 9 to commend those responsible for this Item. A motion was made by Hardy, second Peterson to consider Consent Item No. 4 after action is taken Councilmember Item No. 17. Approved and adopted Minutes A motion was made by Posey, second Hardy to review and adopt the City Council/Public Financing Authority regular meeting and the Housing Authority special meeting minutes dated November 7, 2016, as written and on file in the office of the City Clerk. Received and filed City of Huntington Beach Strategic Plan Updates A motion was made by Posey, second Hardy to receive and file the Six -Month Strategic Objectives. Approved appointments to the Design Review Board (DRB) as recommended by City Council Liaisons Mayor Pro Tern Sullivan and Councilmember Peterson A motion was made by Posey, second Hardy to approve the appointment of i-illi Cutler and Mariana Morris to the Design Review Board for a 4-year term to expire on December 31, 2020. The motion carried by the following vote: AYES: Posey, O'Connell, Sullivan, Katapodis, Hardy, Delgleize, and Peterson NOES: None 4. Denied Resolution No. 2016-84 authorizing the cancellation of the City Council/Public Financing Authority regular meeting of December 5, 2016; and, direct the City Clerk to provide notice of such cancellation Councilmember Hardy requested that Councilmembers consider holding the regular meeting of December 5 so that Mayor Katapodis and Mayor Pro Tem Sullivan could participate in voting on resolutions to adopt an official City flag, and the Miss Huntington Beach Pageant, directed by the Sand Dollars of Huntington Beach. In addition, she strongly supports a new tradition of having a City Council meeting on the second Monday of December with the sole order of business being the change to the new Council. A motion was made by Hardy, second Peterson to deny Resolution No. 2016-84, "A Resolution of the City Council of the City of Huntington Beach Declaring the Cancellation of the City Council and Public Financing Authority Meeting of December 5, 2016; and Directing the City Clerk to Provide Notice of Such Cancellation." The motion carried by the following vote: AYES: Posey, O'Connell, Sullivan, Katapodis, Hardy, Delgleize, and Peterson NOES: None 5. Adopted Resolution No. 2016-72 authorizing cancellation of the City Council/Public Financing Authority regular meeting of January 2, 2017; and, directed the City Clerk to provide notice of such cancellation A motion was made by Posey, second Hardy to adopt Resolution No. 2016-72, "A Resolution of the City Council of the City of Huntington Beach Declaring the Cancellation of the City Council and Public Financing Authority Meeting of January 2, 2017; and Directing the City Clerk to Provide Notice of Such Cancellations." Adopted Resolution No. 2016-73 amending the City's Code of Ethics by clarifying the process for filing Acknowledgement of Receipt forms A motion was matte by Posey, second Hardy to adopt Resolution No. 2016-73, "A Resolution of the City Council of the City of Huntington Beach Amending the City's Code of Ethics." The motion carried by the following vote: AYES: Posey, O'Connell, Sullivan, Katapodis, Hardy, Delgleize, and Peterson NOES: None 7. Approved and authorized execution of a Five -Year Maintenance Services Contract with West Coast Arborists, Inc. (WCA) for As -Needed Tree Maintenance Services A motion was made by Posey, second Hardy to approve and authorize the Mayor and City Clerk to execute the "Maintenance Services Contract Between the City of Huntington Beach and West Coast Arborists, Inc. for Tree Maintenance Services" for as needed Tree Maintenance Services in an amount not to exceed $1,063,500 annually or $5,317,500 cumulatively over the five year term; and, authorize the City Manager to execute all documents in furtherance of this Agreement. The motion carried by the following vote: AYES: Posey, O'Connell, Sullivan, Katapodis, Hardy, Delgleize, and Peterson NOES: None 8. Adopted Resolutions requesting authorization by the City and approval from California Department of Transportation (Caltrans) for temporary closure of streets for certain special events in 2017 A motion was made by Posey, second Hardy to adopt Resolution No. 2016-77, "A Resolution of the City Council of the City of Huntington Beach Authorizing the Closing of Main Street and 5th Street to Vehicular Traffic for Certain Special Events;" and, adopt Resolution No. 2016-78, "A Resolution of the City Council of the City of Huntington Beach Approving the Temporary Closure of 12th Street in Sunset Beach for the Annual Sunset Beach Art Festival and Halloween Party;" and, adopt Resolution No. 2016- 79, "A Resolution of the City Council of the City of Huntington Beach Requesting Caltrans Approve the Closing of Pacific Coast Highway and Certain Ingress and Egress for the Surf City USA Marathon Run;" and, adopt Resolution No. 2016-80, "A Resolution of the City Council of the City of Huntington Beach Approving the Temporary Closure of Portions of Goldenwest Street, Garfield Avenue, Huntington Street, Twin Dolphin Drive, Edwards Street, Ellis Avenue, Talbert Avenue, Seapoint Street, Inlet Drive, Overlook Drive, Summit Drive, Varsity Drive, Main Street, Walnut Avenue, and Central Park Drive for the Surf City USA Marathon Run;" and, adopt Resolution No. 2016-81, "A Resolution of the City Council of the City of Huntington Beach Requesting Caltrans Approve the Closing of Pacific Coast Highway and Certain Ingress and Egress Within the City of Huntington Beach for the Annual Surf City 10 Run;" and, adopt Resolution No. 2016-82, "A Resolution of the City Council of the City of Huntington Beach Requesting Caltrans Approve the Closing of Pacific Coast Highway for the Huntington Beach Fourth of July Parade and Fireworks;" and, adopt Resolution No. 2016-83, "A Resolution of the City Council of the City of Huntington Beach Authorizing Street Closure for the Fourth of July." Approved and authorized execution of a three-year License Agreement between the City and Fare Share Enterprises for coin operated telescopes on the Pier Councilmember Posey pulled this item to commend community member Kim Kramer for making him aware of the deteriorating condition of the Pier telescopes, and to acknowledge the efforts that Director of Community Services Janeen Laudenback and her staff put into a new contract ensuring new telescopes. A motion was made by Posey, second Delgleize to approve and authorize the Mayor and City Clerk to execute the "License Agreement between the City of Huntington Beach and Fare Share Enterprises for Coin Operated Telescopes on Huntington Beach Pier." The motion carried by the following vote: AYES: Posey, O'Connell, Sullivan, Katapodis, Hardy, Delgleize, and Peterson NOES: None 10. Approved, authorized execution and recordation of a Mills Act Agreement between the City and Dru Ann Joyce McCluskey for the purpose of providing property tax relief for owners of qualified properties who wish to use the savings to preservelrepair their historic property (912 10th Street) A motion was made by Posey, second Hardy to approve and authorize the Mayor and City Clerk to execute the "Historic Property Preservation Agreement Containing Covenants, Conditions, and Restrictions Affecting Real Property By and Between the City of Huntington Beach and Dru Ann Joyce McCluskey for the Real Property Located at 912 10th Street Within the City of Huntington Beach (Mills Act Contract);" and, direct the City Clerk to record the applicable documents with the County of Orange Recorder's Office. Adopted Ordinance No. 4104 amending Municipal Code 14.12.010 to replace the 2012 Water Master Plan Approved for introduction November 7, 2016 - Vote. 7-0 A motion was made by Posey, second Hardy to adopt Ordinance No. 4104, "An Ordinance of the City of Huntington Beach Amending Chapter 14.12 of the Huntington Beach Municipal Code Pertaining to Water Fees," to replace with the 2016 Water Master Plan. Approved for Introduction Ordinance No. 4126 approving Development Agreement No. 16- 002 with Bonanni DevelopmentlJB Construction for the Bonanni Garfield Condominiums (Southeast corner of Garfield and Gothard) City Manager Wilson introduced John Ramirez, Assistant Planner in Community Development, who gave a PowerPoint presentation entitled Development Agreement No. 16-002 (Garfield Condominiums) with slides entitled Project Request, On October 11, 2016 the Planning Commission Approved:, PC and Staff Recommendation, and Questions. Councilmember Hardy and staff discussed that municipal code and state law prohibit using a unit twice when calculating the density bonus, therefore the calculation is computed on only nine (9) units for this Holly Seacliff Specific Plan project. Mayor Pro Tern Sullivan and Deputy Director Keliee Pritzal discussed how affordable units are determined, how in -lieu fees are calculated and how the in -lieu fees are used by the City. Mayor Katapodis opened the Public Hearing Pursuant to the Brown "Open Meetings" Act, City Clerk Robin Estanislau announced receipt of supplemental communication, a PowerPoint entitled Development Agreement No. 16-002 (Garfield Condominiums). Ed Bonanni, Bonanni Development (applicant), was called to speak and shared that this project has been in progress for over three years, and he urged Council's support. (01:10:06) Mr. Bonanni and Mayor Pro Tern Sullivan discussed that Bonanni Development needs the option to sell, rather than just rent, the units. With no more speakers, or further public questions or comments, Mayor Katapodis closed the Public Hearing. Councilmember Hardy and staff discussed that if or when the units do sell, the affordable housing unit would then become part of the City's affordable housing stock, and the clock would start at the time of sale for a 45-year term. Councilmember Hardy shared her opinion that regardless of state law, all 10 units should be considered in determining the density bonus, and stated she would not support the item Councilmember O'Connell and staff discussed that this parcel is vacant land that is currently providing no property tax, is a decent project that fits into the neighborhood, and that the project meets state law requirements. (01:15:23) A motion was made by O'Connell, second Sullivan to approve Development Agreement No. 16-002 with findings for approval; and, after the City Clerk reads by title, approve for introduction Ordinance No. 4126, "An Ordinance of the City of Huntington Beach Adopting a Development Agreement by and Council/PFA Regular Minutes November 21, 2016 Page 9 of 12 Between the City of Huntington Beach and Bonanni Development/JB Construction Development Agreement No. 16-002." The motion carried by the following vote: AYES: Posey, O'Connell, Sullivan, Katapodis, Delgleize, and Peterson NOES: Hardy ADMINISTRATIVE PUBLIC HEARING 13. Approved and authorized execution of a Sales Tax Sharing Agreement between the City and McKenna Motors Huntington Beach, Inc., for the opening of a new Subaru Dealership City Manager Fred Wilson introduced Deputy Director of Economic Development Kellee Fritzal who presented a PowerPoint entitled Sales Tax Sharing Agreement Subaru Dealership with slides entitled Agreement, Financials, Subaru Agreement - McKenna, and Questions. Councilmember O'Connell and staff discussed that there will be 50 temporary new jobs during construction and 85 new full and part-time jobs as a result of the new dealership. Mayor Katapodis opened the Public Hearing. City Clerk Robin Estanislau announced there were no speakers signed up for this item. Mayor Katapodis closed the Public Hearing. Councilmember Peterson thanked the Office of Economic Development for working with McKenna Motors and the City Manager's Office to make this agreement work which, in his opinion, is the best use of this property. Councilmember Hardy echoed Councilmember Peterson's comments, and also thanked the Councilmembers who made a change to the Beach Edinger Corridor Specific Plan. Councilmember Delgleize also applauded those responsible for the hard work necessary to make this agreement possible, an agreement which is better for McKenna as well as the City. Mayor Pro Tern Sullivan voiced his appreciation to everyone involved, especially Mr. McKenna for purchasing the land. Mayor Katapodis shared is appreciation for everyone working together to reach this very good end result. A motion was made by O'Connell, second Posey to approve and authorize the Mayor and City Manager to execute the "Sales Tax Agreement Between the City of Huntington Beach and McKenna Motors Huntington Beach, Inc."; and, increase appropriation as revenue is received above the base to pay for City's share of the Sales Tax Sharing Agreement; and, authorize the City Manager or designee to execute any additional documents required to further the Agreement. Item submitted by Mayor Pro Tern Sullivan approved to direct staff to return with a plan to open the Central Library on Sundays Mayor Pro Tern Sullivan introduced the item and explained that providing Sunday hours in the past was profitable for the Central Library, and how for many residents, Sunday may be the only day to access the Library's resources. Councilmember Hardy expressed her support for this item. Library Director Stephanie Beverage shared the reality that currently there is 25% less staff than when the Central Library previously provided Sunday hours, and preparing a plan for the December 19th meeting might be a bit difficult. Mayor Pro Tern Sullivan amended the motion to present the plan at the January 17, 2017, regular City Council meeting. Mayor Katapodis shared that his discussions on this topic with high school students showed that Sunday afternoon hours are preferred, and asked that staff reach out to high school and elementary students for Input on this. A motion was made by Sullivan, second O'Connell to direct staff to bring forward a plan to open the Central Library on Sundays for City Council consideration at the January 17, 2017, regular City Council meeting. The motion carried by the following vote: AYES: Posey, O'Connell, Sullivan, Katapodis, Hardy, Delgleize, and Peterson NOES: None 15. WITHDRAWN FROM CONSIDERATION. Submitted by Mayor Pro Tern Sullivan - Districting Position Confirming At Large election of City Councilmembers 16. Item submitted by Councilmember Hardy approved to direct staff to prepare a resolution to recognize the flag in the Council Chambers as the Huntington Beach Official Flag Councilmember Hardy explained how she became aware that the City Council had never officially recognized an official City flag (with the Huntington Beach logo rather than the City Seal), and would like to see a resolution presented at the December 5 regular City Council meeting so that the current Council members can vote on this Item. A motion was made by Hardy, second Posey to direct staff to prepare a resolution recognizing the flag in the Council Chambers as the City's official flag, as amended to present at the December 5 regular City Council meeting. Item submitted by Councilmembers Peterson and Hardy approved to officially recognize the Miss Huntington Beach Pageant directed by the Sand Dollars of Huntington Beach as the official pageant and the annual winner as the official Miss Huntington Beach Councilmembers Hardy and Peterson explained that traditionally the Miss Huntington Beach pageant, as presented by the Sand Dollars of Huntington Beach, and the Miss America Organization have focused on community service and scholarships and that they would like to see this officially recognized and documented to preserve the focus. A motion was made by Hardy, second Peterson to formally recognize the Miss Huntington Beach Pageant, directed by the Sand Dollars of Huntington Beach, as the official pageant and the annual winner as the official Miss Huntington Beach. If Sand Dollars wishes to be an affiliate of a state or national program, that it will be with the Miss America Organization, as amended to direct staff to prepare a resolution for presentation at the regularly scheduled City Council meeting of December 5, 2016. The motion carried by the following vote: AYES: Posey, O'Connell, Sullivan, Katapodis, Hardy, Delgleize, and Peterson NOES: None COUNCILMEMBER COMMENTS (Not Agendized) Councilmember O'Connell reported attending the 20 Year Interfaith Council Celebration event, the 2016 Presidential Election Day Luncheon, the Annual Tip A Cop Fundraising Drive, the City Selection Committee Meeting, the Veterans Day Car Show, the Veterans Day Ceremony at Pier Plaza, the opening of Bluegold Restaurant by DJM Capital Partners, Inc., the Association of California Cities - Orange County (ACC-OC) Thanksgiving Reception, the Building Industry Association - Orange County (BIAOC) Affordable Housing Committee Workshop, the OCTax - Fall 2016 Election Wrap -Up, the Orange County Business Council (OCBC) 6th Annual "Turning Red Tape into Red Carpet" Awards and Reception, the RJ Mayer Celebration of the Topping Off of the all new Twin Dolphin Tower at the Hilton, and he closed with a shout -out for the Huntington Beach Chamber of Commerce for the AM Connect event and the City's businesses for keeping the City rolling and replenishing the treasury.
