HomeMy WebLinkAboutOrdinance #35 ORDINANCE NO. 3 5. AN ORDINANCE ADOPTING SPECIFICATIONS FOR THE GRADING AND OILING OF STREETS IN THE CITY OF HUNTINGTON BEACH. AND DESIGNATING THE SAME AS SPECIFICATIONS NO. 4. The Board of Trustees of the City of Huntington Beach do Ordain as Follows: Section 1. That the following specifications are hereby adopted for the grading and oiling of streets in the City of Huntington Beach, and shall be known as "Specifications No 4;" And all streets hereafter directed to be graded and oiled according to"Specifications No. 4;" shall be graded and oiled according to the provisions and requirements of these specifications: - Specifications No. 4. For grading and oiling street in the City of Huntington Beach California. 1. Plans, Etc. The work herein provided for is to be done in accordance with the plans, profiles and cross sections on file in the office of the City Engineer of the City of hunt, and all work shall, during its progress and on its Completion conform to the lines and levels which may, from time to time be given by said City Engineer. II. Grading. Grading shall include all filling, the removal of all earth, stone or other material, of whatsoever Nature it may be, that may be encountered in preparing the street, and all trimming, shaping, or other work that may be necessary in bringing the surface of the street to the required grade and cross-section. Then mud or other soft material is encountered, however, will not be required, in such cases, to excavate the mud or other soft material to a greater depth than two feet below sub. grade. In places where filling is necessary to bring the street to the required grade, it shall be done with good sound earth. The embankments shall be carried up. of full width, in horizontal layers not to exceed one foot each in thickness, and the teams shall be made to travel as evenly as possible over the whole surface of each layer, both going and coming. The formation of well-defined ruts is specially prohibited. No material of a spongy nature shall be use for filling. The space over which fills are to be made shall first be cleared of all brush or timber. After the street has been brought to the required grade and cross-section as above specified, the surface shall be rolled with a roller weighting not less than two hundred (200)pounds to the inch width of a tire, until the surface is unyielding. ORD. 035 1 Depression made by the rolling shall be leveled up with a good earth and again rolled. Such portions of the street as cannot be reached by the roller, and all places excavated below grade and refilled and all pipe trenched and other placed that cannot be properly compacted by the roller shall be tamped solid, and in case of wet weather or soft or mudy ground, making use of the roller unsafe, or impracticable, the rolling shall not be undertaken until the ground has become sufficiently dry. The street shall then be tested for grade and cross-section, and no further work shall be done upon it until a certificate shall have been issued stating that it is acceptable in these respects. It shall then be plowed to a depth of not less than six inches and thoroughly pulverized by cultivating and harrowing. Should the soil to a depth of three (3)inches not contain at least ten per cent (10%) of sand, enough sand shall then be sprinkled OVER the surface to raise the proportion of sand therein to the said ten per cent(10%). III. Oiling Oil shall then be applied as follows: The area to be oiled shall extend from curb. to curb where there are no gutter, and where there are gutter then from gutter to gutter, including all intersections of streets and alleys, and to the property line on both side of said intersections. The roadway shall be coated evenly with the oil at the rate of thee-fourths (3/4) of a gallon to the square yard of surface COVERED. It shall then be thoroughly cultivated to a depth of three (3)inches until the oil is well mixed with the soil. A second application of oil, to the extent of three-fourths (3/4) of a gallon per square yard of surface COVERED, shall then be thoroughly cultivated to a depth of two (2)inches, a portion of the cultivating being done alone diagonal lines so as to thoroughly mix the surface. It shall then be graded with a road grader if uneven until it substantially conforms to the official cross-section, and shall then be rolled with a roller weighting at least too hundred (200)pounds to the inch width of tire, or roller tamper, until the entire surface is uniformly hard, solid and free from undulations or other irregularities. The completed surface of the street must conform substantially to the established grade and cross-section. Should it be low, it shall be broken up to a depth of at least two inches, fresh earth and oil supplied and the surface again rolled as before. Should an excess of oil remain upon the surface after it has been thoroughly completed, such oily portion shall be cultivated to a depth of at least three (3)inches and retamped. In the process of cultivating, the surface shall be gone over not less than twice after the first application of oil, and not less than three times after the second application, and in all cases until the oil and soil are thoroughly mixed. ORD. 035 2 The total quantity of oil to be applied on the street shall be not less than one and on-half- (1-1/2) gallons net oil by measure for every square yard of surface COVERED. At all stages of the work sufficient water shall be applied to secure the best results in the tamping, the amount of water to be used to be governed by the character of the soil, the intention bring to make the oil just damp enough to feel solid. Any portion of the street that cannot be reached by the roller shall be tamped solid by hand, under the direction of the Superintendent of Streets. The Contractor will be held responsible for all damage to curbs, gutters or crosswalks that may be caused by him in the performance of the work. IV. Oil. (a) The oil used shall be a natural oil or an asphaltic base, treated to remove water or sediment of the residuum of such an oil from which the volatile material has been removed by distillation. It must not have been injured by OVER-heating, and it must not be obtained by adding solid asphalt to lighter oils or distillates. (b) Temperate. All oil must be delivered at the point required for sprinkling at a temperature of not less than one hundred and fifty (150) degrees Fahrenheit. (c) Measurement, in determining the quantity of oil delivered, the correction for expansion by heat shall be as follows: From the measured volume, of oil received at any temperature above sixty (60) degrees Fahrenheit. An amount equivalent to four tenths (4) of one (1) per cent for every ten (10) degrees above said sixty (60) degrees Fahrenheit shall be subtracted as the correction for expansion by heat. For the purpose of measuring oil a temperature of sixty (60) degrees Fahrenheit shall be deemed normal temperature. (d) Water and Sediment, Deduction will be made for water and sediment found therein, and the oil shall not contain OVER two (2)percent of such water and sediment. (e) Asphalt, After being freed from water and sediment, the oil shall contain not less than seventy-eight(78)per cent of asphalt having, at a temperature of seventy-seven (77) degrees Fahrenheit, a penetration of eighty (80) degrees, district of Columbia Standard. The percentage of Asphalt shall be determined by heating twenty-five (25) grams of said oil or residuum in an evaporation over at a temperature of four hundred (400) ORD. 035 3 degrees Fahrenheit until it has reached the proper consistency, when the weight of the residue shall be determined and the percent calculated. (£) Volatility. The oil shall not lose in excess of one and one-half (1 '/2)per cent Volatile matter when heated from a temperature of 77 degrees Fahrenheit to 220 degrees Fahrenheit, and maintained at 220 degrees Fahrenheit for fifteen minutes. The time required for heating from 77 degrees to 220 degrees Fahrenheit should be one hour. (g) Sulphur. Natural oil shall not contain in excess of two (2.0)per cent of sulphur, and residuum shall not contain in excess of two and one0half (2 '/2)per cent sulphur. (h) Organic Impurities. Residuum shall not contain in excess of two tenths (2) of one (1)per cent of organic matter insoluble in carbon tetrachloride at ordinary temperature. (i) Tank Wagons.All tank wagons used for the delivery of this oil must first be submitted to the Department of Oil Inspection, which will gauge and stamp upon said tanks the capacity in gallon, and no figure of capacity will be accepted other than the official rating given by the Department of Oil Inspection. (j) Testing Oil. All oil to be used shall be tested by the Department of Oil Inspection. V. Culverts. Culverts shall be placed wherever designated on the profiles or plans of the street on file in the office of the City Engineer. They shall be of the character and dimensions shown on the profile or plan and described in the specifications named in the ordinance of Intention. VI. General Requirements. Work. The Contractor shall, for the price bid, furnish all the materials and perform all the labor necessary to execute the work in every aspect in a thorough, workmanlike manner, and in accordance with the plans and specifications and to the satisfaction of the Superintendent of Streets. Materials and Samples. All materials must be of the specified quality and fully equal to samples when samples are required. The Contractor shall furnish to the City Engineer for the test, when ever called for, and free of charge, sample of all the materials proposed to be used, in the work. Rejected material must be immediately removed from the work by the Contractor. ORD. 035 4 Labor. Any overseer, Superintendent, laborer or other person employed on the work by the Contractor, who shall perform his work in a manner contrary to these specifications shall be discharged immediately, and such person shall not again be employed on the work. Examination of Ground. Bidders must examine and judge for themselves as to the location of the proposed work, the nature of the excavation to be made and the work to be done. Setting Stakes. The Contractor shall give twenty four(24) hours notice in writing when he will require the service of the City Engineer for laying out any portion of the work. The Contractor shall dig all stake holes necessary to give lines and levels. The contractor shall preserve all stakes set for the lines, levels or measurements of the work in the proper places until authorized to remove them by the City Engineer, and any expense incurred in replacing said stakes which the Contractor or his subordinates may have failed to preserve shall be borne by the Contractor. Plans and Specifications. The Contractor shall keep upon the work a copy of the plans and specifications, and access thereto shall at all times be accorded the Engineer. Inspectors. The Contractor shall prosecute work only in the presence of an Engineer or an inspector appointed by the Superintendent of Street, and any work done in the absence of said engineer or inspector will be subject to rejection. The Contractor shall furnish the engineer and inspectors reasonable facilities for obtaining such information as may be necessary to give them full information at all times respecting the progress and manner of the work and the character of the materials. Preservation of Monuments. The Contractor shall not disturb any monuments or stakes found on the line of the improvements until ordered by the City Engineer. And he shall bear the expense of resetting any monuments or stakes which may be disturbed with out orders. Removing Obstructions. The contractor shall remove all trees, stones, derbis and other obstructions that may be encountered in making said improvements. Observing City Ordinances. The Contractor shall observe all the ordinances of the City of Huntington Beach in relation to the obstruction of street. Keeping open passagways and protecting the same, where they are exposed to dangerous travel. ORD. 035 5 Barriers, Lights, Etc. The Contractor shall take all necessary measures to protect the work and prevent accidents during Construction. He shall provide and maintain all necessary barriers, guards, temporary bridge, watchmen and lights. Cross Street No more than one cross street shall be closed at any one time. Public Utilities. In case it should be necessary to move the property of any owner of a public utility or franchise, such owner will, upon proper application by the Contractor, be notified by the Superintendent of Streets to move such property within a specified reasonable time, and the Contractor shall not interfere with said property until after the expiration of the time specified. The right is reserved to the owners of public utilities and franchises to enter upon the street for the purpose of making repairs or changed of their property that may be made necessary by the work. The City shall also have the privilege of entering upon the street for the purpose of repairing the sewers and water pipes, and making house connections therewith, repairing culverts or storm drains. Loss or Damage. All loss or damage arising form any unforeseen obstruction or difficulties which may be encountered in the prosecution of the work, or from any action of the elements, or from any act or omission not authorized by these specifications, on the part of the Contractor or any agent or person employed by him, shall be sustained by the Contractor. Defective Work. No work which may be defective in its Construction or deficient in any of the requirements of these specifications, will be considered as accepted in consequence of the failure of any officer of the City or inspector connected with the work to point out said defects or deficiency during Construction, and the Contractors shall correct any imperfect work, whenever discovered, before the final acceptance of the work. Protection of Work and Cleaning up. The Contractor shall care for all work until final completion and acceptance, he shall remove all surplus material and rubbish from the work after its completion and before he makes application for the acceptance of the work. Final Inspection. The Contractor shall notify the Superintendent of Streets when he desires a final inspection of the work, when the latter will, as soon as possible, make the necessary examination, and is the work is found in Compliance with these specifications, the Superintendent of Streets will furnish the Contractor with a certificate, to that effect. ORD. 035 6 Allowable Variation. When in the specification a maximum and minimum, either in size, percentage or thickness or relating to quality or character or other matter, is allowed or prescribed the work shall be accepted as in compliance therewith if within such maximum or minimum so allowed hereby. Definitions. Whenever the work"City" is used in these specifications it refers to the City of Huntington Beach, California. When the work, "Contractor" is used in these specifications it refers to the party or parties of the second part in the agreement for the Construction of the work herein specified. Whenever the word"Superintendent of Street" or"City Engineer" are used in these specifications they refer respectively to the Superintendent of Street or the City Engineer of the City of Huntington Beach, California, or their authorized agents or inspectors. The City Clerk shall certify to the passage of this Ordinance, and cause the same to be published once in the "Huntington Beach News," a newspaper printed& published in the City of Huntington Beach, and thereupon and thereafter it shall take effect and be in full force.
