AN ORDINANCE PROHIBITING GAMBLING, BY ANY DEVICE,
PROHIBITING THE KEEPING OR CONDUCTING OF PLACES
FOR GAMBLING, AND FIXING THE PENALTIES FOR SO DOING.
The Board of Trustees of the City of Huntington Beach do Ordain as follows.
Sec. 1. — It shall be unlawful for any person, either as principal, agent, employee,
mortgagee, or otherwise, to keep, conduct, or maintain, within the City of Huntington Beach, any
house, room, apartment or place, used in whole or in part as a gambling house, or place where
any game of backgammon, bagatelle, billiards, card games or any kind, carom, checkers, chess,
crokinole, pool, or any game of skill or chance whatever not mentioned in Section 330 of the
Penal Code of the State of California, is played, conducted, dealt, carried on, opened caused to
be opened for money, checks, chips, credit or other representative of value.
Sec. 2. — It is hereby declared unlawful for any person, either as principal, agent,
employee, or otherwise, knowingly to permit any house room, apartment, or place, owned by
him, or under his charge or control, in said City of Huntington Beach, to be used in whole or in
part, as a gambling house or place where any game of backgammon, bagatelle, billiards card
games or any kind, carom, checks, chess, crokinole, pool, or any game of skill or chance
whatever not mentioned in Section 330 of the Penal code of the State of California, is played,
conducted, dealt, carried on, opened, or caused to be opened, for money, checks, chips, credit or
any other representative of value.
Sec. 3. — It is hereby declared unlawful for any person to play or bet at or against any
game of backgammon, bagatelle, billiards, card games of any kind. carom, checkers, chess,
crekinole, pool, or any game of skill or chance whatever not mentioned in Section 330 of the
Penal Code of the State of California, which is played, conducted, dealt or carried on with cards,
dice, or other device, for money, checks, chips, credit or any other representative of value, in any
house, room apartment or place described in Section 1 of this ordinance in the said City of
Huntington Beach.
Sec. 4. — It shall be unlawful for any person within the limits of the city of Huntington
Beach to exhibit or expose to view in any barred or barricaded house or room, or in any place
built or protected or guarded in a manner to make it difficult of access or ingress to the City
Marshal of Huntington Beach, or his deputies, when Three or more persons are present, any faro
box, or any roulette or fantan table or layout. or any part of such layout, or any cards, dice
dominoes, or any gambling implements what so ever. Sec.
Sec 5. — It shall be unlawful for any person to visit or resort to any such barred or
barricaded house or room, or other place built, protected or guarded in a manner to make it
difficult of access or ingress to the city Marshal of the City of Huntington Beach, or his deputies,
where any faro box or any roulette or fantan table or layout, or any part of such layout. or any

cards, dice dominoes or any gambling impliments what so ever are exhibited or exposed to view,
when three or more persons are present.
Sec 6. — It shall be unlawful for any person, as principal, or agent employee or
otherwise, to conduct or carry on, or in any capacity to assist in conducting or carrying on the
bisiness of receiving money, or any thing or things of value, or any representative of value, upon
the representation or understanding that said money, thing or things of value, or representation of
value, is received as a bet or wager, on any race or contest, or on the result of any race or contest,
or is received to be bet, or wagered, or placed, or deposited, as a bet or wager, on any race or
contest or on the result of any race or contest.
Sec. 7. — It shall be unlawful for any person, either as owner, lessee, agent, employee,
mortgagee, or otherwise to operate, keep, maintain, rent, use or conduct, within the City of
Huntington Beach, any clock, dice, tape, slot or card machine, or any other machine,
contrivance, or device upon which money or other representative of value is staked or hazarded
upon chance, or into which money or other representatives of value is paid, deposited or played,
upon chance, or upon which money or any other article or thing of value is staked, bet, hazarded,
own or bet upon chance.
Sec. 8. — It shall be unlawful for any person, either as owner, lessee, agent, employee,
mortgagee or otherwise, to operate, keep, maintain, rent, use or conduct within the City of
Huntington Beach, any machine, contrivance, appliance or mechanical devise upon the result of
the action of which money or other valuable thing is representative of value is staked, or
hazarded, and which is operated or played, by placing or depositing therein any coins, checks,
slugs, balls or other articles or device, or any representative of value, or in any other manner, and
by means of the action whereof, or as a result of the operation of which any merchandise, money,
representative or article of value, check, or token redeemable in, or exchangeable for money or
other article of value, or any other thing of value is won or lost, or taken from or obtained from
such machine when the result of the action or operation of such machine, contrivance, appliance
or mechanical device is dependent upon hazard or chance.
Sec. 9. — It shall be unlawful for any person, either as owner, lessee, agent, employee,
mortgagee, or otherwise, to shake or cast, or shake and cast any dice, or similar objects, with the
intention to submit upon the hazard or result of such shaking or casting, or shaking and casting of
dice or similar objects the determination of what person, firm, or corporation shall pay for cigars
or other merchandise, or whether said cigars or other merchandise shall be paid for at all by a
purchaser thereof, or with intentions to submit, shake, bet or hazard upon the chance or result of
such shaking or casting, or shaking and casting, of dice or similar object, credit, money, or any
other article or thing of value, or representative of value.
Sec. 10. — Any violation of any of the provisions of this ordinance shall constitute a
misdemeanor, and every person found guilty of violating any of said provisions, shall upon
conviction thereof, be fined in the sum of not more than Three Hundred Dollars ($300), or be
imprisoned not more than three (3) months in the city jail of the City of Huntington Beach, If
there be one, or in the county jail of Orange County, as the City Recorder may direct, or be
punished by both such fine and imprisonment.

Sec. 11 — The City Clerk shall certify to the adopton of this ordinance and cause the
same to published once in the Huntington Beach News, a news paper published and printed in
the said City of Huntington Beach, and there upon and thereafter it shall take effect and be in full
force.

news a news paper published and printed in the City of Huntington Beach according to law.
