AN ORDINANCE REGULATING THE CONSTRUCTION OF BUILDINGS, CREATING FIRE DISTRICTS, AND PROVIDING FOR THE PREVENTION OF FIRES AND THE MAINTENANCE OF A FIRE DEPARTMENT IN THE CITY OF HUNTINGTON BEACH, CALIFORNIA. The Board of Trustees of the City of Huntington Beach do ordain as follows: Section 1. That a portion of the City of Huntington Beach, California, founded as follows, to-wit: - Beginning at the South Corner of Lot 1, Block 103; thence Northeast to East corner of said Lot 1, Block 103; thence Northwest to East Corner of Lot 6, Block 103; thence Northeast to East corner of Lot 28, Block 203; thence Northwest to North corner of Lot 27, Block 204; thence Southwest to North Corner of Lot 5, Block 104; thence Northwest to North corner of Lot 10, Block 104, thence Southwest to West corner of said Lot 10, Block 104, thence Southeast to point of Beginning, Shall be and is hereby declared to be Fire District No 1 of the City of Huntington Beach. Section 2. All of the City of Huntington Beach not embraced within the limits of Fire District No 1 shall be and is hereby declared to be Fire District No 2 of the City of Huntington Beach. Section 3. No wooden building shall be erected, constructed or placed in Fire District No 1 in the City of Huntington Beach. Section 4. The term "wooden building" as used in this ordinance shall be understood to mean and include, and shall embrace all buildings, houses, out houses, Lanes, sheds, stabled, and structures of every description, and any addition to any building, house, out-house, barn, shed, stable or structure, the outer surface of the walls of which are in whole or in part constructed or built of wood; provided that all wooden roofs shall be covered with fireproof roofing. Section 5 No wooden building now within the limits prescribed in the first section of the Ordinance, which may be damaged or destroyed by fire or otherwise, to the extent of fifty per centum of the value thereof, shall be repaired or rebuilt, nor shall any such building, when the damage to or destruction thereof as aforesaid is less than fifty per centum of its value, be so repairs or rebuilt as to enhance the value of such building over what the same was prior to such partial damage or destruction, or so that such building shall occupy any greater space, or be of any larger dimension than before such damage thereto to partial destruction thereof, except the said building be so reconstructed or repaired so as to conform to the provisions of this ordinance. ORD. 068 1 Section 6 The Volunteer Fire Company recognized by the City of Huntington Beach shall be known as the Huntington Beach Volunteer Fire Department, and no organization except the one recognized by the Board of Trustees of this City shall use such title Section 7 The said Huntington Beach Volunteer Fire Department shall have custody and control of the fire apparatus and equipment and fire house of the City of Huntington Beach, under the advisory direction of the Fire and Police Committee of the City of Huntington Beach. The chief of the said Huntington Beach Volunteer Fire Department shall have the absolute direction and control of the said fire apparatus and equipment of the City of Huntington Beach in time of fire, and his authority shall be absolute in all matters concerning the method of extinguishing the fire. Section 8 Whenever any change is made in the constitution by-laws of the said Huntington Beach Volunteer Fire Department, or in the personel of its officers, the secretary and chief of the said Huntington Beach Volunteer Fire Department shall at once report the same to the Board of Trustees of the City of Huntington Beach in writing, and the said Board shall take such action thereon as it sees fit. Section 9 It shall be unlawful for any person, not charged with the care of the same, to open up, take out or meddle with any fire extinguisher hose, hydrant or other fire apparatus, except to use the same under proper authority for extinguishing fires; or to willfully make or give any fake alarm of fire for the purpose of deceiving or misleading the inhabitants of the City of Huntington Beach. It shall also be unlawful for any person or persons to obstruct or impede any member, wagon, house-cart or other apparatus of the Fire Department when such member, wagon, house-cart or apparatus is going to, or engaged in extinguishing any fire. It shall also be unlawful for any person or persons to drive any horse, mule or other animal, dray, wagon or other vehicle over or across any hose of the Fire Department, unless such hose be fully protected from damage thereby. Section 10 It shall be unlawful for any person to start, build or maintain an out door fire, for burning rubbish, trash or any other materials within the City of Huntington Beach, between the hours of twelve o'clock noon and four oclock of the following morning, or at any time during a strong wind, or within twenty feet of any kind of building. No fire, otherwise permissible shall be started without being put in charge of some responsible person; nor shall such fire be abandoned until the last spark has been securely lanked in or drowned out by the person in charge. Immediately after such a fire in a street, all nails, tacks and other pieces of iron resulting therefrom must be removed to prevent injury to rubber tires and bare feet. ORD. 068 2 Section IL It shall be unlawful for any person to scatter, or permit to be scattered about his premises, or on the walks, streets or alleys adjacent thereto, any loose papers, rubbish or trash or broken glass; or to place or keep any hay, straw or other combustible material on such premises in the fire district, without covering or enclosing the same from exposure to careless smokers and stray sparks; or to put or throw any lighted cigars, matches or other ignited materials or deposit any ashes containing live coals, in any place where a fire might originate therefrom. Section 12 It shall be unlawful for any person to put up, erect, maintain or keep any stovepipe or smoke flue, except brick or stone flues, in any building within the corporate limits of the City of Huntington Beach, which are not secure from contract with wood or cloth or other combustible material as follows: When passing through partitions or ceilings the stovepipes shall be enclosed by a double air thimble, with two-inch space between the inner and the outer cylinder, or enclosed with brick; when passing through the roof it shall be protected by a flauge, the place of which shall not be less than twenty inches square and all made of galvanized iron, sheet iron or tin and all wood-work shall not be less than four inches from the stove pipe; when passing through concealed space between floor ceilings and the roof, there shall be a double pipe, or the joints of the pipe shall be securely riveted together. Section 13 It shall be unlawful for any person thereafter to put up, or erect or maintain any chimney or flue within the City of Huntington Beach, composed of combustible material, or to cause any stovepipe or flue to pass through any window, sash or glass on the side of any building or to cause or permit any stove pipe, flue, stove, grate or fireplace to be erected, placed or maintain as to endanger the building wherein the same is situated or any other building adjacent thereto, with fire. Section 14. No terra cotta flues shall be used in Fire District No 1 in the City of Huntington Beach, and all chimneys of brick or cement or stone shall be built upon a firm foundation. Section 15 Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and on conviction thereof shall be punished by a fine of not more than Three Hundred Dollars ($300.00) or imprisonment not more than ninety (90) days, or by both such fire and imprisonment. Section 16. All Ordinances and parts of ordinances in conflict with any of the provisions of this ordinance are hereby repealed. Section 17. The City Clerk shall certify to the passage of this ordinance, and cause the same to be published once in the Huntington Beach News, a weekly newspaper printed and published in the City of Huntington Beach, and thereupon and thereafter it shall take effect and be in full force.
