Dunn, Fritzal, Hardy ABSENT: Bone, Delgado, A. Dunn PLEDGE OF ALLEGIANCE: Led by Councilmember Hardy SUPPLEMENTAL COMMUNICATIONS: None. PUBLIC COMMENTS: This is the portion of the meeting for any member of the public to address the Oversight Board on any matter that is within the subject matter jurisdiction of the board. The Brown Act, with limited exception, does not allow the board or staff to discuss unagendized issues brought forth under Public Comments. Comments should be limited to 3 minutes per person. None. GENERAL COUNSEL'S REPORT: Oversight Board General Counsel presented an update on the City's conflict with, and introduction of legal action against, the CA Department of Finance. General Counsel, Michael Gates, described his receipt of City Council support to challenge the CA DOF on its recent decisions to deny this Oversight Board's approval of the reimbursement of State Redevelopment Obligations worth $72MM. At the Oversight Board meeting, Mr. Gates distributed copies of an August 24, 2017 Letter he sent to the California State Governor and members of the DOF in reply to the DOF's May 17, 2017 letter regarding Oversight Board's Resolution Nos. 2017-15 through 2017-26, and May 17, 2017 letter regarding the 2017-2018 Annual Recognized Obligation Payment Schedule (ROPS). Counsel Gates acknowledged receipt of an email on September 9, 2017 from the DOF that confirmed receipt of the August 24 letter, and called for additional time to provide a written response. He discussed actions involved in filing a claim and/or lawsuit, and in response to Member L. Dunn, explained why the Oversight Board should expect to be named as a "nominal defendant," unless there were any Oversight Board objections to do so, should future litigation occur on the matter. No objections were made and the Oversight Board concurred with the City and City Attorney's plan to move against the DOF for recovery of the $72MM in owed reimbursements. BUSINESS: 1. Adopted Oversight Board Resolution No. 2017-27 approving the Amended Recognized Obligation Payment Schedule (ROPS) for the Huntington Beach Successor Agency for the period of January 1, 2018 through June 30, 2018 ("ROPS 17-18"), in accordance with Health and Safety Code Section 34177 and related actions Sunny Han, Finance Project Manager, reviewed the County's property tax assessments for Bella Terra I and II, resulting in increased debt service payments of $2.96M for Bella Terra I, and $864k for Bella Terra II, in the ROPS 16-17 and 17-18 periods. A motion was made by Hardy, second L. Dunn, to adopt Resolution No. 2017-27, "A Resolution of the Oversight Board of the Successor Agency to the Redevelopment Agency of the City of Huntington Beach Approving the Amended Recognized Obligation Payment Schedule for the Period of January 1, 2018 Through June 20, 2018 ("ROPS 17-18"). The motion carried by the following vote: AYES: Delgleize, L. Dunn, Fritzal, Hardy NOES: None ABSENT: Bone, Delgado, A. Dunn 2. Approved and adopted the minutes of the Oversight Board Special Meeting of April 13, 2017 A motion was made by Fritzal, second Hardy, to approve and adopt the minutes of the Oversight Board Special Meeting of April 13, 2017, as written and on file in the office of the Secretary of the Board. The motion carried by the following vote: AYES: Delgleize, L. Dunn, Fritzal, Hardy NOES: None ABSENT: Bone, Delgado, A.
