AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH, PROVIDING FOR
THE CARE OF AND REMOVAL OF GARBAGE IN THE CITY OF HUNTINGTON
BEACH.
The Board of Trustees of the City of Huntington Beach, do ordain as follows:
Section 1, For the purposes of this Ordinance, the word garbage is defined to
be all animal and vegetable refuse from the kitchen, and all household waste and garbage
otherwise intended to be used as food or shall have resulted from the preparation of food,
trash, other than garbage is defined to be another refuse such as tin cans, glass, old
clothes, etc.
Section 2, It shall be unlawful for any person, firm or corporation to remove
or convey or cause or cause or permit to be removed or conveyed any garbage on or
along any public streets, alley or other public place in the City of Huntington Beach;
provided however that the provisions of this section shall not apply to any person firm or
corporation with whom the City of Huntington Beach, has entered into or may hereafter
enter into a contract for the collection, removal and disposal of garbage or to any
employee of such contractor during such time as such contract shall be in force,
Section 3, It shall be the duty of every owner, manager or person in
possession, charge or control of any boarding house, restaurant, hotel, apartment or eating
house, and of every person occupying a dwelling or flat within the City of Huntington
Beach, to provide or cause to be provided, and at all times, to keep or cause to be kept, as
in this Ordinance prescribed, convenient portable vessels, tanks or receptables for holding
garbage, and no other shall be used for garbage in said City.
Each such vessel, tanks or receptable shall be a form and style approved by the
Board of Health of the City of Huntington Beach and shall be constructed of metal and
shall be water tight and shall be constructed as to contain not less than three (3) nor more
than sixteen (16) gallons, and shall be provided with a handle or handles on the outside
thereof and shall have a tight fitting metal cover,
Such cover shall not be removed except when necessary to place garbage therein
or to remove garbage therefrom, and at all other times said cover is to be no place on said
tank vessell or receptable.
Each such vessell tank or receptable shall, be kept or placed in the manner
following,
When there is an alley other than a blind alley in the rear of such premise, such
vessell tank or receptable shall be placed on the premeses within five (5)feet of the rear
property line,

When there is no alley other than a bind alley in the rear of such premises and
there is a side entrance to the rear or such premesis, each such vessell tank for receptable
shall be placed on the premesis at an accessible point, not less than fifty (50) nor more
than seventy five (75)feet from the front property line,
Where there is no alley other than a blind alley in the rear of the premesis nor
such side entrance each such vessell tank or receptable shall be places on the curb in front
of the premesis; all such deposeting of garbage cans to be made during or for the hour
fixed for the collecting of garbage therefore to be accessible to the garbage collector at
such hour,
Section 4, It shall be the duty of every owner, manager or person in
possession, charge or control of any boarding house, restaurant, hotel, apartment, or
eating house, and every person occupying a dwelling or flat within the City of
Huntington Beach, to provide or cause to be provided, and at all times to keep or cause to
be kept, convienient portable vessells, tanks, receptables or boxes for holding trash,
Each such receptable for trash to be accessible to the garbage collector, when
called for, by being placed along side the garbage collector, when called for, by being
placed along side the garbage receptables, mentioned in Section three (3) of this
Ordinance,
Section 5, It shall be unlawful for any person other than the owner of such
receptable, or any officer or employe of said City of the person, firm or corporation
holding a contract with the City of Huntington Beach, for the collection, removal and
disposal, or garbage, to interfere in any manner with any such garbage vessell, tank or
receptable,
It shall be unlawful for any person to place or cause, or permit to be placed in any
such garbage vessell tank or receptable, any substance other than garbage,
Section 6, It shall be unlawful for any person, firm or corporation to deposit
or cause or permit to be deposited any garbage or trash upon or in any public street, alley,
or other public place or upon any premises, in the City of Huntington Beach,
Section 7, The City of Huntington Beach shall enter into a contract with same
responsible contractor to collect all trash and garbage from all the various trash garbage
cans or receptables in the City of Huntington Beach, at the times and in the manner
prescribed in said, contract, to which contract shall for a period of not more than three (3)
yeasr, and which contract shall be accompanied by a bond in the penal sum of Two
Hundred Fifty ($250.00) Dollars with two (2) good and sufficient sureties to the effect
that the contractor will faithfully perform his contract and comply with all the ordinances
of the City of Huntington Beach, relating to the care and control of garbage, refuse, filth
and trash,

The City of Huntington Beach, may in awarding such contracting for hauling
garbage and trash as herein provided, advertise the same for bids,
Section 8, Any person, firm or corporation violating any of the provisions of
this Ordinance shall be deemed guilty of a misdomenear and upon conviction thereof,
shall be punishable by a fine in a sum not exceeding Three Hundred ($300.00) dollars, or
by imprisonment for a term for a period not exceeding ninety (90) days or by both such
fine and imprisonment.
Each such person, firm or corporation shall be deemed guilty of a separate offence
for any day, during any portion of which any violation of any provision of this Ordinance
is committed, continued or permitted by such person, firm or corporation and shall be,
punishable therefor as provided by this Ordinance,
Section 9. The City Clerk shall certify to the passage of this ordinance and
shall cause the same to be published by one insertion in the Huntington Beach News, a
weekly newspaper published and circulated in said City of Huntington Beach, and forty
(40) days thereafter it shall take effect and be in force,
