THE ELECTORS OF SAID CITY, THE PROPOSITIOTi OF AMEMIM
ORDINAYCE 140. 209 OF SAID CITY IN ACCORDANCE WITH THE
INITIATIVE PETITION PRESENTED TO THE BOARD OF TRUSTEES
OF SAID CITY, ON THE 26th DAY OF J-UNE, 1922. i
WHEREAS, on the 26st day of June , 1922, there was filed

with the Clerk of .the Board of Trustees of the City of Huntington 1
Beach, a peti.t ion signed by qualified electors of the City of ,
Huntington Beach, not less in number than Fifteen per cent (15Z
of the electors of such City , and which petition contained a
proposed Ordinance of said City is ib hereinafter more particularly
set forth, and
WHERF,AS, each signer had added to his signature his
place of residence and occupation, giving street and number where
such street and number exists, :end whey~� no such street eu�d number

exists, then such designation of the place of residence as will
enable the location to be readily ascertained, and
WHEREAS, each separate payer contained In said petition

register.;tion of the said City of Huntington Beach ascertained i
that said petition w a s signed by not less than Fifteen' per cent i
(15i7,) of the qualified electors of such City of Huntington Beach, and
WHEREAS, said City Clerk has attached to `said petition
his Certificate, showing the .result of said examination, and

to the Board of Trustees of the City of Huntington Beach, being
the representative body of such City, at their next regular meeting
after the filing of such tetition, and

WHEREAS, said Board of. Trustees thenla" said ordinance -
at the regular session to which said ordinance was Dresynted, and
WHEREAS, said. Board of Trustees ordered the said Ordin-
ance to be su Bitted to a vote of the electors of the City of
Huntington Beach.
NOW THEREFORE, the Board of Trustees of the City of
Huntington Beach do ordain as follows :
SECTION 1. That a Special Election be :yield in the
City of Huntington Beach, California, for the object and 'purpose
of submitting to the qualified electors of said City of Huntin-S-ton
Beach, the proposition of passing and adopting an Ordinance in the
.'cords and figures, as follows, toiwit:

by Ordinance Number 211 of Said. City Entitled, "An Or-
dinance of the City of Huntington Beach Amending Section
1 of Ordinance No. 209 of Slid City Entitled 'An Ordinance
of the City of Huntington :3eu ch, California, Establishing
a Business u!-id Residence District in Said City and Pro-
hibiting the Establishment or Haintenance of Certain {
Businesses and Industried in said .District t , ".
The People of the City of Huntington Beach do ordain

as follows : i
That Section 1 of Ordinance #209 of ,the City of Huntington
Beach as amended by Ordinance #211 of said City entitled, "An Ordin-
ance of the City of Huntington Beach, California,, establishing a
business and residence district in said City and prohibiting the
establishment or maintenance of certain businesses and industries
in said district" be and the same is hereby amended to read as
follows :
"Section 1. That all the City of Huntington Beach,
California, within the following described boundaries is established
And declared to be a residence district , to ,wit :

SECTION 2. That said Snecial Election shall be held at and in
the City of Huntington Beach on the�2�a. !- _day of August
1922,
i,ihich Jay is hereby fixed as the date on which such Special Election
shall be held; that such- Election shall be a. Special Election and shall
be held separately from all other elections and at said election there
shall be submitted to the qualified electors of the said City of Hunt-
ington Beach, the proposition of the passage and adoption ofthe Ordinance
set forth in Section 1 hereof.
SECTION 3. That the ,aanner of holding such Special Election
on such .day and the vot ing for and against such -proposition shall be
as follows : The proposition of the -passage omd adoption of said pro-

posed Ordinance as set forth in Section I hereof shall be submitted to
the qualified electors of he said City of Huntington Beach by printed
ballots and the ballots used at such election, except as othe2:wise
provided for in this Ordinance shall be jDrepared , printed, furnished and
idstributed as provided by 1a1v for preparing , printing, furnishing and
-1istributing ballots at -_unicipal elections in the City of Huntington
Beach.
Each ballot shall be printed in substantially the following

To* vote on any question or proposition, stamp a cross (X) in the
voting square 'after the word "YES" or after the word "NO". .All marks
except the cross (X) are forbidden. All distinguishing marks or eras-
ures are forbidden and ma1.e the: ballot void.
If you ,,rrongly stamp, tear or- deface this Ballot return it to the
Inspector of Election and obtain another.
INITIAMIVE PROPOSITION.
Shall the Ordinance amending Ordinance No. 209
of the City of Huntington Beach and providing for YES
the changing of the exterior boundary lines of the
Residential District in the City of Huntington Beach
by excluding from said Residential District certain
territory now, ind.luded therein, be adopted. NO
That for the holding of said election the City of Huntington
Beach is hereby divided into t.,uo Election Precincts ; thcat s;.:iid two
i�recincts . shall be known as "Huntington Beach Special :Elect ion Precinct
Flo. 111, and "Huntington Beach Special Election Precinct -I o. 211 ; that
"Huntington Beach Special Election Precinct No. 1 shall include all of
"Huntington Beach Election Precinct No. 1" and "Huntington Beach Election
Precinct No. 2" as last established and designated by the Board of Super-
visors of the County of Orange, State of California for the polling place
of general State Elections. "Huntington Beach, Special Election Precinct
No. 2" shah embrace the same territory as "Huntington Beach :election
Precinct No. 3" and "Huntington Beach Election Precinct No. 411, as last
established and designated by ,the Board of Supervisors of the County
of Orange, State of California, for the holding of QVener 4l State Elections.
That .the polling places of "Huntington Beach Special Election
Precinct No. 1 and Yo. 2 shall be; No. 1 at the City Hall, #220, 5th. St.
No. 2 at C21

That if any of said members of said Board of Election are
not qualified to act or 'ail to appear at the opening of the polls
on the morning, of the clay, set for such election, the electors of
such Special Precinct -present at the t il_ae, shall appoint in her or
his dace, one -llo is qua;�_ified, who will take the required oath of
office as provided by the General Election Laws . of the State of
Cal ifor.nia.
SECTION 4. The Polls at the -polling ';.)lace hereinbefore
designated for said election, shall be opened at six o ' clock in the
:7o rni ng of the day of the election end shall be kept .continuously open
until seven o ' clock in the afternoon of the same day, when the polls
shall be closed, and that fact shall be -proclaimed aloud at such place
of election and after such _?)rocJ_ajxiation no ballot ,:., shall be received;
provided, however, that if at the hour of closing there are. any other
voters in the polling place, or in line at the door, who are qualified
to vote : c,nd who have not been able to do so since appearing at said
polling plaice, the polls shall be inept open a sufficient time to enable
them to vote ; but no one , who shell arrive at the polling place after
seven of clock in the afternoon, . shall be entitled to vote, although
the polls may be open when he arrives.
SECTION 5. In all particulars not recited in this Ordinance ,
said Special Election shall be held and conducted as provided by law
fox holding 1,111unicipal Elections in the City of Huntington Beach.
SECTION 6. Any qualified voter -Liay at said Special Election,

vote in favor of any p roposi.tion subi-aiitted, by stamping a cross (X) on
his or her ballot in the voting square at the right of the word ItyliSH
following the proposition voted upon and any qualified voter may vote
against any proposition submitted by stamping a cross (X) on his or her
ballot in the voting squ'are at the right of the word "NO" follow- ingthe

Section 7-

or her ballot shall be counted in favor of adopting the ordinance described
in said proposition; an.d if any voter at said Special Election, shall
have stamped a. gross W on his or her ballot in the voting square at the

ballot shall be counted against adopting the ordinance described in said
propos it ion.
Section.' 8. The City Clerk is hereby- directed to Droeure all
supplies that _nay be necessary to -properly and lawfully conduct said
Special Election.
Section 9. That when the polls have been closed, the returns
of. said election shall forthimTith be made to the Board of Trustees of
said City and signed by the officers of election and shall be by them
deposited with the City Clerk, together with the Ballots cast at- said
election and the Board of Trustees of said City shall meet and canvass
sdid returns in the Council Chamber at said City Hall of the said City,
being the regular -mcs.eting place of said Board of Trustees on the 22nd
. ,day of August, 1922, at the hour o L f 8 : 00 o' clock p.m. of said day and
if upon such canvass it shall be found that a majority of the qualified
erlectors voting on said proposed ordinance, shall have voted in favor
thereof, then such ordinance sh,,.11 :thereupon be the valid and binding
at
ordinance of the City of Huntington Beach and be considered as adopted
upon the day the vote is canvassed and si declared by the said Board
of Trustees and shall go into effect ten days thereafter.
'Section 10. The City Clerk shall certify to the passage
and adoption of this ordinance and shall •cause the same to be published
by, one insertion in the Huntington 3each 1,11*eiFis, a weekly newspaper, printed,
published and circulated in the City of Huntington Beach, Orange County,
