AN ORDINANCE ORDERING THE OPENING, WIDENING STRAIGHTENING AND EXTENSION OF DELAWARE AVENUE IN SAID CITY OF HUNTINGTON BEACH FROM THE SOUTH LINE OF FRANKFORT STREET SOUTHWARD TO THE RIGHT OF WAR OF THE LOS ANGELES INTER-URBAN RAILWAY COMPANY;AND NORTH FROM THE NORTH LINE OF MEMPHIS STREET TO THE NORTH LINE OF SECTION ELEVEN(11)TOWNSHIP SIX(6) SOUTH, RANGE ELEVEN(11) WEST, S.B.B. &M., IN THE CITY OF HUNTINGTON BEACH,AD APPOINTING THREE COMMISSIONERS TO ASSESS BENEFITS AND DAMAGES AND TO HAVE GENERAL SUPERVISION OF THE PROPOSED WORK. The Board of Trustees of the City of Huntington Beach do hereby ordain as follows: Section 1. Whereas,the Board of Trustees of the City of Huntington Beach, California,did on the 12'h day of May, 1913,pass its Resolution No 210 declaring its intention to order the following work and improvement to be done,towit: That Deleware Avenue in said City be opened,widened, straightened, and extended from the South line of Frankford Street Southward to the right of way of the Los Angeles Inter-Urban Railway Company; and North from the North line of Memphis Street to the North line of Section Eleven(22)Township. Six(6) South, Range Eleven (11)West, S. B B &M., in the City of Huntington Beach, State of California; and that the width of the Street intended to be opened,widened, straightened and extended North of Memphis Street shall be sixty(60)feet and that the same be opened,widened, straightened and extended through,over and along the various tracts of private property over which the land deemed necessary to be taken and hereafter particularly described passes, as and for a public Street, and that all of said land deemed necessary to be taken, be taken,condemned and acquired as and for said street and describing in said Resolution the lands and premises necessary to be taken therefore, and specifying in said Resolution the lands to be affect or benefitted by said work and improvement and to be assessed to pay the damages, costs and expenses thereof, and Whereas,the Street Superintendent of the City of Huntington Beach did thereupon cause notice of the passage of said Resolution to be posted and published for four(4) successive weeks in the Huntington Beach News,a weekly newspaper printed and published in said City of Huntington Beach, in the manner and as required by law; and Whereas,no objections have been filled against said proposed work and improve, and more than ten(10)days have elapsed after the expiration of the time of the publication of said notice of the passage of said Resolution,and the Board of Trustees of the City of Huntington Beach as acquired jurisdiction to order said work,as proposed in said Resolution,to be done: ORD. 109 1 Now,Therefore,It is hereby ordered,that said work and improvement be done as aforesaid and as specifically described in said Resolution of Intention No 210. Section 2. A.W. Griffith,W.T.Newland,and W.S. Hill are hereby appointed commissioners to assess benefits and damages and to have general supervision of said proposed work and Improvement untill the completion thereof in compliance with law. Section 3. The City Clerk of the City of Huntington Beach shall certify to the passage of this ordinance and shall cause the same to be published once in the Huntington Beach News,a weekly newspaper published and circulated in said City of Huntington Beach, and thirty(30)days thereafter it shall take effect and be in full force.
