AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, OF THE FOLLOWING PROPOSITION: "SHALL THE CITY OF HUNTINGTON BEACH AVAIL ITSELF OF THE PROVISIONS OF THE STATUTES OF 1893, PAGE 153, AS AMENDED BY THE STATUTES OF 1909, PAGE 331, ENTITLED `AN ACT TO PROVIDE FOR THE PLANTING, MAINTENANCE, AND CARE OF SHADE TREES UPON STREET, LANES, ALLEYS, COURTS AND PLACES WITHIN MUNICIPALITIES, AND OF HEDGES UPON THE LANES THEREON; ALSO, FOR THE ERADICATION OF CERTAIN WEEDS WITHIN THE CITY LIMITS"? The Board of Trustees of the City of Huntington Beach do Ordain as Follows: Section. 1. It is hereby ordered that at the next general Election of this City, to-wit, the General election to be held on the second Monday in April, 1910, in the City of Huntington Beach, County of Orange, State of California. The following proposition be submitted to the qualified electors of the City of Huntington Beach to-wit: "Shall the City of Huntington Beach avail itself of the provision of Statutes of 1893, Page 153. As amended by Statutes of 1909, page 331, entitled, `An Act to provide for the planting, maintenance and care of shade trees upon streets, lanes, alleys, courts and places within Municipalities, and of hedges upon the lanes thereof, Also, for the eradication of certain weeds within City limits' " ? Section. 2. That the official ballot used at such election, besides the other things required by law, Contained the following question in the following manner "Shall the City of Huntington Beach avail itself of the provisions, of Statutes of 1893, page 153. As amended Yes. by Statutes 1909, Page 331, Entitled An Act to provide for the planting, maintenance and care of shade trees upon streets, lanes, alleys, courts and places within municipalities, and of hedges upon lanes thereof, also No. for the eradication of certain weeds within the city limits' " ? If an elector shall at the said election have stamped a cross (x) in the voting square after the printed work"Yes" his vote shall be counted in favor of the proposition: if he shall have stamped a cross (x) after printed work"no: his vote shall be counted against the adoption of the same. Section. 3. If a majority of such electors voting at such Election shall vote in favor thereof, than the Board of Trustees of the said City of Huntington Beach shall, by ordinance, declare that the provisions of the said statutes are adopted; and upon the taking ORD. 042 1 efect of the said Ordinance, the said City of Huntington Beach shall be subject to the provisions of the said Act. Section. 4. All Ordinances or Parts of Ordinances in Conflict herewith are hereby repealed. Section. 5. The City Clerk shall certify to the passage of this Ordinance, and cause the same to be published once in the Huntington Beach News, a Newspaper printed and published in the City of Huntington Beach, California, and thereupon and thereafter it shall take effect and, be in full force. Bradbury, City Clerk and ex-officio clerk of the board of the City of Huntington Beach, hereby Certify that the foregoing ordinance is a true and correct copy of an ordinance of the City of Huntington Beach, Numbered"42" and entitled, An Ordinance providing for the submission to the qualified electors of the City of Huntington Beach, California, of the following proposition: "Shall the City of Huntington Beach Avail itself of the provisions of statutes of 1893, Page 153. As amended by statutes of 1909, page 331. Entitles An act to provide for the Planting, Maintenance and care of shade trees upon streets, Lanes, Alleys, courts and places within municipalities and hedges upon land thereof, Also, for the eradication of certain weeds within the City limits" ?
