AN ORDINANCE OUTLINING THE POWERS AND DUTIES OF CERTAIN CITY
OFFICERS OF THE CITY OF HUNTINGTON BEACH
The Board of Trustees of the City of Huntington Beach do ordain as follows.
Section 1. The clerk shall keep a record of the proceedings of the Board of
Trustees and of the Board of Equalization; he shall conduct the correspondence of the
Board, prepare, fill out and countersign all blanks and documents to by signed by the
president; charge all sums of money to the officers whose duty it is to collect the same;
give orders for the payment of money into the treasury; keep account of all receipts and
disbursements on behalf of the city; and provide the city officers, through whatever
arrangement the Board may have made for the city printing and supplies, with necessary
books, blanks and stub receipts, requiring them to account for the same.
As clerk he shall keep the various books specified in Section 878 of the Municipal
Corporation Act. As Ex- Officio assessor he shall list all real and personal property in the
City of Huntington Beach for taxation, in the manner prescribed by the state laws and the
ordinances of the Board of Trustees, and shall transcribe the statements into the
assessment roll.
He shall have power to administer all the oaths and affirmations necessary in the
performance of his duties; he shall have charge of and be held responsible for the books,
papers and other property of the city in his office and in that of the Board of Trustees; he
shall report to the Board of Trustees at the first regular meeting in each month, all
receipts and disbursements of the city during the preceding month, and also present an
annual report.
Section 2. The treasurer shall receive, on the orders of the clerk, and safely keep
all money belonging to the city, whatever its source, for which he shall give duplicate
receipts, one to the depositor and the other to the city clerk. He shall establish and keep
the money in the following funds:
HUNTINGTON BEACH CITY FUNDS
1. A general fund, which shall contain all unappropriated money.
2. A current expense fund
3. A salary fund
5. A library fund
6. A pound fund.

Money may be transferred from one fund to another on the order of the Board of
Trustees, except in the cases of the library fund, the money of which shall be used
exclusively for the purpose indicated by its title. The treasurer will pay out money on
behalf of the city only on warrants signed by the president and countersigned by the
clerk.
He shall make quarterly settlements with the clerk; but prior to the first meeting of
each month he shall report to the clerk the balance in each fund; he shall also make an
annual report to the Board of Trustees.
Section 3. The Marshal shall have charge of the Police Department of the city and
it shall be his duty to preserve the peace; He shall have the same powers that are now or
may hereafter be conferred on sheriffs by the laws of the state, and shall be entitled to the
same protections.
He shall have charge of the city jail and prisoners and of any chain-gang which
may be established by the Board of Trustees.
It shall be his duty to prosecute before the recorder all breaches or violations of or
non-compliance with any ordinance which shall come to his knowledge.
He shall collect all licenses imposed and taxes levied by the Board of Trustees,
and deposit the same with the treasurer as soon as collected at the close of each month
file hisaddidavit with the treasurer that the money so paid in is all the money collected by
him during the preceding month.
He shall make a monthly report to the board of trustees, check up his accounts
quarterly with the clerk and also make an annual report including his work both as
marshal and tax and license collector.
He shall perform such other acts as the laws of the state and the ordinances of the
board of trustees may require.
Section 4. The recorder shall be judge of the recorder's court, and he shall have
the powers and perform the duties of a magistrate.
He may administer and certify oaths and affirmations and take and certify
acknowledgements, His court shall have exclusive original jurisdiction of all actions
arising from the violation of or non-compliance with, the ordinances of the city.
He shall make an annual report to the board of Trustees of all business transacted
in his department during the preceding year.
Section 5. The city attorney shall be the legal advisor of the officers in all matters
pertaining to the business of the city. He shall draft all ordinances, contracts or other
instruments for the city when requested to do so by the Board of Trustees.

He shall assist the city marshal by acting as prosecuting attorney before the city
recorder in all cases of Breaches of or violations of, or non compliance with any
ordinance of the city
He shall perform such other services as may be required of him by the general
laws, by the ordinances of the city or by the instructions of the Board of Trustees.
Section 6. All ordinances and parts of ordinances in conflict here with are hereby
repealed.
Section 7. The City Clerk shall certify to the passage of this Ordinance, and cause
the same to be printed and published once in the Huntington Beach News, a newspaper
printed and published in the City of Huntington Beach, and thereupon and thereafter shall
take effect and be in full force

published and printed in the City of Huntington Beach according to law.
