AN ORDINANCE ADOPTING SPECIFICATIONS FOR THE GRADING AND
OILING OF STREETS IN THE CITY OF HUNTINGTON BEACH, AND
DESIGNATING THE SAME AS "SPECIFICATION NO. 5,"
The Board of Trustees of the City of Huntington Beach do ordain as follows:
Section 1. That the following specifications are hereby adopted for the
grading and oiling of streets in the City of Huntington Beach, and shall be known as
"Specifications No. 5," and all streets hereafter directed to be graded and oiled according
to Specifications No.5," shall be graded and oiled according to the provision and
requirements of these specifications.

I
Plans, Etc.
The work herein provided for it to be done in accordance with the plans , profiles
and cross-sections on file in the office of the City Engineer of the City of Huntington
Beach, and all work shall during its progress and on its completion, conform to the lines
and levels which may, from time to time, be given by said Engineer.
II.
Grading.
Grading shall include all filling, the removal of all earth, stone or other material of
whatsoever nature if may be, that may be encountered in preparing the street, and all
trimming, shaping, or other work that may be necessary to bring the surface of the street
to the required grade and cross-section.
When mud or other soft material is encountered it shall be taken out and the space
filled with good earth or gravel. The Contractor however will not be required, in such
cases, to excavate the mud or other soft materials to a greater depth than two feet below
the sub-grade.
In places where filling is necessary to bring the Street to the required grade, it
shall be done with good sound earth. The embankments shall be carried up of full width
in horizontal layers not to exceed one foot each in thickness and the terms shall be made
to travel as evenly as possible over the whole surface of each layer, both going and
coming.
The formation of well defined ruts is specially prohibited.
No material of a spongy nature shall be used for filling the space over which fills
are to be made shall first be cleared of all brush or timber. After the street has been

brought to the required grade and cross-section as above specified, the surface shall be
rolled with a rolling tamper until the surface is unyielding.
Depressions made by the rolling shall be leveled up again with good earth, and
again rolled.
Such portions of the street as cannot be reached by the roller, and all places
excavated below grade and refilled and all pipe trenches and other places that cannot be
properly compacted by the roller shall be tamped solid and in case of wet weather, or soft
or muddy ground, making use of the roller unsafe or impractible, the rolling shall not be
undertaken until the ground has become sufficiently dry.
The street shall then be tested for grade and cross-section, and no further work
shall be done upon it until a certificate shall have been issued stating that it is acceptable
in these respects. It shall then be plowed to a depth of not less than six inches and
thoroughly pulverized by cultivating and harrowing. Should the soil to a depth of three
(3)inches not contain at least ten (10)per cent of sand, enough sand shall then be
sprinkled over the surface to raise the proportion of sand therein to the said ten (10)
percent.
III
Oiling.
Oil shall then be applied as follows:
The area to be oiled shall extend from curb to curb where there are no gutters,
from gutter to gutter, all intersection of streets and to the property line on both sides of
said intersections.
The roadway shall then be coated evenly with oil at the rate of one and one half(1
'/2) gallons, to the square yard of surface covered. it shall then be plowed to a depth of
four(4) inches, and then cultivated until thoroughly mixed with the soil.
A second application of oil to the extent of one (1) gallon to the square yard of
surface covered, shall then be made and the entire surface shall then be thoroughly
cultivated to a depth of three (3)inches, a portion of the cultivating being done alone
diagonal lines so as to thoroughly mix the surface. It shall then be graded with a road
grader, if uneven, until it substantially conforms to the official cross section and shall
then be rolled with a roller tamper, until the entire surface is uniformly hard, solid and
free from undulations or other irregularities.
The completed surface of the street must conform substantially to the established
grade and cross-section. Should it be low, it shall be broken up to a depth of at least two
inches, fresh earth and oil supplied and the surface again rolled as before.
Should an excess of oil remain upon the surface after it has been thoroughly
completed to a depth of at least three (3)inches and retamped.

In the process of cultivating, the surface shall be gone over, not less than twice
after the first application of oil, and not less than three times after the second application
and in all cases until the oil and soil are thoroughly mixed.
The total quantity of oil to be applied on the street shall not be less than two and
one half(2 '/2) gallons of oil by measure for every square yard of surface covered.
At all stages of the work, sufficient water shall be applied to secure the best
results in the tamping, the amount of water to be used to be governed by the character of
the soil, the intention being to make the soil just damp enough to be pack solid.
Any portion of the street that cannot be reached by the roller shall be tamped solid
but land, under direction of the superintendent of street.
The contractor will be held responsible for all damage to curbs, gutters or cross-
walks that may be caused by him in the performance of the work.
IV
Oil.
(a) The oil used shall be a natural oil of an asphaltic base, treated to remove
water or sediment, or the residuum of such an oil from which the volatile material has
been removed by distillation. It must not have been injured by over heating, and it must
not be obtained by adding solid asphalt to lighter oils or distillates.
(b) Temperature. All oil must be delivered at the point required for sprinkling
at a temperature of not less than one hundred and fifty (150) degrees Fahrenheit.
(c) Measurement. In determining the quantity of oil delivered, the correction
for expansion by heat shall be as follows:
From the measured volume of oil received at any temperature above sixty
(60) degrees Fahrenheit, an amount equivalent to four tenths (4) of one per cent for every
ten (10) degrees above said sixty (60) degrees Fahrenheit shall be subtracted as the
correction for expansion by heat.
For the purpose of measuring oil a temperature of sixty (6) degrees
Fahrenheit shall be deemed normal temperature.
(d) Water and Sediment. Deduction will be made for water in exact proportion
to the percentage of water and sediment found therein, and the oil shall not contain over
two (2)per cent of such water water and sediment.
(e) Asphalt. After being freed from water and sediment, the oil shall contain
not less than seventy-eight(78)per cent of asphalt having of a temperature of seventy-
seven (77) degrees Fahrenheit, a penetration of eighty (80) degrees, District of Columbia

Standard. The percentage of asphalt shall be determined by heating twenty-five (25)
grams of said oil or residuum in an evaporating over at a temperature of four hundred
(400) degrees Fahrenheit until it has reached the proper consistency, when the weight of
the residue shall be determined and the percent calculated.
(f) Volatility. The oil shall not lose in excess of one and one half(1 '/2)per
cent volatile matter when heated from a temperature of 77 degrees Fahrenheit to 220
degrees Fahrenheit, and maintained at 220 degrees Fahrenheit for fifteen (15) minutes.
The time required for heating from 77 degrees to 220 degrees Fahrenheit
shall be one (1) hour.
(g) Sulphur. Natural oil shall not contain in excess of two (2)percent of
sulphur, and residuum shall not contain in excess of two and one-half(2 '/2)per cent of
sulphur.
(h) Organic Impurities. Residuum shall not contain in excess of two-tenths
(2) of one (1)per cent of organic matter insoluble in carbon tetrachloride of ordinary
temperature.
(i) Tank Wagons All tank wagons used for the delivery of this oil must be
submitted to the department of oil inspection, which will gauge and stamp upon said
tanks the capacity in gallons and no figure of capacity will be accepted other than the
official rating given by the department of oil Inspection.
0) Testing oil. All oil to be used shall be tested by the department of oil
inspection.
V
Culverts.
Culverts shall be placed wherever designated on the profiles or plans of the street
on file in the office of the City Engineer. They shall be of the character and dimensions
shown on the profile or plan and described in the specifications named the Ordinance of
Intention.
VI
General Requirements
Work. The contractor shall, for the price bid, finish all the materials and perform
all the labor necessary to execute the work in every respect in a thorough, workmanlike
manner, in accordance with the plans and specifications and to the satisfaction of the
Superintendent of Streets.
Materials and Sample. All materials must be of the specified quality and fully
equal to the samples when samples are required. The contractor shall furnish to the City
Engineer for test, whenever called for and free of charge, samples of all the material

proposed to be use in the work. Rejected materials must be immediately removed from
the work by the contractor.
Labor. Any overseer, superintendent, laborer or other person employed on the
work by the contractor, who shall perform his work in a manner contrary to these
specifications shall be discharged immediately, and such person shall not again be
employed on the work.
Examination of Ground. Bidders must examine and judge for themselves as to the
location of the proposed work the nature of the excavation to be made and the work to be
done.
Setting Stakes. The contractor shall give twenty four(24) hours notice in writing
when he will require the service of the City Engineer for laying of any portion of the
work. The contractor shall dig all stake holes necessary to give lines and levels. The
contractor shall preserve all stakes set for the lines, levels or measurements of the work in
their proper places until authorized to remove them by the City Engineer, and any
expense incurred in replacing said stakes which the contractor or his subordinates may
have failed to preserve shall be borne by the contractor.
Plans and Specifications. The contractor shall keep upon the work a copy of the
plans and specifications and access thereto shall be at all times accorded to the engineer.
Inspectors. The contractor shall prosecute work only in the presence of an
engineer or inspector appointed by the superintendent of streets, and any work done in
the absence of said engineer or inspector will be subject to rejection: The contractor shall
furnish the engineers and inspectors reasonable facilities for obtaining such information
as may be necessary to give them full information at all times respecting the progress and
manner of the work and the character of the materials.
Preservation of Monuments. The contractor shall not disturb any monuments or
stakes found on the line of the improvements until ordered by the City Engineer, and he
shall bear the expense of resetting any monuments or stakes which may be disturbed
without orders.
Removing Obstructions. The contractor shall remove all trees, stones, debris, and
other obstruction that may be encountered in making said improvements.
Observing City Ordinances. The contractor shall observe all the Ordinances of the
City of Huntington Beach in relation to the obstruction of Streets, keeping open passage
ways and protecting the same where they are exposed or dangerous to travel.
Cross Streets. No more than one street shall be closed at any one time.

Barriers, Lights etc. The contractor shall take all necessary measures to protect the
work and prevent accidents during construction. He shall provide and maintain all
necessary barriers, guards, temporary bridges, watchmen and lights.
Public Utilities In case it should be necessary to move the property of any owner
of a public utility or franchise, such owner will, upon proper application by the
contractor, be notified by the Superintendent of Streets to move such property within a
specified reasonable time, and the contractor shall not interfere with said property until
after the expiration of the time specified.
The right is reserved to the owners of public utilities and franchises to enter upon
the street for the purpose of making repairs or changes of their property that may be made
necessary by the work.
The City shall also have the privilege of entering upon the street for the purpose
of repairing sewers and water pipes, or making house connections therewith, or repairing
culverts or storm drains.
Loss or Damage. All loss or damage arising from any unforeseen obstruction or
difficulties which may be encountered on the prosecution of the work, or from any action
of the elements, or for any act or omission not authorized by these specifications, on the
part of the contractor or any agent or person employed by hum shall be sustained by the
contractor.
Defective Work. No work which maybe defective in its construction or deficiency
in any of the requirements of these specifications, will be considered as accepted in
consequence of the failure of any officer of the city or inspector connected with the work,
to point out said defects or deficiency during construction, and the contractor shall correct
any imperfect work, whenever discovered, before the final acceptance of the work.
Protection of Work and Cleaning up. The Contractor shall care for all work until
final completion and acceptance. He shall remove all surplace material and rubbish from
the work after its completion and before he makes application for the acceptance of the
work.
Final Inspection. The contractor shall notify the Superintendent of Streets when
he desires a final inspection of the work, when the latter will as soon as possible, make
the necessary examination and if the work is found in compliance with these
specifications, the Superintendent of Streets will furnish the contractor with a certificate
to that effect.
Allowable Variation. When the specifications, a maximum and minimum. Either
in size, percentage or thickness, or relating to the quality or character or other matter is
allowed for prescribed, the work shall be accepted as in compliance therewith is within
such maximum or minimum so allowed hereby.

Definitions. When ever the word "City" is used in these specifications it refers to
the City of Huntington Beach, California.
When the word "Contractor" is use in these specifications it refers to the party or
parties of the second part in the agreement for the construction of the work herein
specified.
Whenever the word "Superintendent of Streets" or"City Engineer" are used in
these specifications they refer respectively to the Superintendent of Streets or to the City
Eingineer of Huntington Beach, California, or their authorized agents or inspectors.

Section 2. The City Clerk shall certify to the passage of this Ordinance, and
cause the same to be published once in the "Huntington Beach News," a weekly
newspaper printed and published in the City of Huntington Beach, and thereupon and
thereafter it shall take effect and be in full force.
