PUBLIC COMMENTS PERTAINING TO STUDY SESSION / CLOSED SESSION ITEMS (3 Minute Time Limit) — None 401by&4*1*91i'. 19-042 Joint Study Session held between the City Council and the Investment Advisory Board (IAB). The IAB and City Treasurer made a presentation of the 2018 Annual Report as it relates to the City of Huntington Beach's investment management. Roll Call of the Investment Advisory Board: Present: Rob Sternberg, Jennifer Handy, Scott Dowds, John Piekarski, and Syndia Attardo Absent: A. J. DeLiberto and Mark Ellett A PowerPoint communication was presented by Board Member Sternberg titled: Joint Study Session, Investment Advisory Board/Huntington Beach City Council with slides entitled: City of Huntington Beach Council/PFA Regular Minutes February 4, 2019 Page 2 of 13 Investment Advisory Board, Investment Advisory Board Members, Investment Advisory Board Meetings, and 2018 Annual Report (3). 2. 19-125 Police Department Update on Crime Statistics for 2018, Management Partners Update, and Strategic Plan Police Chief Handy, Crime Analyst Julie Romano, and Assistant Chief of Police Kelly Rodriguez, presented a PowerPoint communication entitled: Police Department Update, with slides entitled: 2018 Part 1 Crimes, Robberies in Huntington Beach, Aggravated Assaults in Huntington Beach, Burglaries in Huntington Beach, Arrests in Huntington Beach and Questions? Councilmember Posey and Police Chief Handy discussed procedures related to arrests. Councilmember Delgleize and Police Chief Handy discussed that when category definitions change, it usually increases the numbers. Councilmember Brenden and Police Chief Handy discussed current challenges, and the fact that arrest rates were up, and crime rates are down. Chief Handy explained that technology is important to support the great efforts of department staff. The second half of the PowerPoint communication titled Management Partners Update, contained slides titled: Management Partners Update Report on HBPD 2018, Management Partners Update(3), Huntington Beach Police Strategic Plan 2019-2023, Strategic Plan Process, Department Steering Committee, Our Mission Statement, Vision Statement, Value Statements, Strategic Plan Goals and Questions. Chief Handy thanked Council for their support and encouragement, and specifically for bringing in Management Partners. Chief Handy described the positive changes throughout the department and detailed the Strategic Plan process. Councilmember Brenden and Chief Handy discussed some of the costs involved for equipment upgrades, staff training and consultants throughout the process of implementing the Management Partners recommendations. Minzak Malik, Vice President, Board of Directors, and Ken Inouye, President, shared details on programming that was available exclusively to Huntington Beach, including teaching respect, tolerance and diversity in a school setting. A commendation certificate was presented to Mayor Peterson. (01:23:16) Henry Draper, a landscaper new to Huntington Beach, was called to speak and stated his support for the idea of planting fruit trees in the City. (01:23:43) KC Fockler, resident of Huntington Beach and representing S.A.M.E., was called to speak and shared concerns regarding the Environmental Impact Report (EIR) for the Magnolia Tank Farm project. (01:24:35) David Geddes, a 31-year resident, was called to speak and shared his concerns regarding situations that in his opinion negatively impact efforts to keep Huntington Beach a place where people want to live, work and play. (01:27:44) Kathryn Levassiur, a 20-year resident, was called to speak and shared her opinions on the issue of Short Term Vacation Rentals and encouraged the City to implement processes to regulate and tax a service that many residents are already providing. (01:29:49) Jeremy Krout, planning and environmental specialist working on the Magnolia Tank Farm project, was called to speak and encouraged concerned residents to attend upcoming public meetings for this project, as well as to consult with project and City staff with questions and concerns. (01:31:37) Ben Pickens was called to speak and shared some ideas regarding alternate uses of the Magnolia Tank Farm land. (01:34:44) COUNCIL COMMITTEE - APPOINTMENTS - LIAISON REPORTS, AB 1234 REPORTING, AND OPENNESS IN NEGOTIATIONS DISCLOSURES Councilmember Posey thanked his colleagues for voting to keep him on the Orange County Council of Governments (OCCOG) where he was approved to serve on a Community Economic Housing Development Policy Committee; announced a new app from the Air Quality Management District (AQMD) called "Connected to Clean Air'; provided a report on the recent Association of California Cities - Orange County (ACC-OC) Advocacy Trip to Washington, DC; and, announced that Orange County Supervisor Michelle Steel re -appointed him as a member of the Orange County Parks Commission for a four-year term, and that he was voted in as Chair by the Commission. Councilmember Brenden reported he and Councilmember Delgleize completed interviewing thirteen (13) applicants for the seven -member Jet Noise Commission that will hold its first meeting, open to the public, on February 25, 5:30 p.m. at the Central Library; and, he attended a Huntington Beach Chamber of Commerce Legislative Affairs Committee meeting. Councilmember Carr reported attending a League of California Cities New Mayors and Council Members Academy; meeting with members of the Huntington Beach Firefighters' Association (HBFA); and, receiving messages from the Huntington Beach Police Officers' Association (HBPOA). Council/PFA Regular Minutes February 4, 2019 Page 6 of 13 Councilmember Delgleize reported attending the ACC-OC Washington, DC Advocacy Trip; receiving and sending messages with the Huntington Beach Police Officers' Association (HBPOA); announced that the Orange County Transit Authority (OCTA) is focused on improving conditions where the 22 Freeway meets with the 5 and 57 Freeways and will be holding public meetings on this project; provided an update on the OCTA county -wide signal synchronization project; and announced completion of OCTA's Bravo 529, a faster route for traversing Beach Boulevard from Pacific Coast Highway to Fullerton. Mayor Pro Tern Semeta reported attending a recent Visit FIB Board meeting, and a meeting of Orange County Council of Governments (OCCOG). Mayor Peterson reported a leadership change at the Orange County Sanitation District (OCSD) and that he continues serving on the Administration Committee was appointed to the Ground Water Replenishment System (GWRS) Steering Committee, and the Headquarters Ad Hoc Committee. CITY MANAGER'S REPORT — None CITY TREASURER'S REPORT 9. 19-121 Received and filed the City Treasurer's December 2018 Quarterly Investment Summary Report City Treasurer Backstrom presented a PowerPoint communication entitled: City of Huntington Beach Quarterly Treasurer's Report with slides entitled: Economic and Market Overview - At 12131118, Interest Rates - 2-year/5-year/10-year Treasury, Treasurer's Mission, Portfolio Summary, Investments by Type, Monthly Portfolio Earnings, Portfolio Earnings - as of 12/31/2018, and Compliance. Councilmember Carr and City Treasurer Backstrom discussed in further detail the considerations for rebalancing securities. A motion was made by Carr, second Delgleize to receive and file the City Treasurer's Quarterly Investment Report for December 2018, pursuant to Section 17.0 of the Investment Policy of the City of Huntington Beach. The motion carried by the following vote: AYES: Peterson, Semeta, Carr, Delgleize, Hardy, and Posey NOES: None OUT OF ROOM: Brenden Council/PFA Regular Minutes February 4, 2019 Page 7 of 13 CITY ATTORNEY'S REPORT 11. 19-145 PETITION FOR WRIT OF MANDATE AND COMPLAINT FOR DECLARATORY RELIEF - California Department of Housing and Community Development, Petitioner and Plaintiff, v. City of Huntington Beach; City Council of Huntington Beach; Case No. 30-2019-01046493-CU-JR-CJC. Judge Sheila Fell. City Attorney Gates reported that in Closed Session the City Council, by a unanimous vote of 7-0, acted to defend the above -mentioned lawsuit. Additionally, City Attorney Gates reported a previous vote of 6-1 to authorize the City Attorney's office to file a lawsuit against the State concerning a challenge to SB 166, which requires the City to immediately comply with RHNA mandates. That case was filed on February 1s' in the Orange County Superior Court, entitled City of Huntington Beach v. State of California, case number 30-2019-01048692-CV-WM-CJC. CITY CLERK'S REPORT 12. 19-157 City Clerk provided information on the Laserfiche data conversion affecting public records located in the Online Records Library City Clerk Estanislau described some changes related to the recent data conversion to Laserfiche affecting documents in the Online Records Library. She provided images the public will now see when they look for public records at huntingtonbeachca.gov/government/records, and explained that the project is in process, and elements like a Google search engine will be forthcoming. She invited anyone having difficulty searching the City's public record files contact to the City Clerk's office for assistance. Councilmember Semeta pulled for discussion Consent Calendar Item No. 18 19-118 regarding expediting the Permit Process for Electric Vehicle (EV) Charging Stations on Private Property. City Clerk Estanislau announced a correction for Consent Calendar Item No. 17 19-111 which should refer to the Huntington Beach City ElemeRtaFy School District. 13. 19-112 Approved and Adopted Minutes A motion was made by Posey, second Semeta to approve and adopt the City Council/Public Financing Authority regular meeting and Special Meeting of the Successor Agency minutes dated January 22, 2019, as written and on file in the Office of the City Clerk. The motion carried by the following vote: AYES: Brenden, Carr, Semeta, Peterson, Posey, Delgleize, and Hardy NOES: None Council/PFA Regular Minutes February 4, 2019 Page 8 of 13 14. 19-131 Approved the appointments of Keith Bohr, Phil Burtis, Jeff Morin, Chris Kunze, Michael Bourgeault, David Porter, and Mario Tabernig to the newly established Jet Noise Commission with terms to expire 12/3112022 Councilmember Brenden pulled this item to acknowledge the seven (7) individuals being recommended for appointment to the Jet Noise Commission, and to thank Councilmember Delgleize for being involved in the process. A motion was made by Brenden, second Delgleize to approve the appointments to the Jet Noise Commission as approved by Council Liaisons, Councilmembers Brenden and Delgleize, for Keith Bohr, Phil Burtis, Jeff Morin, Chris Kunze, Michael Bourgeault, David Porter, and Mario Tabernig. These terms will expire on December 31, 2022. The motion carried by the following vote: AYES: Brenden, Carr, Semeta, Peterson, Posey, Delgleize, and Hardy NOES: None 15. 19-127 Approved Modifications to the Ambulance Operator Employment Agreement Reflecting Changes Related to the California Minimum Wage Effective January 1, 2019, through January 1, 2022 A motion was made by Posey, second Semeta to approve Modifications to the Ambulance Operator Employment Agreement Reflecting Changes Related to the California Minimum Wage Effective January 1, 2019. The motion carried by the following vote: AYES: Brenden, Carr, Semeta, Peterson, Posey, Delgleize, and Hardy NOES: None 16. 19-034 Approved and authorized the execution of Amendment No. 1 to the Cooperative Agreement with the Orange County Transportation Authority for the Traffic Signal Synchronization Project along Adams Avenue and Appropriate $30,000 in Matching Funds for the Project (CC-1482) A motion was made by Posey, second Semeta to approve and authorize the Mayor and City Clerk to execute "Amendment No. 1 to Cooperative Agreement No. C-3-2086 between Orange County Transportation Authority and The Cities of Huntington Beach and Costa Mesa for The Adams Avenue Regional Traffic Signal Synchronization Project" funded as part of the Measure M2 Regional Traffic Signal Synchronization; and, appropriate $30,000 from the AQMD Undesignated Fund Balance to project account 20190011.82700. The motion carried by the following vote: AYES: Brenden, Carr, Semeta, Peterson, Posey, Delgleize, and Hardy NOES: None Council/PFA Regular Minutes February 4, 2019 Page 9 of 13 17. 19-111 Approved and authorized the execution and recordation of an Easement, Construction and Maintenance Agreement with HB Homes Management, LLC and the Huntington Beach City Elementary School District for the LeBard Redevelopment Project at 20461 Craimer Lane A motion was made by Posey, second Semeta to approve and authorize the Mayor and City Clerk to execute the "Easement, Construction and Maintenance Agreement Regarding Tract Map No. 17801," between the City, HB Homes Management, LLC and the Huntington Beach City Ele.meRta School District to provide easements, construction of certain park improvements and maintenance of landscaping/park improvements related to certain water quality and drainage features in the LeBard Redevelopment Project. Instruct the City Clerk to record said "Easement, Construction and Maintenance Agreement Regarding Tract Map No. 17801" (and attachments) with the Orange County Recorder. The motion as amended carried by the following vote: AYES: Brenden, Carr, Semeta, Peterson, Posey, Delgleize, and Hardy NOES: None 18. 19-118 Continued to February 19, 2019 — Request to adopt Ordinance No. 4166 expediting the Permit Process for Electric Vehicle (EV) Charging Stations on Private Property Approved for introduction January 22, 2019 - Vote: 6-0-1 (Delgleize out of room) Mayor Pro Tern Semeta pulled this item to request that it be amended to clarify that any signage or advertising, with a commercial charging station, must go through the Community Development Department approval process. Mayor Peterson and Community Development Director Luna -Reynosa discussed Council's expectation to have further clarification on Electric Vehicle (EV) Charging Stations signage. Councilmember Brenden and Director Luna -Reynosa discussed the permitting process for existing EV charging stations which were approved under previous guidelines, and Councilmember Brenden requested that this item be continued to the next meeting to allow for those specifics to be presented. A motion was made by Semeta, second Brenden to continue to February 19, 2019 request to Adopt Ordinance No. 4166, "An Ordinance of the City of Huntington Beach Adding Chapter 17.62 to the Huntington Beach Municipal Code Regarding Expedited Electric Vehicle Charging Station Permitting." The motion carried by the following vote: AYES: Brenden, Carr, Semeta, Peterson, Posey, Delgleize, and Hardy NOES: None 19. 19-119 Adopted Ordinance No. 4171 amending the Huntington Beach Municipal Code (HBMC) by updating Chapter 17.56.200 related to emergency responder access to private property Approved for introduction January 22, 2019 - Vote: 7-0 A motion was made by Posey, second Semeta to adopt Ordinance No. 4171, "An Ordinance of the City Council/PFA Regular Minutes February 4, 2019 Page 10 of 13 of Huntington Beach Amending Chapter 17.56.200 of the Huntington Beach Municipal Code Regarding Security Gates." The motion carried by the following vote: AYES: Brenden, Carr, Semeta, Peterson, Posey, Delgleize, and Hardy NOES: None ADMINISTRATIVE ITEMS 21. 18-527 Approved for introduction Ordinance No. 4163 amending Huntington Beach Municipal Code Chapter 5.56 related to Alarm Systems both residential and commercial, burglary alarms; and, continued to February 19, 2019 request to Adopt Resolution No. 2019-07 increasing fees for burglar alarm businesses and alarm system subscribers collected by the Police Department as established pursuant to Resolution No. 6656, and incorporating the increased fees into the Consolidated Comprehensive Citywide Master Fee and Charges Schedule as established by Resolution No. 2016-59, and amended by Resolution Nos. 2017-46, 2018-01, 2018- 29, 2018-48, and 2018-55 (Supplemental Fee Resolution No. 8). City Manager Wilson introduced Police Chief Handy who presented a PowerPoint communication entitled: Huntington Beach False Alarm Program with slides entitled: Previous False Alarm Reduction Discussions, False Alarm Reduction Program (F.A.R.P.), Police Alarm Response, Current Program, Alarm Calls, Inefficient Staff Time, Alarm Permits, Fees and Fines (3), PM AM Corporation, PM AM, Successes of PM AM, Implementation of F.A. R. P., and Questions? Council/PFA Regular Minutes February 4, 2019 Page 11 of 13 Councilmember Delgleize and Chief Handy discussed alarm procedures, and Councilmember Delgleize stated her support for this item. Councilmember Carr recommended a discount on permit fees for seniors, and confirmed with Chief Handy that currently the appeal fee is zero until the issue is resolved. Mayor Pro Tern Semeta stated her support for this program, and especially the education focus. Mayor Peterson and Chief Handy discussed that both the alarm installation and alarm monitoring companies are required to report. Councilmember Posey and Chief Handy discussed false alarm fees, and expectations of a 20% (twenty percent) reduction in false alarm incidents after the program has been implemented for a year. Chief Handy confirmed that the response time is the same whether for commercial or residential alarms and therefore the false alarm fines are the same. A motion was made by Semeta, second Delgleize to, after the City Clerk reads by title, approve for introduction Ordinance No. 4163, "An Ordinance of the City of Huntington Beach Repealing Chapter 5.56 of the Huntington Beach Municipal Code Relating to Burglar Alarms and Adding Back a Revised Chapter 5.56 Relating to the Regulation of Burglar Alarms;" and, continue to February 19, 2019 request to Adopt Resolution No. 2019-07, "A Resolution of the City Council of the City of Huntington Beach Increasing Fees for Burglar Alarm Businesses and Alarm System Subscribers Collected by the Police Department as Established Pursuant to Resolution No. 6656, and Incorporating the Increased Fees Into the Consolidated Comprehensive Citywide Master Fee and Charges Schedule as Established by Resolution No. 2016-59, and Amended by Resolution Nos. 2017-46, 2018-01, 2018-29, 2018-48, and 2018-55 (Supplemental Fee Resolution No. 8)."
