AN ORDINANCE PRESCRIBING THE ESSENTIALS OF VALID ORDINANCES FOR THE CITY OF HUNTINGTON BEACH, PROVIDING FOR THE PUBLICATION OF SUCH ORDINANCES, FIXING THE TIME OF THEIR TAKING EFFECT, AND AUTHORIZING THE IMPOSITION OF FINES, PENALTIES AND FORFEITURES FOR ANY AND ALL VIOLATIONS OF SAME. The Board of Trustees of the city of Huntington Beach do ordain as follows. Sec. 1. — The ordinances of the city of Huntington Beach shall be numbered consecutively according to order of adoption, unless the Bard of Trustees shall otherwise direct Sec. 2. — Each ordinance of the city of Huntington Beach shall be preceded by a title giving a general description of the subjects treated in the said ordinance Sec. 3. — The enacting clause of each ordinance of the city of Huntington Beach shall be—"The Board of Trustees of the city of Huntington Beach do ordain as follows: Sec. 4. — Every ordinance shall be written or printed in the English language, and shall be read to the Board of Trustees, while in session, at least two times prior to its passage with an internal if not less than five (5) days between the first and last readings, amendments thereto being permitted at any of the readings; such ordinance shall be passed or adopted at a regular meeting of the Board of Trustees by the affirmative vote of at least three (3) Trustees in response to the call of the roll; the number of the ordinance, the date of its passage and the order for its publication shall be inserted therein; and such ordinance shall be signed by the President, or acting President, and attested by and certified to by the Clerk, and shall have the official seal of the City affixed thereto. Sec. 5. — After the passage of an ordinance by the Board of Trustees, it shall be the duty of the City Clerk, unless otherwise ordered, to cause the same to be published once in the newspaper having the contract for the city advertising, or if there be no contract, then in such newspaper published in the City of Huntington Beach, and having a general circulation, as may be designated by the Board of Trustees, in the first publication succeeding the meeting at which the same is passed; provided, that nothing in this ordinance shall be construed to affect the validity of any ordinance which is so published at a later date. Sec. 6. — The City Clerk shall engross the ordinance on the ordinance book, and certify thereafter to the correctness of the copy and to its publication according to law; he shall then place the original on file in his office. Sec. 7. — Each ordinance, duly read, passed, signed and published, shall take effect and be in force upon the publication thereof, unless some other time for its taking effect be specified in the ordinance itself. ORD.008 1 Sec. 8. — The violation of, as willful non-compliance with any ordinance of the City of Huntington Beach shall, unless otherwise provided therein, be punishable by imprisonment in the City Jail of the City of Huntington Beach, if there be one, or in the county Jail of Orange county, as the City Recorder may direct, not exceeding three (3) months, or by fine not exceeding Three Hundred Dollars. ($300.00), or by both such fine and imprisonment; and a violation of such ordinance may be prosecuted by the Board of Trustees of said City of Huntington Beach in the name of the People of the State of California, or it may be redressed by civil action at the option of the said board of Trustees. Any judgment of fine shall direct that in default of the payment of such fine, the defendant shall be imprisoned, until such fine be satisfied; provided, that in case of such imprisonment for failure to pay the fine, the amount of the fine shall be reduced Two Dollars ($2.00)for each day so imprisoned. If the violation be committed by an officer of the said City, he shall be liable, not only to fine and imprisonment, but also to the forfeiture of his office. Sec. 9.—All previous ordinances, or parts or ordinances, in conflict with this ordinance, are hereby repealed. Sec. 10. — The City Clerk shall certify to the adoption of this ordinance and cause the same to be published once in the"Huntington Beach News," A newspaper published and printed in the said City of Huntington Beach, and thereupon and there after it shall take effect and be in full force. Rosenberger, City Clerk and Ex-officio Clerk of the Board of Trustees of the city of Huntington Beach, hereby certify that the foregoing ordinance is a true and correct copy of an ordinance of the City of Huntington Beach Numbered 8 and entitled"An ordinance prescribing the essentials of valid ordinances for the City of Huntington Beach, providing for the publication of such ordinances, fixing the time of their taking effect, and authorizing the imposition of fines, penalties and forfeitures for any and all violations of same," and that the same has been ORD.008 2 published in the Huntington Beach News a newspaper published and printed in the city of Huntington Beach according to law.
