ORDINANCE NO. 5
AN ORDINANCE ESTABLISHING RULES TO
GOVERN THE ORDER AND PROCEEDINGS OF THE
BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH.
The Board of Trustees of the city of Huntington Beach do ordain as follows: —
Section # 1: — The President of the Board of Trustees shall take the chair, and preside at
all meetings thereof, at the hour of meeting he shall call the members to order, and proceed with
the business before the board. In his absense a president protem may be chosen by the board who
shall have the powers and perform the duties of the President only during the day on which he is
chosen and in case the president arrive and take his seat the authority of the President protem
shall cease.
Section # 2: — The ordinary parliamentary rules, as laid down in Roberts Rules of
Order, shall in general govern the proceedings of this Board of Trustees, but the president shall
decide all questions of order, subject to appeal to the board, and all appeals shall be decided by a
majority of those present. Nothing in this ordinance shall be construed to prevent the president
from casting his vote upon each and every matter that comes before the board, whether there be a
tie or not; and nothing in this ordinance shall be construed to permit the president to have a
deciding vote after he has already voted.
Section # 3: — The order of business for the regular weekly meeting shall be as
follows: —
a. Reading of minutes since last regular meeting.
b. Reports of standing committees.
c. Reports of special committees.
d. Reports of term or city officers.
e. Reports and action on accounts and bills.
f. Motions and resolutions.
g. Ordinances
h. Petitions, remonstrances, and communications.

Section # 4: — There shall be four standing committees, of two members each, to be
appointed by the president, as follows.
1. Finance.
2. Police and Fire.
3. Health and Good of the City.
4. Streets.
Section #5: — Special committees may be appointed from time to time, to
terminate upon reporting, unless further continued by the board.
Section #6: — Whenever requested by a member of the Board, the report of a
committee must be made in writing, signed by all the members of the committee, except in case
of the committee of the whole, which shall be signed by the chairman only. No committee shall
have the power of initiative, or jurisdiction over anything not directly referred to it by the board,
and a reference to a committee without instructions shall be construed as an order to investigate
and report.
Section # 7: — All motions, resolutions, and ordinances shall be reduced to writing, if
requested by a member of the board.
Section # 8: — Every member present shall give his vote on all questions brought to a
vote, unless a majority of the other members present vote to excuse him from so voting.
Section # 9: — All claims upon the City of Huntington Beach, whether for salaries, fees,
wages, supplies, or anything else, shall be filed with the clerk not less than three hours prior to
the time of meeting of the board at which they are to be heard; and they shall be presented upon
blanks (as far as practicable)furnished by the city, properly itemized and sworn too.
Section #10: — The Board of Trustees and the presiding officer thereof, shall have
authority to preserve order, and may direct and marshal to remove any and all refractory and
disorderly persons from the presence of the board.
The Board may compel the attendance of any member, and if any member refuse to
come, the board may require him to attend, and may order the city marshal to bring him by force
to such meeting; for which service the said marshal shall receive the sum of$2.50, to be
collected from such refractory member.
Section # 11: —The Clerk of the City of Huntington Beach shall certify to the passage of
this ordinance and cause the same to be published once in the Huntington Beach News, and
thereupon and thereafter it shall take effect and be in full force.

foregoing ordinance was passed at a regular meeting of the Board of Trustees of the City of
Huntington Beach, held in the 1st. day of March 1909, by the following vote.
Ayes M. E. Helme, D. O. Stewart, C. W. Warner, Ed. Manning.
Noes Not any. Absent. C. H. Howard.

Beach" and that the same has been published in the Huntington Beach News a newspaper
published and printed in the city of Huntington Beach according to law.
