AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH PROVIDING FOR THE COLLECTION OF THE CITY TAXES OF THE CITY OF HUNTINGTON BEACH UNDER THE STATUTES OF 1895, PAGE 219, CHAPTER 182, AS AMENDED BY STATUTES OF 1905, PAGE 429, CHAPTER 358. The Board of Trustees of the City of Huntington Beach do Ordain as Follows: Section 1. The City of Huntington Beach hereby elects to and hereby does avail itself of the provisions of the Statute of 1895, Page 219, Chapter 182, of the State of California, entitled, "To provide for the levy and collection of taxes by and for the use of Municipal Corporations and Cities incorporated under the laws of the state of California, except Municipal Corporations of the first class, and to provide for the consolidation and abolition of certain Municipal officers, and to provide that their duties may be performed by certain officers for the services so rendered to such Municipal Corporation," as amended by Statutes of 1905, Page 429, Chapter 358; except that the said city does not avail itself of the provisions of section 2 thereof. Section 2. The Board of Trustees of the City of Huntington Beach shall meet on the first Monday of August of each year, and fix, by ordinance, the amount of money necessary to be raised by taxation upon the taxable property of the City of Huntington Beach as a revenue to carry on the various departments of said City, for the Current year, not to exceed the limit fixed by law, and to pay the bonded or other indebtedness of said City. Section 3. The County Auditor of the County of Orange, State of California, must, on or before the second Monday in August of each year, transmit to the Board of Trustees of the City of Huntington Beach a statement in writing showing the total value of all property within the City of Huntington Beach, which value shall be ascertained from the assessment book of the County of Orange for such year, as equalized and corrected by the Board of Supervisors of said County. Section. 4. The Board of Trustees of the City of Huntington Beach shall, on the first Monday of September of each year, fix the rate of taxes for the said City, and designated in the number of cents upon each hundred dollar, using as a basis the value of the property as assessed by the County Assessor, and so returned to such Board by the County Recorded, and required by Section 3 of this Ordinance, which rate of taxation shall be sufficient to raise the amount so fixed by such Board, as required by Section 2 of this Ordinance. Section. 5. The Auditor of the County of Orange must then compute and enter in a separate column in the assessment book, to be headed, "City Tax, City of Huntington Beach," the respective sums in dollars and cents to be paid as a municipal tax on the property therein enumerated and assessed as being in said City, using the rate of levy as fixed by such municipal board and the assessed value as found in such assessment book. ORD. 040 1 Such taxes so levied shall be collected at the same time and in the same manner as state and County taxes; and when collected the net amount as ascertained by section six of this ordinance shall be paid to the Treasurer of the City of Huntington Beach, under the general requirements and penalties provided by law for the settlement of other taxes. Section. 6. The County Auditor and Country tax Collector shall file with the Board of Supervisors of the County of Orange itemized statements showing the additional expense to their offices as assessing and collecting the taxes of the City of Huntington Beach, and upon the filing of such statements the Board of Supervisors shall, by an order spread upon the minutes, deduct such expenses from the taxes of the City of Huntington Beach, and transfer the same into the County Salary Fund; provided, that not more than one per centum shall be deducted for collecting the first$25,000. so collected, and one-fourth of one percentum for all sums over that amount. Section 7. Whenever any real property situated in the City of Huntington Beach which has been sold for taxed shall be redeemed, the money paid for such redemption shall be apportioned by the County Treasurer to the City of Huntington Beach in proportion which the tax due such City bears to the total for which such real property was sold. Section 8. All Ordinances or parts of ordinances in conflict wherewith are hereby repealed as to all future levies of taxes; it being especially herein reserved and provided that all officers of the City of Huntington Beach shall continue to perform those duties as to the tax levy of the year 1909-1910 until the tax therein levied has been entirely collected and paid to the Treasurer of the said City of Huntington Beach. Section. 9. On or before the first Monday in February of each year the City Clerk of the City of Huntington Beach shall file with the Auditor of the County of Orange, taking his receipt therefore, a certified copy of this Ordinance. Section. 10. The City Clerk shall certify to the passage of this Ordinance, and cause the same to be published once in the Huntington Beach News, a newspaper printed and published in the City of Huntington Beach, California, and thereupon and there after it shall take effect and be in full force.
