AN ORDINANCE OF THE CITY OF HU-I IGTON
. . BEACH, CALIFORNIA, PROVIDING FOR THE
ISSUING OF THE BONDS OF THE CI^lY OF
HUNTINGTON BEACs1, AUTHORIZED AT A SPE-
CIAL MUNICIPAL EZECTION, HELD IN SAID
CITY OF HUNTINGTOIvT BEACH, ON TUESDAY,
Tim 27th DAY OF FEBRUARY, 1923, FOR THL
PURPOSE OF THE ACQUISITION, CONSTRUCTION
AND COMPLETION SY SAID CITY OF A CERTAIN

WHEREAS, the Board of Trustees of the said City of
Huntington Beach, at a regular meeting of the said Board,
held on the 8'th day of January 1923, by a vote of more
than two-thirds of all its members, duly passed .a resolu-
tion determining that the public interest and necessity de-
mand the acquisition, -construction and completion by said
City of Huntington Beach of a certain municipal improvement,
to-wit;
The acquisition, construction and
completion of certain street work,
consisting of the improvement of
the main and connected thorough-
fares, into and from said city and
more particularly described as the
lighting of Ocean Avenue and the
paving and improvement of Ocean
Avenue, a portion. of Seventeenth
Street, and a portion of Delaware
Avenue, in the said City, of Hunting-
ton Beach, California.
WHEREAS, said resolution was approved by the President
of the Board of Trustees of said City of Huntington Beach and
attested by the City Clerk and ex-officio Clerk of the Board
of Trustees of said City on said 8th day of .January, 1923, and
WHEREAS, the said Board of Trustees did thereafter at

a. subsequent meeting of said Board, held on the 22nd day of
January, 1923, by the vote of more than two-thirds of all its,
j members duly pass and adopt an Ordinance of said City, calling
a special election to be held in said City of Huntington Beach,
California, to beheld on the 27th day of February, 1923, for
the object and purpose of submitting to the qualified voters of
said City, the following proposition for the purpose set forth
in said Ordinance, towit;

Shall the City of Huntington Beach, California, incur
a bonded debt in the sum of $300, 000,?00 for the object and
purpose of the acquisition, construction and completion of
certain -street work, consisting of the improvement of the
main and connected thoroughfares, into and from said City and
more particularly described as th4 lighting. of Ocean Avenue
and the paving and improvement of Ocean Avenue, a portion of
Seventeenth Street, and a portion of Delaware Avenue, in the
said City of Huntington Beach, California.
WHEREAS, said Special Municipal Election was held in
said City of Huntington Beach, on the 27th day of February* 1923,
as provided in said Ordinance calling the same, and by laver for
holding Municipal Elections in said City and said proposition of
incurring a bonded indebtedness hereinbefore mentioned received
the favorable vote of more than two-thirds of the votes of all
the voters voting at said Special Municipal Election, and
WHEREAS, all and singular, the provisions of an Act of
the Legislature of the State of California, entitled, "An Act
Authorizing the Incurring of Indebtedness by Cities, Towns and
Municipal Corporations for Municipal Improvements and regulating
the Acquisition, Construction: and Completion thereof, " which be.-
came a law, February 25th, 1901, and the Acts Amendatory thereto,
and the laws of the State of California, governing Cities of
the Sixth Class, and all ordinances of said City ,of Huntington .
Beach have been fully complied with so as to authorize the issue
of said ,Bonds, NOW THEREFORE,
THE BOARD OF TRUSTEES OF THE CITY OF HUNTINGTON BEACH DO
ORDAIN AS FOLLOWS ; ,

SECTION- I. That Bonds of the said City of Huntington Beach,
California, in the sum of three hundred thousand ($300, 000. 00)
Dollars be issued in accordance with the provisions of an Act of
the Legislature of the State of California, entitled; "An Act
Authorizing the Incurring of. Indebtedness by Cities, Towns and

Municipal Corporations for Municipal Improvements and Re-
gulating the Acquisition, Construction and Completion there-
of", which became a Law, February 25th, 1901, and the Acts
Amendatory thereof and supplemental thereto , and the laws of
the State of California, governing Cities of the Sixth Class,
and the Ordinances of said City, for the purpose of the ac;
quisition, construction and completion by said City of Hunting-
ton Beach of certain Municipal Improvements, to-wit :
The acquisition, construction and completion of certain
street work, consisting of the improvement of the main and
connected thoroughfares, into and from said city and more par-
ticularly described as the lighting of Ocean Avenue and 'the
paving and improvement of Ocean Avenue,, •a portion of Seventeenth
Street, and a portion of Delaware Avenue, in the said City of
Huntington Beach, California.
SECTION 2. That said Bonds shall be three hundred (300)
in number; that they shall be designated as "Huntington Beach
�2.un-icipal Bonds, 192311, and shall be numbered consecu-
tively from one (1) to three hundred (300) , both inclusive; that
said Bonds shall be issued. in the denomination of one thousand
dollars ($1, 000. 00) each; that the principal and interest thereof
shall be payable in lawful money of the United States ; that said
Bonds shall be dated the lst day of May, 1923, and bear interest
at the rate of percent ( 5 ) per annum, payable semi-annually
on the lst day of November and the lst day of May of each and
every year, interest pa$ments beginning on the lst day of November,
1923., and continuing until the full amount of principal and in-
terest shall have been paid!; that the principal and interest of
the said Bonds shall be payable at the Office of the City Treas-
urer of the City of Huntington Beach, California, in the following
manner, to-wit:

On the first day of May, A. D. (year of maturity)
the City of Huntington Beach, California, will pay to the bearer at
the office of the City Treasurer of. said City of Huntington Beach,
in the City of Huntington Beach, California, the sum of One Thousand
Dollars ($1, 000. 00) with interest thereon at the rate of five __,_per
cent (_L) per annum, payable semi-annually on the 1st day of November
and the 1st day of May of each year, interest payments beginning'
November 1st, 1923 at the office of 'the City Treasurer of said City .
of Huntington Beach, in the City of Huntington Beach, California,
upon the presentation and surrender of the .interest ° coupons hereto
attached. Principal and Interest payable in lawful money of the
United States. This Bond is issued in pursuance of the provisions
of an Act of the Legislature of the State of California, which be-
came a Law, February 25th, 1901, and all amendments thereto, authori-
zing the incurring of indebtedness. by Cities for Municipal Improve-
ments,
It is further certified that all requirements of the
Constitution and Laws of the State of California and all Ordinances
of said City of Huntington Beach, -have been fully complied with by
the proper officers in the issuing of this Bond; that this issue
of Bonds has been authorized byba vote of more than two-thirds of
the duly qualified voters of said City, voting at a Special . 7,`�
Municipal. Election, held * in the Said City on the 27th day of February,
1923, and that the total amount of this issue, together with all
other indebtedness of said City, does not exceed the limit prescribed
by the Constitution and- Laws of the State of California. That before

or at the time of incurring the indebtedness evidenced hereby,
provision has been made for the collection of an annual tax
sufficient to pay the interest of such indebtedness, as it falls
due, and also a. provision to constitute a sinking fund for the
payment of the principal thereof on or before..maturity.
IN WITNESS WHEREOF, the City of Huntington Beach '_nas
caused this Bond to be signed by the Executive of said Municipality,
to-wit: The President of the Board of Trustees of said City, and
also by the Treasurer of said City and to be countersigned by the
Clerk of said City and the corporate seal of said City to be af-
fixed.-,thereto and the said City .has also caused the coupons thereto
attached to be numbered consecutively and signed by the Treasurer '
of said City of Huntington Beach.

SECTION 4. That the President of the Board of Trustees
of said City of Huntington Beach and the Treasurer of said City
of Huntington Beach, are hereby authorized and directed to sign
all of said Bonds and the City Clerk is hereby authorized and
directed to countersign and to affix the corporate seal of said
City to all of said 300 "Huntington Beach Muiaicpah Bonds
192311, and the City Treasurer of said City is hereby authorized and

directed to sign the interest coupons on said Bonds and said
-Bonds shall be delivered by said City Clerk to said City
Treasurer in such amount as the Board of Trustees of said City
may from time to time determine, and said City Treasurer is
hereby •authorized and 'directed to sign all the interest coupons

SECTION 5. That the proceeds of the sale of said
"Huntington. Beach Municipal Bonds, 1923", shall be placed in
the treasury of said City to the credit of a fund to be known
as the "Municipal Bond Fund, 1923", which proceeds shall be ap-
plied exclusively to the purpose of the acquisition, construction
and completion by said City of Huntington Beach of certain Ik1uni-
azipal Improvement, to-wit: The acquisition, construction and
completion 'of certain street work, consisting of the improvement
of the main qnd connected thoroughfares, into and from said City
and more particulatly described as the lighting of Ocean Avenue
and the .paving and improvement of Ocean Avenue, a portion of
Seventeenth Street, and a portion of Deleware Avenue, in the said
City of Huntington Beach, California.
SECTION 6. That for the purpose of securing and providing
for the principal and interest of said "Huntington Beach iirunicipal
Bonds, 1923", there is hereby created a fund of said City, to be
known as "municipal Bonds,. 1923, Interest and Sinking Fund". That
all money which shall from time to time be placed in said fund
shall be and is hereby set apart exclusively for. the purpose of
meeting all sums coming due for principal and interest of all of
said "Huntington Beach Municipal Bonds, 1923", which may be issued
under the proceedings hereinbdfore recited. That for the '-purpose
of pay..ing the Principal and Interest of, said Bonds, the Board of
Trustees of said City shall. at the time of fixing the General Tax
Levy and in the manner for such General Tax bevy pro_v_i.ded, levy
and collect annually a tax sufficient to pay the interest of such
indebtedness as it falls due, and also to constitute a sinking fund
for the payment of the principal thereof on or before maturity.
Said tax shall be in addition to all other

taxes levied for municipal purposes and shall be collected at
the same time and in the same manner as other municipal taxes are
collected$ and forthwith, as collected, shall be turned over to
and paid into said - " uiicipa�.` Bonds, 1923"", Interest and
Sinking Fund", and be used for no other purpose than the payment
" of said Bonds and the interest thereon.
SECTION 12. The City Clerk shall certify to the passage
and adoption of this Ordinance and shall cause the same to be
;published by one insertion in the Huntington Beach News, a weekly

This Ordinance shall take effect and be in force from and
